At its January 11, 2001 meeting, the Planning Commission voted to deny the application
of Chuck and Judy Dougherty to rezone their Cover Manor property located at 15330
58 Street North. The Doughertys had requested creation of a separate R -1 Zoning
District that allowed for large bed and breakfast/inns. Their Cover Manor property is
currently used as a residence for the family and as a bed and breakfast with four guest
suites. The family is proposing an expansion that would add a total of ten guest suites,
meeting rooms, a commercial kitchen, a small breakfast room and a lounge /social room.
The Planning Commission determined that it must deny the Doughertys' application
within the 120 day timeline in order to review other zoning options for allowing an
expanded bed and breakfast use. At their February meeting, the Planning Commission
will open a new public hearing to hear comments related to allowing bed and breakfasts
as conditional uses in the R -1 District. With this proposed change, bed and breakfasts
would be allowed in all residential districts, but with significant conditions that would limit
the use to the Village and Upper neighborhoods of Oak Park Heights. The existing
permit conditions would be expanded to limit bed and breakfasts to residences of 80
years in age or greater and to tie the numbers of allowable units to the lot size. The
conditions would be based on similar limitations found in the Stillwater Zoning
Ordinance.
Residents of the Village neighborhood of Oak Park Heights were present at the January
public hearing to express support for the Doughertys' proposal, as long as the long term
impacts of this use are controlled. The Planning Commission recognized the potential
impacts of the proposed bed and breakfast ordinance changes and asked staff to notify
all residents east of Osgood Avenue of the upcoming February meeting.

The Planning Commission moved to direct staff to schedule the hearing, notify the
residents of the community as indicated, and draft proposed ordinance language for
consideration. The Planning Commission also wanted staff to attempt to notify as many
residents as possible through the City newsletter, and newspaper articles.
