Dear Ms. Shodeen:
We have received a cop of a letter sent from y our office to Mr. Dar Knutson of
Northern States Power re zonin issues in the Cit of Oak Park Hei
I
The Cit of Oak Park Hei has approved a Conditional Use Permit with a variance to
NP for the construction of a coolin cell tower at the A.S. Kin Plant. This Conditional
Use Permit is contin upon receivin all approvals necessar from the DNR.
As indicated in our River Impact District Zonin Ordinance, "an applicant seekin an
form of buildin permit approval within the River Impact District shall first file for a
conditional use permit and g ain approval from the Cit Council". This is the procedure
that we have followed. Also indicated in our River Impact District Zonin Ordinance
"application of district re shall be imposed as an overla upon currentl applied
zonin use districts''. As such our consideration of the River Impact District was
inherent in our decision makin
The Conditional Use Permit specificall states in Condition 3 that " written approvals are
received from the Corps of En Minnesota Pollution Control A and the
Department of Natural Resources for the 11 proposed NSP structures". Condition 6
provides for an other conditions of Cit staff".

401 e 344A. Purpose. This Section is established to provide necessary protection to
lands which fall within the designated regional floodplain and Lower St. Croix National
Scenic Riverway area as defined by Minnesota Department of Natural Resources
regulations.
401.34. B. Dlstdct Boundary and Application. For purposes of this Ordinance, the
River Impact District shall include all lands lying riverward from the Chicago, Milwaukee

St. Paul and Pacific Railroad right-of-way. Application of district regulations shall be
imposed as an overlay upon currently applied zoning use districts.
401.34.C. Development Regulations. All development within the River Impact District
shall be jointly regulated according to the following State regulations, adopted herein b
