The Cit did contact Lowe's to advise them of two site violations relatin to outside stora
see enclosed letter. Also, the Cit has received a report from Terracon Consultin
En related to .owes' g enerator and compactor noise levels. The g enerator exceeds
MPCA standards on the east side of the propert Skanska has informed the Cit that the
will be installin a barrier of some form that will resolve this issue and brin the nose levels
into compliance.

for each Council member. Please also note that MNDOT will be providin a END of the

Autumn Hills Park Shelter
Pro remains slow at the Shelter, however this past week it appears that much of the
electrical conduit has been installed, the roof is nearin completion and work has
commenced in the vaulted ceilin area. An interestin point however, is that a sk that
has been installed in the servin area instead of the women's restroom. I have advised
ARCHNET who in turn contacted DNR Construction — who then stated that there will be
one installed in the women's restroom at no char to the Cit I have asked for a Chan
Order to be issued to this effect, but to date I have not y et received it. Please note that Jan
1 " will• be a date where we will evaluate pro for substantial completion.

As the city has requested, a noise survey has been conducted at the recently
constructed Lowe's Home improvement store to measure the noise level created by
the generator and trash compactor located at this site, Attached with this letter is the
report dated January 8, 2007, prepared by Terracon, a local independent testing
agency, Minnesota Pollution control Agency Eloise pollution Control Standards
were used in determining acceptable levels of compliance.
The results of the sound testing found that the trash compactor is in full compliance
with MPCA standards. However, the Generator exceeded noise standards at one
monitoring point (east property line ).
Lowe's is currently pursuing options to reduce the noise levels to be within the
MPCA guidelines. One of the options proposed by the generator manufacturer is a
Level i sound housing enclosure, however, the lead time for design fabrication and
installation would be approximately 12 weeks. Several other options are also under
consideration that would reduce the noise output,
I expect Lowe's to finalize a sound reduction plan shortly and will send you an
update as soon as this occurs, Feel free to give me a call with any questions or

Dear Mr. Hawkinson:
Terracon consultants, Inc. (Terracon) has completed a noise survey at the above referenced
site. The purpose of this letter is to present the results of the noise survey.
Project Information
Terracon completed a noise survey at the request of Collins Electrical Construction
Co, /convergent Media for an electrical generator and trash compactor located on the exterior of
the Lowe's store in Oak Park Heights, Minnesota. The noise survey was conducted in general
acco rdance with the Minnesota Pollution control Agency (MPGA) Noise Pollution Control
Standards as set forth in Minnesota Rules Chapter 7030 and A Gtficle to Noise Coiitrof it)
Minnesota issued by the MPcA and dated March 1999 (Noise Control uidance). The purpose
of the survey was to measure the noise level created by a generator and trash compactor at a
property adjacent and east of the site where residential town hornes are to he constructed.
Noise Survey
A Terracon representative conducted a brief survey of the propert adjacent to the site in
order to select the most appropriate monitoring location, Based on a telephone conversation
with Eric Joh of the City o f Oa k Park Heights, the monitoring loc -rations were tirnited t o
points on the site property itself and not on adjacent propertie - -s. The Terracon representative
selected two monitoring points on the property line of the site. Point 1 was located near the
southwest corner of the property approximately 175 feet west and 35 feet south of the trash
compactor. Point 1 was selected for its proximity to the trash compactor and for its distance
f rom a harrier wall that has been erected on the southern property line. Point 2 was located on
the eastern property line approximately 239 feet east and 59 feet south of the generator. Point
2 was selected for its proximity to the generator and an a djacent property tc 111e east that
eventually support town homes. A sketch of the site and the monitoring points is provided can

the noise survey form attached. According to Minnesota Rules 7030,0050, the site has a Noise
Area Classification (NAG) of 2 for retail trade facilities.
Sound lev measurements were taken using a Quest 1200 sound level meter equipped with a
wind screen attachment. The sound level meter was set to the "A" weighted scale used for
measuring sounds wi thin the range of h uman hearing and all measurements were taken using
the "FAST" response setting. The sound level meter was mounted on a tripod at a height of
approximately 3.5 feet above the ground surface. Prior to conductir)g measurements, the
sound level meter was calibrated using a calibration attachment. The calibration information
was recorded on the attached noise survey fora. For the background noise level, several
measurements were take over a period of 1 0 rninutes and averaged. The background noise
level was estimated at approximately 50 decibels (dBA).
Generator Monitoring
Monitoring of the gener noise level was conducted for one hour monitoring points 1 and
from 1:30 pr i to 3:30 pm. A sound level reading was made even 10 seconds during the hour
for a total of 360 readings for each monitoring point, The sound levels were recorded on the
manual rponitoring data sheet attached. A light breeze of approximately three to five miles per
hour was observed from the north an the temperature was approximately 45 `)1 .
Using the method described in the noise Control Guidance, the 10 "' and 50' percentile noise
levels (L10 and t..50, respectively) were estimated using the results recorded on the attached
manual monitoring data sheets, The L10 and 1...,50 for the generator at monitoring points and
the noise standard for the NAC are listed below in Table 1 .

Trash Compactor Monitoring
The trash compactor was not monitored in the same manner as the generator because it did
not operate continuously. Terracon conducted measurements at monitoring points 1 and 2
while the trash compactor was operated once by itself and once while the generator was in
operation. In each case, the compactor operated for approximately one minute, which allowed

for six measurements. No change in sound level was observed at the monitoring points while
the trash compactor was operated at the same time as the generator; therefore the
measu rements were not recorded, Table 2 below lists the measurements trade while only the
trash compac operated, Because the sound level measurement varied by less than one dB
during the compactor operation cycle at each monitoring point, only one measurement value is
listed. The sound levels measured are shown on the attached manual monitoring sheets.

Conclusions
The L10 and 1-50 values from Table 1 and the measurements from Table 2 were compared to
the noise standards in Minnesota RUIes 7030,0040 for NAC 2. The measurements f or the trash
compactor at paints 1 and 2 listed in Table 2 did not exceed either the L10 or the L50 standard.
The L10 and L50 values estitriated for the generator at point- 1 did riot exceed the NA 2
standards; however, both the L10 and L50 values estimated for the generator at point 2
exceeded the NAG 2 standards (See Table 1).
Minnesota R ule 7030.0030 states that exceedances of noise standards for an NAC r not be
violated upon establishment of land use within the NAC, Based on the noise s tandard
exceedances observed at point 2 during operation of the generator, noise abatement measures
may be necessary depending on the application of noise standards by the local municipal
authority. The City of Oak Park heights should be consulted to determine if noise abatement
measures should be implemented.
