RE: NSP Kin Plant Coolin Tower Hei Variance Re St. Croix River
Dear Mr. Melena:
The Department of Natural Resources has reviewed the information received April 3 and April 10, 2000
relative to the hei variance re for the new coolin tower at the Kin Plant. The new tower
exceeds the setback from the main channel of the river.
After careful consideration of the issues and the minutes of the March 14, 2000 Cit Council meetin
the Commissioner of Natural Resources hereb certifies the variances as compl with the intent of the
National Wild and Scenic Rivers Act, the federal and state Lower St. Croix River Acts, and the Master
Plan adopted thereunder, and Minnesota Rules, Parts 6105.0351 to 6105.0550. The DNR is willin to
work with the applicants on maintainin a buffer adjacent to the river as well as selection of screenin
ve that the applicant has a to plant.
In the future, please be advised that Section 401.34 of y our ordinance adopts Minn. Re NR 2200-2202
(now numbered Parts 6105.0351 to 6105.0550 Under these re 6105.0530 lists the
re for public hearings, which include notification of the DNR at least 20 da prior to the
hearin Part 6105.0540 g ives the criteria and procedures for DNR certification. In addition, the
Riverwa re contain standards for minimum structure setbacks, 35' hei limit and 20% lot

industrial, must be reviewed usin the above referenced rules. Moll Shodeen at the Metro Re is
available to explain the details of these re to cit staff if desired. We realize that q uestions come
up infre within the cit since the river fronta is primaril industrial and commercial. The cit
has also adopted Floodplain Mana Standards. We assume that the new structure will compl with
the floodproofin standards in the buildin code.
