Adjourn ENCLOSURE 7 CITY OF OAK PARK HEIGHTS <. y` PLANNING COMMISSION MEETING MINUTES Thursday, June 16 2011— Oak Park Heights City Hall Call to Order: Commissioner Dougherty called the meeting to order at 7:00 p.m. Present: Commissioners Powell and Squyres; City Planner Richards, and Commission Liaison Alternate Runk. Not Present: Chair Bye, Vice Chair LeRoux; City Administrator Johnson and Commission Liaison Abrahamson. II. Approval of Agenda: Commissioner Powell, seconded by Commissioner Squyres, moved to approve the Agenda as presented. Carried 3 - 0. III. Approval of May 12, 2011 Meeting Minutes: Commissioner Powell, seconded by Commissioner Dougherty moved to approve the minutes as amended, noting correct conditions of approval for MCF -Oak Park Heights on page 4. Carried 3 - 0. IV. Department/Commission Liaison / Other Reports: City Planner Richards noted that in July the Commission would be reviewing an application from Applebee's for site plan and design guidelines standards as part of their proposed remodeling project. V. Visitors /Public Comment: None VI. Public Hearings: None. VII. New Business: None VIII. Old Business: A. Zoning Ordinance 401.30: to review B -2, General Business District performance standards related to energy efficiency, green space and building standards. City Planner Richards reviewed the June 9, 2011 Planning Report as to additional conditions suggested by the City Council at their May 24, 2011 meeting and discussed the same. Discussion ensued as to the suggested conditions noted within the planning report, including green space condition 1 related to no front yard parking applicability. It was noted that the condition should be reworded to state that there shall be no parking in the front yards adjacent to right -of ways. Additional discussion was held as to setback requirements for building heights that increase over 40 -feet in height, building height limitations, green space requirements, underground parking, and Minnesota Sustainable Building 2030 (SB2030) energy standards and Minnesota Building Guidelines (B3) requirements. The language for this energy efficiency requirement shall be worded so that it reflects that the requirement will be that of which is established by the State of Minnesota as amended at the time. Planning Commission Minutes June 16, 2011 Page 2 of 2 Richards noted that after the conditions have been clarified, the Commission may wish to consider reviewing other districts within the zoning ordinance that contain the energy efficiency provisions, green space and building standards in light of the discussion held since their amendment to include those provisions. City Planner Richards stated that he would research the language based upon the discussion shared with the Commission and also review the Zoning Districts with the energy efficiency, green space and building standards in them. Commissioner Powell, seconded by Commissioner Squyres, moved to table the discussion of this matter to the July Planning Commission meeting. Carried 3 — 0. IX. Informational: A. Scott Richards DATE: July 7, 2011 RE: Oak Park Heights — Applebee's — 13625 60 Street North — Design Standards Review TPC FILE: 236.02 — 11.04 BACKGROUND Apple Minnesota, LLC has made application for a Design Guidelines review for a remodel of the Applebee's Neighborhood Grill and Bar at 13625 60 Street North. Applebee's will not be changing the footprint of the building or the site. The exterior appearance will be upgraded with a tower feature on the northeast corner of the building. New signs and awnings will be installed. The interior of the restaurant will also be updated. No changes will be made to the screening for the mechanical equipment. We will construct a. box on the roof, in the northeast corner of the building, to create a tower. A stone veneer is applied to this area to complete the new entrance. The sign vendor will install a standing seam roof cap to the top of the newly created entrance. New signs, awnings and exterior light sconces will be installed on the building. The parapet cap will be painted Applebee's colonial red and the exterior wooded doors will be painted Urbane Bronze. The interior renovation will include replacing the wall vinyl, carpet, booths and chairs. We will freshen up the wood work by sanding and applying new polyurethane. The old light fixtures will be removed and replaced with new fixtures, but no new circuits or lights are added. We will not change the number of seats in the restaurant." ISSUES ANALYSIS Comprehensive Plan. The property is designated as Commercial on the Proposed Land Use Map. The Applebee's is consistent with this land use designation. Zoning. The property is zoned B-4 Limited Business District. Restaurants are a permitted use in this District. Parking. The number of seats will not be increasing with the proposed remodel. When constructed, the restaurant was constructed with the required amount of parking. No change to the parking lot or number of parking stalls is proposed. 