Attn: Mike Forsythe FROM: Eric Johnson, City Adminis City of Oak Park Heights RE: Permits for Oak Park Commons land clearance, site/contour grading, erosion control and pond storm sewer outlet systems In addition to all City Ordinances and Codes, the following conditions are incorporated and made part of the Gradin2 Permit No. 2006-00090 and must be completed and/or followed by the Applicant: 1. This permit has been issued for the land clearance, site/contour grading, erosion control and pond storm sewer outlet systems as located on the property known as Oak Park Commons and as may be owned by CSM, Inc, Lowe's and/or other parties. The Applicant shall verify ownership prior to commencing any work. This permit does not authorize any work related to the installation of private utilities proposed to serve the Project (Oak Park Commons); this work must be permitted separately. 2. This permit authorizes that the Applicant for the Project, which includes the properties as owned by CSM, Lowe's and all other parties, shall comply in total with the grading plans as submitted by the Developer (CSM/Lowe's) and approved by the City Engineer. These plans are dated 5/4/06 from Ozark Engineering and 5/3/06 from Alliant Engineering. These plans are attached here in 8 1/2" x 11" form for reference purposes only; please see actual plans from Ozark and Alliant. There shall be no deviations from the plans as approved by the City Engineer without the prior written consent of the City Engineer. The terms and conditions as written in the letter dated May 12 2006 from the City Engineer's office are hereby incorporated into this permit and are also attached hereto. 3. This permit allows for "Staggered Grading". No grading shall be undertaken in the area depicted on the attached map (DATED 3/14/06 — as received by the City from Cory VonEngen on 5/25/06) until such time as and all structures, buildings, footings, septic tanks, wells, etc have been properly removed. When the demolition for this area is complete, the Applicant may contact the City for a review of the site and an expansion of this permit to allow grading of this area. 4. This permit requires that all wells are located and closed utilizing the most complete and safe process to protect groundwater resources and per proper Minnesota Dept of Health and/or MPCA procedures. Only a Minnesota licensed firm specializing in well closure may perform and oversee such work. 5. In areas of any suspected land contamination, such as all existing buildings to be demolished and adjacent site areas, the Applicant shall secure an appropriate Minnesota licensed soils-scientist or environmental engineer to monitor and manage all excavations and/or demolitions. Should any unsafe or improper conditions be found, all work shall cease, the City, the Washington County Health Dept. and the MPCA shall be immediately notified in writing and then proper remediation activities shall be undertaken by the Applicant to correct and remediate any pollution sources. The City shall be notified by the Applicant, in writing, of all remediation or correction activities. 6. Any and all excavation debris, materials and equipment being removed from the City and/or that will be accessing public roadways shall be done in a method that is fully compliant with Minnesota state law, which includes the covering of loads, proper manifesting and final disposal. 7. No material may be removed from Project's property / development area and replaced and/or relocated within the jurisdictional limits of the City of Oak Park Heights without the City's prior and specific written consent for such placement. The Applicant shall first verify with the City should any material be leaving the site to a location within the City. Otherwise all material shall remain either on site or removed from the City. 8. Dust control techniques such as appropriate site watering and soil stabilizations shall be implemented and maintained at all times. 9. The City shall be provided a legible copy of all well closure-- e , documents by 3 :00 pm, Friday, June 2 nd 20 06. 10. Operating of equipment shall not commence on at the site prior to 7 am and shall cease at 9 pm. 11. The Applicant shall coordinate with the owner(s) to ensure continued compliance with all applicable terms and conditions of the Development Agreement for the Project. Failure of the Applicant to comply with the conditions as set forth above may result in this permit being revoked. All previous comments have been addressed to our satisfaction, with the exception of the following. (These comments can be addressed after issuing the grading permit, but prior to construction.) -Lowe's Construction Plans signed 5-04-06- Submitted by Ozark Engineering, Inc. Drawing Number 5 1. The plans show for the removal of the existing curb inlet on Norwich Avenue, however as shown on Drawing Number 6, the storm sewer outlet from the pond connects to this structure. Verify this with Alliant Engineering. General Comments 1. All previous comments have been addressed to our satisfaction. 2. The future phase does show parking stalls perpendicular to the center private road through the development. As stated in the letter of December 1, 2005, we believe this presents an unsafe situation and strongly recommend these parking stalls be reconfigured with the final design of this area. Alliant Engineering has indicated that the developer wants to keep the site plans as shown. Permits for Lowe's and Oak Park Commons We have received a copy of the MNDOT permit and the NPDES permit; however we still need to receive a copy of the approved BCWD permit prior to the City issuing the grading permit. Once this is received a grading permit can be issued for both developments. Any deviations from these plans, prior to or during construction, shall require written approval from the City Engineer.
