Approve Planning Commission Minutes: Commissioner Runk, seconded by Commissioner Dwyer, moved to approve the minutes of September 12, 2002 as amended. Carried 3 -0 -1; Chair Vogt abstained. Department /Commission Liaison Reports: 1. Hwy, 36 Partnership Study: Mary McComber reported on the recent meeting of the partnership committee and noted that they reviewed the design concepts and have narrowed their review to a couple design options. Valley Sr. Services Alliance: To consider a request for preliminary and final plat approval for construction of 8 townhome units in four duplex buildings located at Nolan Ave. N. City Planner Richards provided an overview of the project and reviewed the lannin P g report regarding the same, noting that the concept plan had received City Council approval. Chair Vogt opened the hearing for, public comment. The subject area is to be . rezoned from 0, Open Space Conservation to PUD, Planned Unit Development as part of the general plan of development approval. P PP 2. The general plan of development will address relocation of the historic school and construction of a church within the development. All buildings in the development shall maintain at least a 20 -foot setback from the curb line of the street network. 8. The driveway for the 10 unit dwelling and parking spaces shall maintain at least a l0 -foot setback from property lines or public sidewalks within the development. 9. The City shall calculate the park dedication based upon current ordinance standards. Park dedication issues shall be addressed as part of the development agreement. • 10. Specifically, they talked about the Renton townhome project and whether it should proceed. Generally, the City Council felt those portions of the City located north of the electrical transmission lines should be reserved for commercial and raised concern as to how street access will be provided in these areas. In this respect, they felt that the Renton townhome project may be premature on the basis of its land use and uncertainty as to whether MnDOT will grant additional access at Oakgreen, north of the power lines. If you have any further questions regarding this item and the City Council discussion, please contact me at your convenience. Another item that was raised at the Council meeting were the McKean Square West concept plan. At the Council meeting, VSSA indicated that they were submitting a revised concept plan for the balance of the McKean Square property at the previous Friday and that this would be reviewed by Planning Commission at their upcoming meeting. To date, we have not received any application for PUD concept plan for this portion of the property. As a result, the Central Business District Design Guidelines apply to the proposed development. In addition to the PUD approval and site plan review, the applicant also requests preliminary/final plat approval to allow the individual units to be sold as townhomes with commonly owned open space and drive aisles. Jeff Warren, representing Renton Homes, has requested a planned unit development) conditional use permit, preliminary/final plat and site planlsite plan review for a 9 unit townhome project on Oakgreen Avenue North. The proposed building site is located on the west site of Oakgreen Avenue south of Hall Family Chiropractic Clinic and east of the Pond View Condominiums. The total property under control of the developer will be approximately 0.83 acres and is undeveloped. Each unit will have two stories and include a two stall garage. Access for the townhomes will . be from a private driveway with direct access to Oakgreen Avenue. The applicant has utilized the Central Business District Design Guidelines as a guide in developing the housing structures. The front of the buildings will feature porches and the building materials include lap siding, cedar shakers, and stone fireplaces. Comprehensive Plan. The subject property is designated as CBD, Central Business District by the Oak Park Heights Comprehensive Plan. The purpose of the CBD designation is to provide a focal point for the community in terms of retail, service, and entertainment businesses, as well as residential opportunities. As such, the proposed townhome project is consistent with the Comprehensive Plan. Zoning. Within the CBD Zoning District, two family, townhome, and multiple family dwellings are a conditional use. The approval also requires a conditional use permit / planned unit development (CUPIPUD) in that the project will have individual units sold with jointly held common • areas. An association will be established to maintain the exterior of the buildings and the surrounding common property. Density. The Zoning Ordinance requires 4,000 square feet of lot area per unit for townhome projects. The lot area is based upon the total area in the project as controlled by the individual or under joint ownership. A nine unit project would require 36,000 square feet of lot area. The total property of the parcel including the Oakgreen roadway easement is approximately 36,503 square feet or 0.83 of an acre. Subdivision. Preliminary/final plat approval is required to subdivide the site. All existing easements for Oakgreen Avenue and utilities must be identified on the plat. The applicant has submitted a proposed lot layout. The preliminary/final plat is subject to the review and approval of City staff. Park Dedication. The property subdivision will also require park dedication. At this time, the City does not have need for park land in this immediate area and therefore will require a cash dedication. The development will have a density of just over ten units per acre, thus requiring a cash dedication of 14 percent of the fair market value of the land. Therefore, the park dedication fee for this property will be $19,600. The Subdivision Ordinance requires the dedication to be deposited by the developer with the City prior to final plat approval. Central Business District Guidelines. In October of 1999, the City adopted a master plan for the Central Business District in an effort to create a pedestrian friendly, mixed use district. In order to guide implementation of the goals and policies of the plan, specific design guidelines for the CBD were developed. The proposed development will 2 • therefore be reviewed in regard to its consistency with such guidelines as referenced below: Precinct Designation. The subject area and the commercial property at the corner of Highway 36 and Oakgreen Avenue were not placed in one of the specific precincts identified in the Design Guidelines. The project will be reviewed under the residential precinct guidelines. Building Context and Character. The Design Guidelines state that buildings within the residential precinct should be characterized by pitched roof buildings, entry porches, underground or tuck -under parking, and appropriately landscaped front yards. The proposed plan is consistent with these guidelines. Building Setbacks. The Design Guidelines specify the following: Front Yard: Minimum 5 feet / Maximum 15 feet Side Yard: Minimum o feet / Maximum 5 feet Rear Yard: Minimum 10 feet / Maximum 30 feet The front yard (along Oakgreen Avenue North) would be consistent with the Design Guidelines. The north and south property lines would also meet the side yard standards. However, given that the site now has access along Oakgreen Avenue, the plan does not meet the suggested rear yard setback of 10 feet. The current design illustrates a three foot setback along the western property line for the southerly building. This building should be shifted east to meet the minimum five foot setback to comply with, the Fire Code. Building Width. According to the Design Guidelines, buildings in the residential precinct should be divided into increments of no more than 24 feet in width. Each of the townhome units proposed range in width from 22 to 24 feet and feature an offset with the adjoining unit. Building Height. The CBD Zoning District establishes a maximum building height of 35 feet. The guidelines state that the building height should vary between two and three stories. The proposed building is approximately 32 feet and its highest point and has two stories above ground. Roof Design. The guidelines state that residential roofs should be pitched. The project is in conformance with this provision. Ground Level Expression and Entries. According to the Design Guidelines, buildings should have porches and balconies to identify the front entry and to create character to the building. The buildings are designed with porches that face north on the northern set of building and south on the southern set of buildings. Building Materials. The Design Guidelines state that buildings should be constructed of