Dear Tom and Pat;
I was presented your request for information on alcohol at a wedding reception to be held at Boutwells
Landing in October 2011.
Your intent of having the Harbor Bar provide alcohol is not a permissible act since they are not licensed
in the city. No one can charge for alcohol without a license. The harbor bar is not eligible to be licensed
in Oak Park Heights since they do not have a physical location within Oak Park Heights.
You personally would be able to purchase the alcohol or have them give it to you from their bar in
Stillwater, and then you give it away at the reception. If you do purchase it or receive it for free, no fee
can be charged for it. You cannot charge a fee such as an entry fee to the event, or glass fee and then
"give away" the alcohol. I would refer you to the city web site at www.citvofoakparkheights.com and
the city ordinance sections 1201 to 1204 regulating alcohol. These ordinances generally mirror state law
which also regulates alcohol sales and possession.
We have city ordinance 1205 regulating persons under 21 consumption and possession. This Social Host
Ordinance makes it a criminal act for you as the supplier of alcohol or controlling the location to not
reasonably control access of alcohol to persons less than 21 years of age.
If you were intending on having the event outdoors at the city park you will need to be out of the park
by 10:00 PM. You will need to apply for a permit from the city administration to use the park and if you
plan to allow any alcohol. No alcohol can be consumed in city parks without prior permit.

On October 22, 2011 our daughter is having a wedding and reception at Boutwells Landing in
Oak Park Heights, Minnesota. We would like the Harbor Bar and Restaurant, located in
Stillwater, to be able to serve beer, wine and /or liquor on that date (the food will be catered by
Boutwells Landing). The owner of Harbor Bar will be providing his services as a wedding gift.
We are planning to charge a nominal fee for alcoholic beverages, although soft drinks will be
provided free of charge.
We are requesting your authorization to utilize Harbor Bar to provide this service. We would
also like to know what licenses and /or permits might be required for this private event.
