PLANNING COMMISSION MEETING MINUTES Thursday, May 9, 2002 DRAFT Call To Order: • Chair Vogt called the meeting to order at 7:02 p.m. Present: Commissioners Dwyer, Powell, and Runk; Community Development Director Danielson, City Planner Richards, and Council Liaison McComber. Absent: Commissioner Liljegren. Approval of Agenda: In light of its significance to Public Hearings on the Agenda, Chair Vogt suggested that Item 2 of New Business be discussed following Visitors /Public Comment and prior to Public Hearings. Commissioner Dwyer, seconded by Commissioner Runk, moved to approve the Agenda with Item 2 of New Business placed for discussion following Visitors /Public Comment. Carried 4 -0. Approve Planning Commission Minutes: Commissioner Runk, seconded by Commissioner Vogt, moved to approve the minutes of April 11, 2002 as presented. Carried 4 -0. Department /Commission Liaison Reports: 1. Hwy. 36 Partnership Study: Mary McComber reported that the partnership committee met on May 8th and received traffic analysis data for the three alternatives being reviewed. McComber reported that the next meeting of the Hwy. 36 Partnership Study is scheduled for 6:30 p.m., May 29th at the Washington County Government Center. She further reported that a meeting of the aesthetic design committee will be held at 8:00 a.m., May 22nd at the Oak Park Heights City Hall and that an Open House is scheduled from 4:30 to 7:30 p.m., May 22nd at Stillwater Area High School. McComber noted that a great deal of information is to be available, including an artistic rendition of the parkway concept and the three design - styles. 2. Other Commission / Liaison Reports: None. Visitors /Public Comment: None. New Business: (As moved per motion and second on Agenda approval) 2. Consideration of Scheduling Special May 23rd Meeting: Chair Vogt noted that the special meeting scheduled for May 6th for discussion of the McKean Square West, Oakgreen Village Townhomes, Oakgreen Village Villas and Oakgreen Village Apartments public hearing applications was cancelled at the request of the applicants and that they had requested a continuation and extension of 120 day timeline. Chair Vogt asked for and received an update from Community Development Director Danielson and City Planner Richards as to the proposed projects status and extension request. DRAFT Planning Commission Minutes May 9, 2002 Page 2 of 5 Discussion ensued as to the need for a special meeting, legal aspects involved with the extension request, timeliness and general options for proceeding. Commissioner Dwyer expressed his desire to see material, prior to next meeting, if significant changes to the site plan were made. Chair Vogt moved that a May 23rd special meeting not be scheduled and to recommend that the City Council approve request for 31 -day extension. Discussion continued as to when information from the applicant would be available to staff for review. Ken Hooge of Sr. Housing Partners addressed the Commission and advised them that they were trying to move the project ahead as rapidly as possible. He noted that changes to the site plan are not drastically different but noticeably better in meeting the goals and guidelines as established by the City of Oak Park Heights. He added that a concentrated effort has been made to improve the town -home area, with modifications to building design and configuration. Chair Vogt elected to withdraw his earlier motion as a result of discussion following the same. Brief discussion ensued as to the timing for coordination of meetings, materials submission deadlines, staff review and availability for commission distribution. Commissioner Vogt, seconded by Commissioner Dwyer, moved to recommend that the City Council grant request for 31 -day extension to applicants for Mckean Square West, Oakgreen Village Townhomes, Oakgreen Village Villas and Oakgreen Village Apartments applications. Carried 4 -0. Commissioner Runk, seconded by Commissioner Dwyer, moved to recommend the scheduling of an additional Planning Commission for 7:00 p.m., June 3, 2002 at the Oak Park Heights City Council Chamber for continued discussion of the Mckean Square West, Oakgreen Village Townhomes, Oakgreen Village Villas and Oakgreen Village Apartments applications. Carried 4 -0. Public Hearings: A. Applebee's: To consider requests for sign variance and site plan review for vestibule addition at 13625 60th St. N. City Planner Richards provided an overview of the applicant's requests and a summary of his report regarding the same. Chair Vogt opened the hearing for public comment at 7:35 p.m. Jay Noseworthy - Applebee's Manager stated that it was the desire to be more convenient that prompted their request. Commissioner Runk, seconded by Chair Vogt, moved to recommend that the City Council approve the applicant's request for sign variance and site plan review, subject to the conditions within the April 25, 2002 City Planner's report, as follows: 1. One additional wall mounted sign not to exceed 10 square feet and to be allowed on the east elevation of the Applebee's Restaurant. 