The City has obviously noted the non-compliance for CSM requirement that they bury the distribution lines that lie within the frontage road. You will recall that the City released them from a STOP WORK ORDER for a period of 8 months. At this time, we are offering them an opportunity to not comply with the burial of these lines, but that they will agree to a special assessment in the future. This is a similar requirement as approved in the final resolution for Manley Development next to Appleby's. The City has noticed a property owner on Memorial Ave of two violations — one sign permit violation and another relating to the need for a CUP to operate a daycare facility in this area, (required under such B-3 zoning). Accordingly the owner, Mr. Jon Whitcomb has completed the necessary application documents and this will be processed at the May planning commission.