authentic materials such as wood, brick, stone, cast stone, stucco or pour -in -place concrete. Accent materials may include metal, glass, block, copper flashing, or similar materials. The buildings are to be constructed with steel lap siding, cedar shake accents, stone fireplaces, and an asphalt shingle roof. The Planning Commission should review the building materials and colors to determine consistency with the Design Guidelines. Of concern may be the use of steel siding as a predominant building material. The applicant will be required to present building aterial samples for g p review by the Planning Commission and City Council. Walkways. The Design Guidelines state that sidewalks in the residential precinct should be a minimum of six feet in width and that be placed along all public streets. The Parks Commission, Planning Commission, and City Council should determine if a public trail /sidewalk should be placed along Oakgreen Avenue at this time. Lighting. The Design Guidelines state that lighting should be designed to reduce glare and be in scale with the surrounding buildings. Light fixtures located on walkways or trailways should be at a pedestrian scale not more than 14 feet in height. For parking lot lighting, fixtures must be in scale with their surroundings with cut off fixtures. To date, the applicant has not submitted a photometric plan. The applicant must submit a lighting plan to be considered with the Design Guidelines and Zoning Ordinance provisions for lighting. The ordinance specifies that no light source which cast Tight on a public street shall exceed one foot candle meter reading at the centerline of the street nor cast light on adjacent property not more than 0.4 foot candles as measured at the property line. Additionally, details of the fixtures will need to be provided to assure full cut off. Landscaping. The Design Guidelines state that landscaping is strongly .encouraged and that in the residential precincts, front yard landscaping is required and should have a combination of trees, shrubs, ground covers, and turf. The landscape plan indicates that existing trees will need to be removed and significant additional plantings have been added adjacent to the buildings and on the yard adjacent to Oakgreen Avenue. The City Arborist has indicated that a tree inventory will need to be completed for the property. The final landscape plan is subject to review and approval of the City Arborist. Access /Streets. As designed, the development will have access from Oakgreen Avenue North. From this access, the development will have a private common drive leading to each individual unit. This drive lane is approximately 35 feet in width with asphalt surfacing and cement curb and cutter. A MNDot access permit will required before Planning Commission recommendations /City Council approvals can be granted for this development. 4 • Parking. The Zoning Ordinance requires that all townhome units are provided with two spaces per unit, both of which are in a covered garage structure. The building /site plan indicates that each unit will have a two stall garage, although the garages are designed at 21 feet in width and 18 feet long. The applicant has agreed to extend the length of the garages to 20 feet. Additionally, there will be two guest parking spaces in front of each garage door along with four common guest parking stalls. Staff recommends that the parking spaces in front of each individual unit be redesigned to be 20 feet in width. Snow Removal. The applicants shall provide provisions for snow removal on the site due to the limited open area. Grading and Drainage. The applicants will be required to provide drainage calculations for the proposed site. The property drains to the existing drainage pond north and west of the property. The pond has been adequately sized to accommodate this development. The drainage plans and the requirement for additional drainage easements will be subject to review and approval of the City Engineer and applicable watershed authority and will require a M N DOT storm water permit. Utilities. Utility related issues and plans shall be subject to review and approval of the City Engineer. Sewer and water utilities are in place through an easement that traverses the subject property. Signage. The applicants have proposed two stone identification signs on either side of the entrance to the development from Oakgreen Avenue. The northern sign lies within what will become the right-of-way easement for Oakgreen Avenue. This monument must be pulled off of the easement and onto the townhome common property. Trash. All townhome projects will be individually responsible for storage of trash receptacles. Conditional Use Criteria. Section 401.301.E of the Zoning Ordinance specifies criteria for review of conditional use permits for townhome projects in the CBD District. The criteria are as follows: a. At least two parking spaces per unit must be provided on site, or proof is shown of arrangements for private parking nearby. b. No physical improvements, either interior or exterior, may preclude future re -use for commercial purposes. c. Unit floor areas must comply with Section 401.15.C.0. d. Compliance with conditional use requirements of Section 401.03.A.8. e. The development does not conflict with existing or potential future commercial uses and activities. f. The density standards imposed as part of the R -3 Zoning District are complied with. g. Adequate open space and recreational space is provided on site for the benefit of the occupants. h. The development does not conflict or result in incompatible land use arrangements as related to abutting residential uses or commercial uses. 1. Residential use be governed by all applicable standards of the Zoning Ordinance, Building Code, Housing Code, and Fire Codes. 1. Residential and non - residential uses shall not be contained on the same floor. k. Residential uses shall be provided with a separate entrance, and separately identified parking stalls. CONCLUSION / RECOMMENDATION The Planning Commission should review the criteria and determine if the project complies with the intent of the Zoning Ordinance. City staff does not recognize any significant issues that would prevent approval of this project based upon the preceding criteria. Development Agreement. A development agreement between the applicant and the City will be required as part of the approvals subject to the City Attorney and City Council review and approval. Additionally, the City Attorney has requested copies of the restrictions and covenants and party wall/common area agreements as part of the project review and approval process. Based upon the preceding review, the project proposed is consistent with the criteria within the Zoning Ordinance and Central Business District Design Guidelines. City staff recommends approval of the concept/general planned unit development/conditional use permit, subdivision and site plan review for Oak Park Square based upon the following conditions: 1. The applicant shall provide the City with a preliminary and final plat in conformance with specifications of Section 402 of the Oak . Park Heights Subdivision Ordinance. 2. The building positioned in the southwest corner of the site should be shifted east to meet a minimum five foot setback to comply with Fire Code. 3. The applicant shall pay a park dedication fee of $19,600 to the City prior to final plat approval. 4. The Planning Commission should review the building materials and colors to determine consistency with the Design Guidelines. The applicant shall be required to provide building material samples for review by the Planning Commission and City Council. 6 • 5. The Parks Commission, Planning Commission and City Council should comment on the need at this time for a sidewalk on the west side of Oakgreen Avenue. 