2 Grading /Drainage /Utilities. There is no change to the site plan, thus the grading, drainage and utilities remain as is Landscaping. There will be no change to the landscaping for this site. Mechanical Screening. There will be no changes to the mechanical screening with the remodel and addition of the tower feature. Lighting Plans. Fixtures. The existing parking lot lights will not be changed. The gooseneck fixtures over the windows will be removed but the fixtures between the windows will remain. The remodel will include LED architectural lighting below the tower roof, within the eyebrow awnings above the two entrances, and on the awnings. As indicated in the plans, not all of the fixtures in the roof and awnings will be full cut off. The applicant has indicated that the lights will be installed in such a way as they are shielded and will be full cut off. Photometrics. The lighting plan as approved with the initial construction was in compliance with zoning requirements for lighting intensity. The light intensity is required to be less than one foot candle at the centerline of adjacent streets and 0.4 foot candles at the property line. The architectural lighting proposed with the remodel will not change that Tight intensity. Hours. Outdoor lighting for parking lots shall be turned off one hour after closing, except for approved security lighting. Signage. Freestanding Signage. The existing freestanding sign will remain but the signage on the pylon will be updated. The proposed pylon signs will be a total of approximately 168 square feet. Since the freestanding sign was installed, the signage requirements have changed. Pylon signs are permitted to be 20 feet in height and contain a total of 100 square feet of signage. The existing sign is 44.3 feet and has approximately 191 square feet of signage. The Design Guidelines indicate that ground or monument signs are encouraged over pylon signs. As part of the Design Review process, the City can require that the freestanding sign be brought into conformance. The Planning Commission should discuss whether this sign should be lowered to 20 feet and the signage is limited to 100 square feet. Wall Signage. The Zoning Ordinance allows for a total of two wall signs, each on separate facades. The current proposal provides for a replacement of the Applebee's logo on the two facade wall signs. That portion of the sign that reads "Neighborhood Bar and Grill" would remain. The overall amount of wall signage will decrease slightly with this change. The "Curbside to Go" wall sign was previously allowed by variance and would remain. 3 Above each of the two primary entrances, a "Welcome Back" sign is proposed. The signage does not contain a logo or the Applebee's name. They would be considered as informational and not count as an advertising sign. Sign Illumination. All of the proposed signs will be internally lit and in compliance with the sign requirements for illumination. Design Guidelines Sustainable Guidelines. City staff has questioned the applicant on how the project has been designed to achieve at least a certain degree of sustainability. The applicant will need to discuss the plans with the Planning Commission and indicate if these issues have been addressed. Architectural Guidelines. Facade Treatments The building was originally constructed with a definite base, middle and top. The proposed tower feature at the northeast corner of the building will add to the architectural interest and appearance of the facades. Ground Level Expression This is a one story building with a proposed tower feature at the northeast corner. The main entrances will be well defined with the awning and signage. Awnings As indicated, there are eyebrow awnings proposed above the main entrances. The cloth awnings over the windows will be replaced a painted metal awning structure. The awnings will be washed with Tight by the use of LED fixtures mounted in the structure. The Planning Commission should comment on the use of this architectural lighting feature. Transparency The building uses glass on all of the primary facades visible from Highway 36. The transparency percentages will not significantly change from the current building. Entries The building features a prominent entry. Roof Design The rooflines are broken by a raised parapet and the proposed tower feature. The rooftop mechanical equipment is screened. 4 Building Materials and Colors The applicant has provided color elevations and a paint chip of the color used for the exterior doors and another for the awnings and the metal roof on the tower. Building material samples will be available at the Planning Commission meeting. Franchise Architecture The building design and material selection will be consistent with the Cities design goals. Site Design Guidelines Building Placement No change to current site. Parking Areas No change to current site. Stormwater No change to current site. Pedestrian and Common Space The Comprehensive Park and Trail Plan includes a trail location along the south side of 60 Street. There are no trail connections on either side of this property at this time. The applicant shall develop a plan for the trail location, provide the City a trail easement and agree to build the trail at a later date when required by the City. The plans should also include a connection from a future trail to the front entrance of the building. Landscaping No change to current site. Trees /Shrubs No change to current site. Utilites /Service /Loading /Drive - Through /Storage Areas No change to current site. Lighting Addressed elsewhere in the planning report. Signage Addressed elsewhere in the planning report. 