The City has 30 calendar days from bid opening to execute the contract and by May 15 to allow work to commence on the site. Accordingly, the City will be preparing the final documents necessary to execute an agreement so that this work may proceed per the timelines. However, prior to Burschville commencing, specific site grading work needs to be completed by the Developer for the City's Novak Ave. N, and Norwich Ave. N. (tlblkla Nova Scotia Avenue North and Norwich Ave) — Street and Utility improvement Project. This work includes the following: The rough site grading of the full right -of -way on Novak Avenue North, from 58 Street to 00 Street, in accordance with the approved street grades and typical street section. The rough site grading of the full right -of -way on Norwich Avenue North, 300 feet south of the existing cul-de -sac, in accordance with the approved street grades and typical street section. The installation of the proposed storm sewer within the right-of-way on Norwich Avenue North. 0 Removal of all wells and septic systems, the City must be provided appropriate closure documents from your contractors and the County if applicable. To date, the City has not received a demolition permit application. These items must be completed by the Developer prior to May 14, 2006 to enable the City contractor to meet the requirements of the Contract Documents and Plans and Specifications, and more importantly to allow the City Contractor to meet the specified Milestones and Substantial Completions dates. Should CSM not be able to complete these items by end of business day May 14 2006 CSM will be responsible for all possible change order costs. It is also possible that the City may be required to re-bid such work, for which the City cannot be held responsible for project delays. Please note that both CSM and Lowe's concurred with the specified Milestones and Substantial completion dates as part email correspondence dated March 3, 2006 as attached. Also due to bid requirements, the City needs to sign the Contract with Burschville before April 23, 2006 or release the contract. Burschville needs to secure pipe, steel and related materials which requires their production orders to be in by April 23 2006. If CSM has not signed the Development Agreement, posted all securities and needed performances by Wednesday, April 19 2006, the City will be required to release Burschville from their bid.