6. The applicant shall submit a lighting plan consistent with Zoning Ordinance requirements for lighting. Details of the light fixtures shall be provided by the applicant to assure full cut off. 7. The applicant is also requesting a variance to allow for a portion of the structure to lie within the designated 30' rear yard setback. The subject site is zoned R -1, Single Family Residential, and the lot has recently been cleared in preparation for this project. Attached for reference: Exhibit A: Site Plan Exhibit B: Front Elevation ISSUES ANALYSIS Comprehensive Plan: The Comprehensive Plan Land Use Map designates this area for single family residential use. The Zoning Map has included this area within the R -1 District. This is an older neighborhood with a mix of one and two story buildings, unique in character and architectural style. The applicant has cleared the site of a previous home in need of repair in hopes of revitalizing the site and improving the neighborhood. Conditional Use Permit: The Zoning Ordinance, Section 401.15.J., requires that the relocation of any building or structure over one hundred twenty (120) square feet onto another lot within the City be subject to review and approval of a conditional use permit. In evaluating the requested conditional use permit, Section 401.03.A.7, of the Zoning Ordinance directs the Planning Commission and City Council to consider the possible adverse effects of the proposed use, with their judgment based upon, but not limited to the following factors: a. Relationship to the specific policies and provisions of the municipal Comprehensive Plan. b. The conformity with present and future land uses of the area. c. The environmental issues and geographic area involved. d. The impact on character of the surrounding area. e. The demonstrated need for such use. f. Traffic generation by the use in relation to the capabilities of streets serving the property. g The impact upon existing public services and facilities including parks, schools, streets, utilities and the City's service capacity. h. The proposed use's conformity with all performance standards contained in the Zoning Ordinance. Comment: Our office has evaluated the above criteria and feels that the applicants project sufficiently meets these requirements, with exception to (h), conformity with all performance standards. This can be reconciled with the approval of the requested rear yard variance which is discussed within this report. Additional comments and criteria for review of a conditional use permit specific to the relocation of a structure as described in Section 401.15.J of the Zoning Ordinance are as follows: Performance Standards: a. Upon relocation, the building shall comply with the applicable requirements of the Uniform Building Code in effect in Oak Park Heights. Comment: The building plans are subject to review and approval of the City's Building Official. 2 1 b. The proposed relocated building shall comply with the character of the neighborhood in which it is being relocated as determined by the City Council. Comment: The neighborhood consists of a variety of one and two story residential structures with a mix of architectural style. The proposed structure will not be at variance with the existing neighborhood character. c. The relocated use will not result in a depreciation of neighborhood or adjacent property values. Comment: Prior to demolition, the previous house was in ill repair. The proposed structure will be significant improvement to the lot and the surrounding neighborhood. d. The relocated structure shall be similar to the market valuation of adjacent principal structures as determined by the City Assessor. Comment: According to information provided to our office by the City Assessor, the proposed structure will have a market value of approximately $137,000. This is consistent with the market values of the surrounding structures which range in market value from $71,900 to $130, 800. . Occupancy: The relocated structure should be ready for occupancy within eight months from the date of location on the site. Comment: The applicant will be required to complete the project within eight months. Performance Security: A performance security should be provided to the City as specified in Section 401.08 of the Ordinance. Comment: In addition to the normal performance security requirements specified in Section 401.08 of the Ordinance, the applicant should provide a performance bond for grading, sodding, and landscaping of the site. The amount of the performance bond shall be set by the Building Official at the time of building permit issuance. Variance: As mentioned previously, the applicant has requested a variance to allow encroachment into the required rear yard setback (30 feet). Specifically, the parcel is a corner lot, fronting on two public right -of -ways. The ordinance states that in such a situation, the front of the lot shall be the boundary abutting the public right -of -way with the least width, which in this case is 57th street. The applicant feels it necessary to orient the proposed structure towards Perkins Avenue, as shown on the site plan, for the following two reasons; the location of existing mature trees along the north lot line limits access off of 57th street and the long narrow layout of the proposed structure fits best fronting Perkins Avenue. This however, does not change the 30' rear yard setback requirement located from the south line of the parcel. The location of the proposed structure, as shown on the applicants site plan, encroaches 20' into the setback. It should be noted also that the site plan currently shows the structure 28.2 feet from the east lot line, fronting Perkins Avenue. According to the Ordinance, the side lot line abutting the public right -of -way on a corner lot should be set back 30'. Our office feels that this is an issue that can be easily corrected by moving the structure to the north and to the west, which would not only eliminate the encroachment into the side yard setback, it would lessen the encroachment into the rear yard setback. In considering the variance request, the City has established a number of criteria which should be used in determining their acceptance. Per the Ordinance, Section 401.04.A.4., the Planning Commission and City Council should make a finding of fact that the proposed action will not: 1. Impair an adequate supply of light and air to adjacent property. 2. Unreasonably increase the congestion in the public street. 3. Have the effect of allowing any district uses prohibited therein, permit a lesser degree of flood protection than the flood protection elevation for the particular area, or permit standards which are lower than those required by State law. 4. Increase the danger of fire or endanger the public safety. 5. Unreasonably diminish or impair established property values within the neighborhood, or in any way be contrary to the intent of this Ordinance. 6. Violate the intent and purpose of the Comprehensive Plan. In addition to the aforementioned criteria, the variance must also demonstrate an undue hardship will result if the variance is denied due to the existence of special conditions and circumstances which are peculiar to the land, structure, or building involved and which are not applicable to other lands, structures or buildings in the same district. Comment: Review of the setback variance request finds that it does not violate any of the six provisions stated above. The Planning Commission and City Council need to decide if the location of existing mature trees along 57th street, which impede access for the proposed structure design, is sufficient to be deemed a hardship. Our office feels that the proposed structure does fit best on the lot when oriented towards Perkins Avenue, however the building should be moved 8.8 feet to the north to allow for the minimum variance necessary as required in Section 401.04.5.g. of the 4 • • • ordinance and 1.8 feet to the west to eliminate the need for a variance to the side yard setback requirement of 30'. CONCLUSION / RECOMMENDATION The applicants parcel is located in a unique older neighborhood which was developed well before the cities zoning ordinance. Its odd shaped lots, narrow streets, and varying setbacks help in making the variance to the rear yard setback Tess of an issue. The parcel is zoned for residential use and meets the general requirements for the conditional use permit needed when relocating such a structure. Based upon the factors outlined herein, our office recommends approval of the requested conditional use permit and variance subject to the following conditions: 1. Upon relocation, the building shall comply with the applicable requirements of the Uniform Building Code subject to approval of the cities Building Official. 2. The Site Plan is revised to show the proper setbacks as described in the ordinance and the structure is moved 8.8 feet to the north and 1.8 feet to the west to eliminate the need for a variance to the required 30 foot side yard setback and to allow for the minimum variance necessary to the rear yard. 3. A Site Plan showing landscape improvements is submitted and approved by the City Arborist. 4. A performance security is provided to the City as specified in Section 401.08 of the Ordinance, including a performance bond for grading, sodding, and landscaping of the site, the amount of which shall be set by the Building Official at the time of building permit issuance. 