A C U R B A N P L A N N I N G • D E S I G N • M A R K E T R E S E A R C H FILE COpy MEMORANDUM TO: Oak Park Heights Mayor and City Council FROM: Curtis Gutoske DATE: 9 August 1990 RE: Oak Park Heights - Conoco (Revised Plan) FILE NO: 798.02 - 89.14 Conoco Inc. has submitted a revised site plan, dated 8/7/90, for their mini - mart /gas station to be located at the corner of Omaha Avenue and the south frontage road on the Dairy Queen site (please see the attached site plan). The revised plan follows the intent of Conoco to construct the facility as approved last October with the exception of the car wash being removed from the principle building and placed in an accessory building to the rear of the lot. This revision is found to be relatively minor and does not require a CUP amendment to be processed. No revisions have been proposed to the gas pump area, the parking stalls, curb cuts, or the basic size and location of the mini -mart. An item that has arisen, however, is that the car wash is now considered an accessory building. Section 401.03.B.5 of the Zoning Ordinance requires that all accessory buildings for commercial properties be no greater than 30 percent of the main floor area of the principle building. Either the car wash must be reduced by this amount or the mini -mart must be increased to 2,640 square feet in size. The larger mini -mart would allow for an accessory building of 792 square feet. It is not recommended the proposed plan be approved as it would require a variance for which there is no hardship. If the applicant decides to enlarge the mini -mart, this would be a viable alternative as the fourteen parking spaces now provided would satisfy the new parking requirement of the larger building (twelve spaces). The mini -mart could be expanded by extending the building 20 feet to the east. This would fit within the adjacent landscape area and would not require an alteration of the drive aisle. Should the applicant pursue this or a similar alternative, a revised detailed site plan, landscape plan, and grading plan must be submitted and subject to staff review before any building permits are issued.
