Re: Swimming Pool @ North End of Towhome Parking Area
Dear Property Owners & Occupants:
Private swimming pools are regulated by City Ordinance 1303 and defined by section 1303.01. A copy
of this ordinance is enclosed.
There is a free - standing swimming pool erected at the north end of the parking area behind your
townhome complex which appears to have a water depth of greater than 18 inches, meeting the
definition of a private swimming pool and making it subject to the requirements set forth in City
Ordinance 1303.
The pool as placed in the parking area poses a life safety hazard and does not comply with the
requirements of City Ordinance sections:
• 1303.02, in that a permit for private swimming pools is required; and
• 1302.12, in that swimming pools shall not be located within ten (10) fee of any side or rear lot
line, nor within six (6) feet of any principal structure; and

• 1303.03, in that swimming pools shall be surrounded by a fence or wall not less than four (4)
feet in heights and without vertical or horizontal openings greater than four (4) inches, except
for doors and gates. An above - ground pool with a wall greater than four (4) feet does not
required a fence if the wall cannot be readily climbed by children; and
® 1303.05, in that above - ground pools shall be equipped with self - closing and self - latching gates
or doors so that the gates or doors are kept securely closed at all time; and
® 1303.04, in that there is no life- saving emergency equipment on site.
This letter directs that the pool be removed by its owner no later than Wednesday, June 29 2011.
City Ordinance 1303, in its entirety, shall govern any pool installation, should a pool installation be
desired at the townhome complex.