5. The shrubs are Clethra or summersweet, which is a native shrub that will not be attractive planted singly as depicted in the plan. Clethra also requires acidic soil, which will most likely not be the case in this area. The landscape plan that was submitted in October 2001 for the previously proposed parking lot was an attractive plan that utilized several good plant species. 1 would suggest that they try something similar to that plan for the landscaping. The landscape plan submitted in October of 2001 is attached in Exhibit 4 for reference. A revised landscape plan must be submitted and is subject to review by the City Arborist. Parking. The City's existing zoning code does not have a specific parking standard for car, van, or truck sales. The closest standard relates to boat sales, and that standard has been used to evaluate parking requirements for other vehicle sales lots in Oak Park Heights. Boat sales require one space for each 400 square feet of floor area for the first 25,000 square feet, plus one space for each 600 square feet thereafter. Floor area is determined by subtracting ten percent from each floor of the two -story building. The building is 10,000 square feet in size. After subtracting ten percent, the floor area is 9,000 square feet in size. The floor area divided by 400 is 22.5. Therefore, 23 parking spaces are required. The site plan indicates that 20 parking spaces are reserved for customer parking and 78 stalls are designated for display parking. Section 401.15.F.7 of the Zoning Ordinance prohibits use of required parking for outdoor storage or sales. In order to meet Ordinance standards, 23 parking stalls must be reserved for customer and employee parking, leaving 75 stalls for display parking. The site plan must be revised to indicate that 23 stalls are reserved for customer parking. Building Height and Design Guidelines. The proposed two - story building is approximately 32 feet tall to the tallest parapet. The building does not exceed the maximum height of 35 feet. Exterior building materials include rock-face concrete block, glass, and E.I.F.S. The south side of the building is 60 percent glass and 74 percent glass and rock-face concrete block combined. The side walls are approximately 45 percent glass and 77 percent glass and rock -face concrete bLock combined. These exterior building material types and percentages comply with Design Guidelines. The back of the building is a large blank wall. The Design Guidelines require a building more than 30 feet in width to be broken up through articulation of the facade into 30 -foot increments. This is especially important in this case where the back of the building is only 30 feet away from the neighboring building to the north. A revised north building elevation should be provided that includes vertical design features to break up the expanse of wall. The Design Guidelines require exterior building color to blend with the 3 architecture in the area and include primarily warm tones. Material colors have not been indicated and must be provided. Lighting Plan. Section 401.15.B.7.d of the Zoning Ordinance (outdoor lighting) states that light shall not exceed one foot candle measured from the centerline of a public street, nor shall light exceed four tenths of a foot candle at any property line adjoining an adjacent properly. Light levels on the lighting plan are exceeded on all property lines; therefore, the lighting plan must be revised to comply with the City's foot - candle limitations. Signage. One wall sign is proposed on the front of the building. The proposed sign is 45 square feet in size. The Zoning Ordinance allows a wall sign that is up to 64 square feet in size; therefore, the sign complies with City standards. Trash. The site plan illustrates a trash enclosure on the northwest side of the building. The site plan includes a plan detail of the trash enclosure; however, elevation details have not been provided. Elevations for the enclosure must be submitted with materials specified. The enclosure materials must be consistent with the principal building materials. CUP Review Criteria The conditional use permit criteria for open and outdoor sale of vehicles is listed below with a review of each. 1. Outside sales areas are landscaped and fenced or screened from view o neighboring residential uses or an abutting residential district. A revised landscape plan needs to be submitted and is subject to review of the City Arborist. There are no neighboring or abutting residential uses or districts. 2. All lighting shall be hooded and so directed that the light source shall not be visible from the public right -of -way or from neighboring residences. A revised lighting plan needs to be submitted that does not exceed maximum light intensity level regulations. The light fixture detail submitted is for a full cut- off style fixture. 3. Adequate analysis and provisions are made to resolve issues related to demand for services. No use shatl be allowed that will exceed the City's ability to provide utility, police, fire, administrative or other services to the site. The use will not create a large demand for services. 4. The provisions of Section 401.03.A.7 of this Ordinance are considered and satisfactorily met. 4 • r t • Section 401.03.A.7 are the general considerations for a CUP request. The proposed use is not expected to have a negative impact on the area and is an appropriate use provided conditions of approval are met. CONCLUSION AND RECOMMENDATION The proposed land use is appropriate and allowed as a conditional use in the B -2 District. The changes that need to be made to the plans are feasible, and after revisions are made, the project will comply with the provisions of the Zoning Ordinance and Design Guidelines. Therefore, our office recommends approval of the site plan and CUP to allow the new facility for Denny Hecker's Conversion Van Center subject to the following conditions: 1. An access permit from MnDOT is required for the access onto Neal Avenue North. 2. Employees of Stillwater Ford shall park on the Stillwater Ford property. Twenty- three stalls shall be dedicated to customer and employee parking on the subject site. Required parking stalls shall not be used for display, storage, or sales. 3. Parking stalls are required to be at least 20 feet long with drive aisles that are at least 24 feet wide. A revised site plan, subject to City staff review and approval is required. 4. Revised grading, drainage, and utility plans shall be submitted and are subject to review and approval by the City Engineer and applicable watershed district. 5. A revised landscape plan must be submitted and is subject to review and approval by the City Arborist. 6. A revised north building elevation that includes vertical design features to break up the expanse of wall shall be provided for City staff review and approval. 7. Building material colors shall be provided for Planning Commission and City Council review and approval. Colors shall be primarily warm tones. 8. A revised lighting plan that complies with the City's foot - candle requirements shall be submitted for City staff review and approval. The fixtures shall be full cut -off. 9. Elevations for the trash enclosure with materials specified shall be submitted for City staff review and approval. In conjunction with the department store, the concept plan also calls for approximately 80,000 square feet of retail commercial space dispersed upon two outlots. The property is zoned Central Business District and is included in the area of the Central Business District Urban Design Study. As a result, the Central Business District Design Guidelines apply to the proposed development. At this time, the submitted concept plan is undergoing some refinement. City staff has suggested that the applicant consider the relocation of the department store from the northern to southern area of the site (to more closely adhere to the CBD Guidelines). Additionally, information relating to grading and drainage also has yet to be submitted. In this regard, discussions with the Brown's Creek Watershed District and Valley Senior Services Alliance are underway to address site ponding solutions. Site Location Site Survey Site Plan Building Elevations Site Plan Alternative ISSUES ANALYSIS Comprehensive Plan. The subject property is designated as CBD, Central Business District by the Oak Park Heights Comprehensive Plan. The purpose of the CBD designation is to provide a focal point for the community in terms of retail, service, and entertainment businesses, as well as residential opportunities. As such, the proposed retail commercial uses are consistent with the Comprehensive Plan. Zoning. Within the applicable CBD Zoning District, retail commercial uses are listed as permitted uses. Subdivision. The subject property overlays three parcels of land and a segments of public right -of -way (5g and Norwich