A public Hearing for your development application was held March 8, 2007 and a recommendation was forwarded t the City Council, who granted project approval, subject to conditions established by City Resolution -0 -1 on March 27, 2007. A copy of this resolution is included for your reference. Please rote that March 2-7, 20o8 is just a short couple of months away. Prior to this date, you must enter into a Development Agr6ement with the City and you must address any other outstanding matters in order to maintain the file in an active status. if steps are not taken to rove this project forwar , the file will be closed at the end of the business day March 27, 2oo8 and a new development application process will be required for any activity to this development site to occur. Moreover at this tire, you owe the City $x,873.81 related to services rendered for building plan review. Please remit this amount not later than February 29, 20o8. FOR SITS PLAN AND DESIGN GUIDELINES I2EVIEW TO CONSTRUCT AN 11,050 SQUARE FOOT RETAIL BUILDING, LOCATED SOUTH OF I- IIGHWAY 36 AND EAST OF NORELL AVENUE NORTH, ADJACENT TO THE ENTRANCE TO WAL MART BE APPROVED WITH CONDITIONS WHERE AS, the City of oak Park Heights has received a request from Manle Comm ere I nc. for site plan and Design. Guidelines review to construct an l 1 5 o square foot retail building, located south of Highway 36 and east of Norell Avenue North, adjacent to the entrance to Wal Mart; and after having conducted a review relative thereto, the Planning Commission n o oak Park Heights recommended that the applicable be approved with conditions. The City Council of Oak Park Heights makes the following findings of fact and resolution I . The real property affected by said application is legally described as :follows, to wit SEE TrA.CHMEN' A. and .. The applicant has submitted an application and supporting documentation to the Community Development D epartment consisting of the Following items: SEE ATTACHMENT B and 3 . The proposed site is .91 acres and zoned BM , L imited Business District; and 4. T request is for site plan and Design Guidelines review, no public hearing is necessary- and 5 . The site is p artially encumbered by a n access easement for the W l Mart entrance; and 4 6 . City staff prepared a planning report dated March 1, 2007 review' I g the request; and '. The planning report dated Marc h 1, 2007 recommended that the requests be approved with conditions; and 8. The Planning Conmiission held a review at their March 8, 2007 i eeting, took comments from the applicants and public and recommended that the application be approved with conditions. NOW, THERE FORE , BE IT RE SOLVED BY THE CITY COUNCIL FOR THE CITY of OAK PARK HEIGHTS THAT H CITY COUNCIL APPROV S THE, FOLLOWING: A. The application submitted by Marley Commercial Inc. for site playa and Design Guidelines review to construct an 11 ,05 o square root retail building, located south of ig way and cast o f NorelI Av enue North, adjacent to the entrance to- Wal Mart and affecting the real property as follows: SEE ATTACHMENT A Be and the same as hereby approved by the City Council of the City of oak lark Heights with the 'ol o ing conditions: The Wal Mart freestanding sign, including foundations, shall be removed no later than May 1, 2007. The applicant shall post a cash escrow, as specified by the development agreement, that will be released upon sign removal and as approved by City staff. 2. The grading, drainage and utility playas are subject to the review and approval of the City Engineer. 3. The proposed signage for the site shall be consistent with Section 401.15.G of the Zoning Ordinance. A sign permit shall be obtained prior to the erection of any signs on the subject site. 4. Landscape playas shall be subject to the review and approval of the City Arborist. 5 The applicant must submit updated lighting plans detailing the proposed parking lot and exterior building lighting, subject to City staff's review and approval. All lighting shall be full cut off fixtures and compliant with Section 401.15.B.7 of t e Ordinance. 6. The Planning Commission and City Council was favorable to the building elevations and building material selection. '. A snow removal plan shall be submitted for City staff review and approval. 8. The applicant shall provide a plan indicating locations of mechanical equipment and screening subject to review and approval of City staff. 2 9. The applicant shall bury the overhead distribution lines along 01" Street North. The timing o that improvement shall be coordinated with the burying of distr xbution lies I front of Lowe's along 60 Street North. The applicant shall escrow sufficient funds, as specified by the City Engineer, to complete the improvement or agree that the City will complete the work and petition for the public improvement, vai i ; notice of public hearing and assessments, as required tinder Minnesota Statute 429. 10. The Wal Mart access agreement and easements shall be provided to the City Attorney for review and approval. 11. The final trail location and placement along 60 "' Street North shall be subject to review and approval of the City Engineer. 12. The applicant shall provide a plan for a central postal boy for the center, subject to review and approval of the City and the Postmaster. 13. A development agre ement shall be required, subject to review and a pproval of the City Attorney. 14. The drainage plans shall be subject to review of the Browns Creek Watershed District.