5 Pedestrian/ Bicycle Routes A bike rack should be added near the front entrance of the building. CONCLUSION / RECOMMENDATION Upon review of the requests for site plan and Design Guidelines review, City Staff would recommend the project with the conditions as follows: 1. All lighting fixtures shall be full cut off and installed in compliance with the lighting standards of the Zoning Ordinance. All visible interior lighting shall also be full cut off. The lighting specifications shall be subject to review and approval of the City Planner at the time of permitting. 2. The outdoor lighting shall be turned off one hour after closing, except for approved security lighting. 3. The Planning Commission should discuss whether the freestanding pylon sign should be brought into conformance with current sign standards of a 20 foot height and a maximum of 100 square feet of signage. 4. The Planning Commission should discuss whether the Tight wash of the awnings with LED fixtures is acceptable. 5. The sign specifications and methods of illumination shall be subject to review and approval of the City Planner at the time of permitting. 6. Mechanical equipment that is located on the roof and visible from street level or from neighborhood properties shall be screened with materials that blend harmoniously with the building facade materials. 7. The applicant shall address sustainability initiatives with the Planning Commission. 8. The Planning Commission should comment on the building material selection and colors. A materials board shall be provided by the applicant for the Planning Commission to review. 9. The City Council intends to construct an eight foot bituminous trail on the south side of 60 Street North adjacent to Applebee's. Applebee's agrees to a special assessment for this improvement and does hereby waive all rights they have by Minnesota State Statutes 429.081 or otherwise challenge the amount or validity of the assessments or procedures used by the City in levying the assessments. 6 10. The applicant shall provide a plan with a location of the trail and a trail easement, subject to review and approval of the City *Engineer and City Attorney. 11. The Planning Commission discussed the language and made some changes. In that there were only three Planning Commission members at the meeting, it was decided that the discussion would be continued to the July 14, 2011 meeting. The amendment that was recommended by the Planning Commission at their May meeting is as follows: B -2 District (Proposed Language) 401.30.E.11 11. Buildings in excess of three (3) stories or thirty -five (35) feet, provided that: a. The site is capable of accommodating the increased intensity of use. b. The increased intensity of use does not cause an increase in traffic volumes beyond the capacity of the surrounding streets. c. Public utilities and services are adequate. d. For each additional story over three (3) stories or for each additional ten (10) feet above thirty -five (35) feet, front and side yard setback requirements shall be increased ten (10) feet. e. The provisions of Section 401.03.A.8. of this Ordinance are considered and satisfactorily met. Staff would suggest the following additional conditions with the changes suggested by the Planning Commission: Energy Efficiency: 1. The project shall comply with the Minnesota Sustainable Building 2030 (SB2030) energy standards and Minnesota Sustainable Building Guidelines (B3) or as amended. Green Space: 1. There shall be no parking in the yards facing adjacent rights of way. Building /Design Standards: 1. On the third and upper floors, windows and /or architectural features that provide interest shall be included on all four sides of the building when permitted within the building code. 2. Abrupt changes in building heights and /or roof orientation shall be diminished by offsets of building form and mass. 3. Recesses and projections to visually divide building surfaces into smaller scale elements shall be included. 4. Color shall be used to visually reduce the size, bulk and scale of the building. 5. Buildings forty (40) feet or over shall provide rooflines with articulated features. - 6. Location of back flow prevention devices and the fire sprinkler riser shall be identified on project plans submitted for site and design review and shall be located inside the building. CONCLUSION /RECOMMENDATION The Planning Commission, at its July 14, 2011 meeting should consider the language as proposed. Additionally, the Planning Commission should discuss whether the B -4 CUP allowance for building height should also be changed to add these additional conditions and whether this allowance should also be added to the B -3 District. 2