Street). To accommodate the development, the vacation of the existing right -of -way, the subdivision of the property into lots (which correspond with the building locations) and the dedication of appropriate right -of -way will be necessary. In regard to the right -of --way vacation, it should be understood that the applicant will need to specifically request the vacation of the roadways and, if the vacation is approved, need to compensate the City accordingly. Central Business District Guidelines. In 1999, the City adopted a master plan for the Central Business District in an effort to create a pedestrian friendly, mixed use district. In order to guide implementation of the goals and policies of the plan, specific Design Guidelines for the CBD were developed. The proposed development will therefore be reviewed in regard to its consistency with such guidelines. The Design Guidelines established four precincts within the CBD; the Medium -Box Mixed Use Precinct, the Small Box Mixed Use Precinct, the Residential Precinct, and the Public Green Precinct. The subject property overlays three of the referenced precincts as noted below. • The northern one -third of the property lies within the Medium Box Precinct which is intended to provide transitional changes between the big box development and the small box development within the center area of the CBD. The Medium Box Precinct envisioned placement of the buildings so that they would face 60 Street and Highway 36 with no front yard parking. The plan included parking to the rear and sides of the buildings, but the stalls would be screened and landscaped so as not to be the predominant view from Highway 36. Entryways at Norwich and Novak Streets were planned to define the entrance into the Central Business District with landscaped center islands, sidewalks on either side of the roadways and boulevard plantings. • The central portion of the property overlays the Public Green Precinct which extends beneath the Northern States Power overhead wires. The Public Green 2 Precinct was planned as an open area that would have been used for trails, gathering areas, and for stormwater ponding. • The southern one -third of the property lies within the Small Box Precinct which suggests retail, service and office uses. The Small Box Precinct was planned as a traditional downtown setting characterized by modest building scale and height, Y g 9 buildings constructed to the sidewalk line, parking in rear courtyards, and a streetscape of coordinated plantings, lighting, signage, and amenities. The southerly area of the proposed development was planned as a central green area with a downtown park area. The Design Guidelines also provide specific recommendations in regard to development context and character, building setbacks, building height and upper story setbacks, roof design, facade transparency ground level expression and entrances, building materials, pedestrian access, parking lot layout, streetscape elements, lighting, and landscaping. Under every category, the proposed development would not comply with the intent of the specific design elements and details specified in the Design Guidelines. While the proposed retail commercial land uses are consistent with the land use directives for the area, the proposed 88,000 square foot department store is considered a "big box" development and exceeds what is commonly understood to be "small" or "medium" box development as directed by the Guidelines. The layout of the buildings, parking, streets, and driveways characterize a more "suburban" commercial . development that is not considered consistent with the Guidelines. Should the City wish to accommodate the proposed development, the CBD Guidelines should either be amended to exclude the subject property or be repeated recognizing that the subject site overlays a significant portion of the CBD and is integral to the success of the guidelines. Access. Access to the site is proposed from the north via 60 Street, from the east via future Novak Street and from the west via Norwich Street. Recognizing that significant traffic volumes will be generated by the proposed use, it is suggested that access be dispersed to public streets on the east and west sides of the property and through private access roads and driveways. This issue should however, be subject to comment and recommendation by the City Engineer. Traffic Generation. In considering the development proposal, an assurance should p p p uld be made that the development can be supported by the existing and proposed area street system. In this regard, a traffic study identifying the amount of traffic generated by the proposed use and traffic capacity of the street network should be provided by the applicant and subject to review by the City Engineer. Circulation. In considering the proposed development, it is important that both area site circulation and circulation within the site itself be given due consideration. 3 Use Ratio Required Spaces Kohl's (88,000 gsf x .9) 79,200 nsf. 1 space per 200 square feet 396 Outlot Uses (71 ,100 gsf x .9) 63,990 nsf 1 space per 200 square feet 320 Total 716 On an area -wide scale, an assurance should be made that desired street linkages to the south, east and west of the site be provided. Specifically, the following street related improvements should be incorporated into (or planned for) as part of the development plan (see Exhibit E for reference): • An ultimate southerly extension of Norwich Street to align with the existing 58th Street/ Norwich Avenue North intersection. • The dedication of future Novak Street along the east side of the property with a connection to 58 Street. Circulation patterns within the site should provide for potential connections to the Wal -mart site west of the subject property. The access roadways should align with existing driveways within the Wal -Mart site. • The City should work with the applicant and adjacent property owners to the east in planning an east/west public street connection to Oakgreen Avenue. Building Location /Orientation. As shown on the submitted site plan, the department store is located in the northeast corner of the property. Such location raises two primary concerns. The first concern relates to the presentation of the building to 60th Street. As proposed, the rear and side of the building will be visible from such roadways which is not considered ideal from a planning standpoint. . Secondly, to more closely reflect the existing development pattern in the area, it is suggested that the smaller, outlot uses /buildings be located on the northern portion of the site (along 60 Street) and the larger Kohl's building be located in the southern portion of the site such that it parallels the existing Wal -Mart (see Exhibit E for reference). Beyond this change, the parking is directed to the center of the site and a less of a prominent visual feature from 60 Street/Highway 36. Additionally, Norwich and Novak Streets can be developed as significant entryways into the commercial area with landscaping and pedestrian access. Off - Street Parking. According to the Ordinance, retail stores must provide one parking space for each 200 feet of floor area. As shown below, a total of 716 parking spaces are therefore required upon the subject property. As shown on the site plan, the applicants are proposing to provide 612 spaces for the Kohl's store and an additional 493 stalls for the outlot uses, totaling 1,138 stalls. Thus, the minimum parking supply requirements of the Ordinance have been significantly exceeded. 4 • Recognizing that the minimum parking supply requirement has been significantly • exceeded, it may be worthwhile to consider the conversion of some parking areas to green space. The Novak, Norwich Street entrances could be enhanced with landscaping, boulevards, and center islands with sidewalks. Additional pedestrian access and green areas could be incorporated to enhance the site and decrease the significant amount of hard cover paved in the proposed plan. Building Height. The CBD Design Guidelines establish a maximum building height of 35 feet. At 33 feet in height, the proposed department store meets the maximum height requirement. • Architectural Appearance. As the development proposal moves forward, the architectural appearance of the Kohl's store and outlot buildings will be subject to detailed review in comparison the CBD Design Guidelines or with the general City Design Guidelines. Lighting, Signage and Landscaping. Detailed plans related to lighting, signage and landscaping have not, to date, been submitted. Such plans will need to be submitted and considered as part of the general plan review. Grading and Drainage. To date, a grading and drainage plan has yet to be submitted nor does the submitted site plan designate specific areas for stormwater ponding. The applicant has however, been working with the Brown's Creek Watershed District, City Engineer and Valley Senior Services Alliance in providing proper areas for stormwater 411 holding. It is anticipated that stormwater ponding will be provided in one of the following areas: • In the southwest area of the site (within Outlots 1 and 3) • Upon the Valley Senior Services Alliance property southwest of the site. • Beneath the department store's off - street parking area. While it is anticipated that ample area for ponding can be provided, a grading and drainage plan must be submitted subject to review and comment by the City Engineer and the Browns Creek Watershed District. Utilities. Utility related issues and plans shall be subject to review and approval of the City Engineer. The applicant should however, be responsible for the following as conditions of PUD approval: • Burying the existing power line along Highway 36 (at the developer's expense). • Verifying area utility locations. Trails /Sidewalks. As part of the City's consideration of the development proposal, attention should be given to not only vehicular circulation but pedestrian movement through the area as well. In what is considered a ositive feature of the development, p an east/west trailway has been proposed beneath the Xcel Energy Power easement. In this regard, consideration should be given to converting some excess off - street parking spaces to an east/west greenway corridor within which a trail could be constructed. While such trailway is considered positive, it is suggested that such trail lie within a more defined greenway corridor. Considering that the proposed parking supply significantly exceeds that required by Ordinance, it believed an opportunity exists to not only provide a trailway link but introduce a significant visual amenity to the development as well. Trails and sidewalks should also be incorporated into the plans for the public street improvements anticipated for the Novak and Norwich Streets. North and south pedestrian access along Novak and Norwich Streets would provide necessary pedestrian access between 58 and 60 Street and into the Boutwells Landing development. Loading /Trash. To the extent possible, loading and trash handing activities should be located so as not to be visible from public rights --of --way. Should the applicant choose to move forward with a design concept similar to that illustrated on Exhibit E, it is important that loading activities along Novak Street be properly screened. Development Contract. The applicant will be required to enter into a development contract with the City should approval of the concept plan and general plan be granted. CONCLUSION /RECOMMENDATION While the proposed retail commercial land uses are considered generally acceptable, it is the opinion of our office that some significant concerns exist that should be addressed prior to moving forward in the development process. While it is believed such issues can and will be resolved, our office cannot, at this time, recommend approval. Specific issues which need to be addressed include the following: • Area street network/traffic generation • Building location /orientation • Site circulation • Stormwater management • Design Guidelines compliance Staff has been and will continue to work with the developer toward the resolution of these issues. Due to the short approval timeline requested by the applicant, the Planning Commission may need to consider adding additional special meetings, if required, to review this project. pc. A sign or portion thereof with characters, letters, or illustrations that can be changed or rearranged without altering the face or the surface of the sign. A sign on which the message changes more than eight (8) times per day shall be considered an • • animated sign and not a changeable copy sign for purposes of this Ordinance. A sign on which the only copy that changes is an electronic or mechanical indication of time or temperature shall be considered a "time and temperature" portion of a sign and not a changeable copy sign for purposes of this Ordinance. 21. Commercial Message: Any sign wording, logo, or other representation that, directly or indirectly, names, advertises, or calls attention to a business, product, service, or other commercial activity. 22. Construction Sign: 23. Copy: The wording on a sign surface either permanent or removable letter form. 24. Directional Sign: A non - illuminated sign placed at a construction site identifying the project or the name of the architect, engineer, contractor, financier, and other involved parties, or announcing the character of the building enterprise or the purpose for which the building is intended. A sign erected with the address and/or name only of a business, development project, institution, church or other use or activity plus directional arrows or information on location. 25. Directory Sign, Private: An exterior information wall sign, or a free - standing sign identifying the names of residences, businesses or professional offices served by a common public entrance such as an apartment complex, shopping center, or office building. 26. Directory Sign, Public: A sign, group of signs on a sign panel or any identifiable object intended to communicate a public message or direction when located on public property as may be approved by the Oak Park Heights City Council. 27. Employment Sign: A temporary sign to announce employment opportunities in business and industrial zoning districts as well as each public and institutional conditional use in residential districts. 4 28. Flashing Sign: A piece of cloth or bunting varying in color and design, used as a symbol, standard, emblem, or insignia identifying a governmental agency or any civic, charitable, religious, institutional, patriotic, corporate, fraternal, or similar organization. An illuminated sign upon which the artificial light is not kept constant in terms of intensity or color when the sign is illuminated. 30. Freestanding Sign: A self - supported sign not affixed to another structure. 31. Governmental Sign: A sign which is erected by a governmental unit for identification or traffic. 32. Ground /Low Profile Sign: A sign that is intended to be incorporated into some form of landscaping design scheme or planter box, is not elevated from the ground by means of a pole or free - standing support structure, but is placed directly on the ground or on an interior planter base which is incorporated into such a design arrangement. 33. Historical Sign: A sign commemorating places of local, state, or national historical significance. 34. Holiday Sign: 35. Identification Sign: A sign which identifies the business, owner, manager, resident, or address of the premises where the sign is located and which contains no other material. 36. Illuminated Sign: 37. Informational Sign: 38. Institutional Sign: A sign or display that contains or depicts a message pertaining to a national, state, local, or religious holiday. A sign illuminated by an artificial light source either directed upon it or illuminated from an interior source. A temporary sign affixed to the outside or inside of a window or inside the building within three (3) feet of a window in view of the general public. A minimum of one (1) address sign identifying the correct property number as assigned by the City shall be required on each principal building in all districts. Such sign shall be of sufficient size to be legible from the nearest street yet shall not exceed nine (9) square feet in area. The maximum angle permitted between faces of a double face freestanding sign is sixty (60) degrees, anything less is one (1) sign, anything more is two (2) signs. :` No sign shall be positioned so that it impacts or is exposed to residential uses or districts along adjoining side and rear yard property lines. 401.15.G.6. PERMITTED SIGNS IN ANY ZONING DISTRICT. The following signs are allowed without a p ermit unless otherwise specified. These signs, if placed in accordance with the following standards, will not apply toward the maximum allowable sign area, but shall comply with all other applicable provisions of this Ordinance. a. Governmental Signs. Signs of a public, non - commercial nature including safety signs, danger signs, trespassing signs, traffic signs, signs indicating scenic or historical points of interest, memorial plaques and the like, when these signs are erected by or on order of a public officer or employee in the performance of official duty. b. On- Premises Directional Signs. Shall not exceed four (4) square feet in area. c. Integral Signs. Shall not exceed nine (9) square feet in area. Campaign Sins. Shall not be placed upon public right -of -way or propertyf d. g p p . .. Campaign sins erected on private property staff be erected with signs p ... permission of the property owner or lessee. Those installing campaign signs p shall comply with the Fair Campaign Practices Act contained in State of Minnesota Statutes chapter 211B. Signs in all B, Business Districts and 1, Industrial Districts which at the front, side, or rear entrance of a building identify the business, owner, manager or resident and set forth the address of the premises where the sign is located and which contain no other material. Security Signs. Shall not exceed one (1) square foot with one (1) sign per driveway connection to a public right -of -way. h. Real Estate Signs. 1) Property for sale and development project signs shall be wall or freestanding signs and shall be removed within ten (10) days after the closing on a property. 2 a) Such signs shall be professionally designed and painted on all sides, including support posts. Freestanding signs shall be properly anchored into the ground using posts with minimum dimensions of four (4) inches square or three (3) inches in diameter. b Such signs shall be limited to one (1) per street frontage of the property. The content of the commercial message on these signs shall include an offer of the property for sale, the realty company name, the phone number, and other information related to the sale. Such signs shall not measure more than twelve (12) square feet in R -1, R -1 A, R -1 B, R -1 C, R -2, R -3, R -B Districts, and shall not measure more than forty (40) square feet in all other districts. The forty (40) square foot limitation may be increased to sixty- four (64) square feet, provided a conditional use permit is issued and the following standards for freestanding signs are met: (1) The sign shall be a maximum height of twelve (12) feet. (2) The sign shall be set back from the front property line no less than one (1) foot per one (1) foot of sign height. (3) The sign shall be non - illuminated. Temporary property for lease signs shall be wall or freestanding signs. a) The gross area and total height of a temporary property for lease sign shall be limited to the requirements specified in Section 401.15.G.6.h.1).(d) above. b) Temporary property for lease signs shall be set back from the front property line no less than one (1) foot per one (1) foot of sign height, except that if the sign cannot be located to comply 14 with the minimum setback requirement from the front property line without locating the sign in a parking lot or other paved surface, the sign may be located up to the front property line provided that the sign does not exceed twelve (12) square feet in area and four (4) feet in width, and further provided that the sign will not disrupt any public utility service and interfere with the sight line visibility of motorists on the adjoining roadway. The content of the commercial message on such signs shall include an offer of the property for lease, the management company or owner's name, the phone number, and other information related to the lease. d) Such signs shall be limited to one (1) per street frontage of the property, and if ground mounted, . � shall be constructed of painted, smooth finish ' ` { "� " and shall have either flush or side mounted, four (4) inch by four (4) inch painted wood posts. Shall be limited to the subject property, shall not exceed five (5) square feet and shall be removed within one (1) day after the termination of the sale. Signs shall include the property address, date of sale, hours and shall not be placed in any public rights -of -way. The City shall have the right to remove and destroy rummage sale signs. The City shall assess a fee of ten (10) dollars per sign removed by the City. k. Barber pole signs. 1. Public information service signs. m. Signage on bus benches, as regulated in the Oak Park Heights Code of Ordinances. For the purposes of this Ordinance, such signage shall not be considered to be off-- premises advertising signage. 15 n. Permanent Window Signage. Shall not exceed twenty -five (25) percent of the total area of the window in which they are displayed. PROHIBITED SIGNS IN ANY ZONING • G DISTRICT. The following signs are prohibited in all zoning districts: a. Any sign which obstructs or impairs the vision of drivers or e p destrians or detracts from the visibility of any official traffic control device. b. Any sign which contains or imitates an official traffic sign or signal, ignal, except for private, on- premises directional signs. c. Off- premises advertising and directional sig ns. d. Business signs on or attached to equipment, such as semi- trailers, semi -truck trailers being i used in such a manner that advertising is a principal use of the equipment. g p p quipment. e. Animated signs. f. Projecting signs (exceptions allowed in the CBD District) g. Roof signs. 16 h. Vehicle sales signs displayed on vehicles within open p n sales lots. i. Any sign which contains or consists of banners, bannerettes, pennants, ribbons, streamers, strings of light bulbs, balloons and hot or cold ' air inflatable devices, spinners or similar outdoor advertising devices, except ept as may be approved by a special event permit in accordance with the provisions ns as set forth in Section 401.15.G.8 of this Ordinance. j. SPECIAL EVENTS. a. Required. No special event shall be held without first obtaining a permit. b. Number of Events. The business or applicant in all business and industrial zoning districts, as well as each public and institutional use in residential districts, shall be allowed three (3) special events per calendar year. Each special a I event shall not exceed ten (10) days and shall not be extended for p three (3) consecutive time periods for each business. Once the time period has expired for the special event the applicant shall wait the same number of days that the . permit permit was issued to start a new special event. • c. Permitted Advertising Devices. Advertising devices for special events must Aft be directly related to the activity being conducted as a special event. The IF advertising devices described below are permitted for special events in addition to the maximum allowable sign area, provided they are professionally done and the following standards are met and complied with: 1) Small Balloons. a) The size of small balloons or a group of connected balloons shall not exceed two (2) feet as the largest dimension, except that balloon arches not exceeding eight (8) feet in height shall be allowed. b) Small balloons may be multi colored and incorporate logos and messages. c) Helium balloons shall be refilled daily. 2) Tents. a) Tents, including all ties, ropes, stakes, etc., shall be located entirely upon the permittee's property and shall comply with the City's setback requirements for accessory buildings. 17 • 3 4) Banners. 5) Search lights. d. Prohibited Advertising Devices for Special Events. The advertising devices or activities described below are prohibited for special events: 1) Animated signs, Tight bulb strings, pennants, portable signs, ribbons, and streamers. 2) Displays or special features on any landscaped areas or on roofs. 3) Aerial rides. 4) Large balloons or collections of small balloons exceeding two (2) feet in diameter, except for balloon arches not exceeding eight (8) feet in height. 5) Additional lighting that does not meet this Ordinance. 6) Any advertising device in the public right -of -way. 7) flat -Air inflatable devices. 0 >:••:o::s e. S i gn Permit Requirements for Special Event Lot Decorations. Before any special event signs or decorations shall be permitted to be used for an event, Bannerettes. a) Bannerettes may be used on light standards or flag poles. b) No more than one (1) bannerette shall be allowed per standard or pole. c) Bannerettes shall be smaller than any United States flag on the property, and shall not be flown at a height greater than any United States flag allowed on the property. a) Banners may be attached to poles, tents, and buildings, provided that are well secured and are prevented from being blown around uncontrollably by the wind. b) No more than two (2) banners shall be allowed. c) Banners shall not be larger than one hundred (100) square feet nor higher than the wall of the principal building on the lot. 18 the responsible -Few mks owner or organization shall submit a completed application for a ififi permit with the City. In addition to other requirements, p tY uirements the q • applicant shall show that when the event is held, adequate parking area will continue to exist, even though a portion of required parking spaces may be used to celebrate the event. Only after the City issues the : permit, may a business display the special event signs and decorations. f. Violations. 1) It is a violation for any person, company, or organization to provide, erect or display any beacons, balloons or other advertising device which is not in conformity with the provisions of this Section. 4 Special event signs and decorations not removed by the last day of the special event. 401.15.G.9. DISTRICT REGULATIONS. a. R -1, R -1A, R -1 B, R -1 C, Single Family Residential and R -2, Low to Medium Density Residential Districts. Except as otherwise provided in this Ordinance, signs in these districts shall be limited to: 1) One (1) nameplate sign for each unit in a single and two family residential dwelling not exceeding two (2) square feet in area per surface. Lots abutting more than one (1) right -of -way shall be allowed one (1) nameplate sign not to exceed two (2) square feet in area per frontage. (3) To scale plans for all existing and proposed signs of an type included within the comprehensive sign plan indicating area, dimensions, height, materials, colors, and means of illumination (if any). 2) The maximum individual sign sizes for multiple occupancy buildings and individual businesses that may display a sign shall not exceed the maximum provisions for single occupancy structures of the applicable zoning district. The freestanding business sign may identify multiple tenants, and may not exceed one hundred (100) square feet and a maximum height of twenty (20) feet. The planter shall contain decorative shrubbery and/or flower materials. Except as provided for in Section 401.15.G.10 of this Ordinance, individual tenants of a multiple occupancy building shall not display separate business wall signs unless the tenants business has an exclusive exterior entrance. The number of individual business wall signs shall be limited to one (1) per entrance, and each sign shall be limited to the maximum wall sign allowances permitted in the district. Tenants on building ends may have a maximum of two (2) signs each to be located at the front and side elevations of the tenant space. The individual business signs shall be located only on exterior walls which they are directly related to the use being identified. In any multiple occupancy building qualifying as a shopping center, directory signs shall be permitted for each common public entrance. Each directory sign area shall not exceed a total of fifty (50) square feet and shall be located within fifty (50) feet of the common public entrance being served. The size of individual business identification signing within the directory shall be established during the site plan 29 • • • 401.15.G.11. NON - CONFORMING SIGNS. a. General Provisions Governing Non- Conforming Signs. 1) Continuation of Use. A non - conforming sign lawfully existing upon the effective date of this Ordinance may be continued at the size and in the manner existing upon such date. 2) If any property use or business changes ownership, all signs on that property, including any sign identifying a business no longer is existence, shall be brought into conformance with Section 401.15.G.15.c) within thirty (30) days. 4 review process. Attention shall be given to the possible number of tenants or occupant bays which may be served by the common public entrance for which the directory sign is intended. No permit shall be issued for a new or replacement business sign for an individual use except upon a determination by the Zoning Administrator that it is consistent with the approved comprehensive sign plan. Prohibitions. A non-conforming sign may not be: a) Structurally altered except to bring it into compliance with the provisions of this Ordinance. b) Enlarged. c) Re- established after its removal or discontinuance. d) Repaired or otherwise restored, unless the damage is less than fifty (50) percent of sign structure. e) Replaced. Non - Conforming Sign Maintenance and Repair. Nothing in this Ordinance shall be construed as relieving the owner of use of a legal non - conforming sign or owner of the property on which the legal non- conforming sign is located from the provisions of this Ordinance regarding safety, maintenance, and repair of signs, provided, g p , however, that any repainting, cleaning, and other normal maintenance or repair of the sign or sign structure shall not modify the sign structure or copy in any way which makes it more non- conforming or the sign shall lose its legal non - conforming status. 30 401.15.G.12. MAINTENANCE. All signs, together with all of their supports, braces, guys and anchors, shall be kept in repair and in proper state of preservation. The display surfaces of all signs shall be kept neatly painted or posted at all times. Every sign and the immediate surrounding premises shall be maintained by the owner or person in charge thereof in a clean, sanitary, and inoffensive condition and free and clear of all obnoxious substances, rubbish and weeds. Notice shall be given to the Zoning Administrator of any change in sign user, sign owner, or owner of the property on which the sign is located. 401.15.G.13. INSPECTION. All signs for which arpermit is required shall be subject to inspection by the City Building Official. The Building Official may order g Y the removal of any sign that is not maintained in accordance with the maintenance provisions of this Ordinance. 401.15.G.14 b. Non - Conforming Uses. When the principal use of land is legally non- conforming under the Zoning Ordinance, all existing or proposed signs in conjunction with that land shall be considered conforming if they are in compliance with the sign provisions for the most restrictive zoning district in which the principal use is allowed. a. Required. Except as provided in this Section, no sign or structure shall be erected, constructed, altered, rebuilt, or relocated until a permit has first been issued by the City. The fees which shall be charged for sign p ermits under this Section shall be in accordance with the fee schedule as determined by resolution of the City Council. b. Sign Application. The owner of the sign, building, structure, or premises shall also, upon removal of any sign, be fully responsible for repairing, replacing, and returning the ground, building wall, or other mounting surface to its original condition or to a proper condition consistent with the present appearance of the area, building wall, or surface. Temporary or-Illegal Signs. The City may impound signs which have been illegally installed upon public property or within public right --of -way or easement. The sign owner may retrieve the signs according to the following: 1) Fee Payment. For impounded signs, there shall be an impoundment and storage fee, as may be approved from time to time by Council resolution. 2) Retrieval of Sign. The sign shall be retrieved from a designated impound area during routine business hours and within fifteen (15) days from the date of impounding. After fifteen (15) days, the City will dispose of the sign. Liability. The City shall not be held liable for any damage to impounded signs. c) Out _ _ Business Signs. In order to provide additional flexibility in the enforcement of this Ordinance and to alleviate hardship and injustice, the City Council may, upon application, grant a variation from the terms of this Ordinance. Upon • application, therefore, from the person seeking a permit for the erection or • installation of a sign, the request for variance shall be processed in accordance with Section 401.04 of this Ordinance, as may be amended. a. Criteria. Additionally, the City Council shall make a finding of fact that an undue hardship or injustice exists if a variance were not granted and therefore, may grant such variations based upon consideration of the following: 1) That particular physical surrounding, shape, or topographical conditions of the specific parcel of land involved exist. 2) That the condition involved is unique to the particular parcel of land involved. 3) That the purpose of the variation is not based exclusively upon a desire to increase the value of income potential of the business involved. 4 That the alleged difficulty or hardship is caused by this Ordinance and has not been created by any persons presently having an interest in the parcel. That the granting of the variation will not be detrimental to the public welfare or injurious to other land or improvements in the neighborhood. 6) That the proposed variation will not impair an adequate supply of light pY 9 and air to adjacent property, or substantially increase the congestion of the public streets or interfere with the function of the Police and Fire Departments of the City. b. Fees.