2. The sign shall be illuminated during regular business hours and must be turned off after 1:00 a.m. 3. Th neon sign shall not flash or rotate in any manner. 4. Landscaping and screening shall be subject to the review and approval of the City Arborist. 5. Any other conditions of the Planning Commission, City Council, and City staff. Carried 4 -0. B. 401 Ordinance Amendment: To consider amendment to City of Oak Park Heights Ordinance 401 as it pertains to signage. Chair Vogt summarized the history of the issues. City Planner Richards asked the Commission for direction on how they would like to proceed with public hearing and ordinance draft., Chair Vogt opened the public hearing for comment at 7:42 p.m. There being no visitors for public comment, Commissioner Runk, seconded by Commissioner Powell, moved to continue the public hearing to the next meeting of the Planning Commission. Carried 4 -0. City Planner Richards referenced the City of Burnsville sign ordinance, noting that the structure of the ordinance itself was very good, as was many of the ordinance provisions. Chair Vogt asked for comment on the ordinance structure and procedure for moving forward to address the issue of possible amendment. Commission discussion ensued as to proposed changes, desire to see a draft of Oak Park Heights ordinance to review, and format style of draft for review. Commissioner Runk, seconded by Commissioner Dwyer, moved to request that a draft proposal be prepared for the Commissions review prior to their meeting of June 13, 2002. Carried 4 -0. Chair Vogt initiated a brief discussion regarding conduct for this public hearing, along with the continued hearings for Oakgreen Village Townhomes, Oakgreen Village Villas and Oakgreen Village Apartments, in light of the earlier made motions to schedule a June 3 2002 special meeting and recommending that the City Council approve the request for 31 -day extension. City Planner Richards indicated that each hearing should be opened for public comment, if any, and the moved for continuance. Chair Vogt opened the hearing for public comment. There being no public comment, Commissioner Runk, seconded by Commissioner Dwyer, moved to continue the public hearing to the next meeting of the Planning Commission. Carried 4 -0. D. Respectfully submitted, Julie Hultman Community Development Approved by the Planning Commission: PLANNING REPORT TO: Kimberly Kamper FROM: Scott Richards DATE: June 6, 2002 RE: FILE NO: 798.02 - 02.13 BACKGROUND Oak Park Heights — Century Power Equipment: Building Addition And Remodeling, Conditional Use Permit, Site Plan, and Design Guideline Review Roger and Bruce Tuckner have requested approval for an expansion and remodeling of the existing Century Power Equipment at 5920 Memorial Avenue North. The building expansion consists of a 27,700 square foot addition to the west and north of the existing 10,500 square foot building. The expansion will include an added showroom /sales area, a parts department, service department/repair area, employee loun e, general p g g office, and a warehouse. The existing building remodeling will include a demolition, removal, and modifications of existing exterior walls and interior partitions, a new building entrance, sales offices, service write -up area, and restrooms. Changes to the site will include an expanded bituminous parking lot and loading dock/delivery area with a concrete curb and gutter, a storm water drainage system, and new landscaping. The subject site is zoned B -3, Highway Business and Warehouse in which retail sales and service facilities are a permitted use. The business has done limited outdoor sales and storage of vehicles in the past. A conditional use permit has been requested to allow for the outdoor sales to continue. The proposed building addition and site plan changes will also require review and approvals to assure consistency with the Design Guidelines and Zoning Ordinance performance standards. A conditional use permit is also required to allow less than 20 percent of the buildable portion of the lot to remain as a grass plat with landscaping. The subject site is guided for Highway Business/Warehouse within the Comprehensive Plan. The current B -3, Highway Business and Warehouse District zoning is consistent with the Comprehensive Plan. The expanded retail /service land use is also compatible with the existing uses in the Kern Center. Zoning. The indoor sales, service, and storage aspects of this business are a permitted use in the B -3 District. Open and outdoor services, sale and rental as a principal use is a conditional use. The business will continue to display a limited number of recreational vehicles for sale on the exterior of the building, thus requiring conditional use permit review. Open and Outdoor Sales. The applicant has proposed a continuation of the limited outdoor sales of merchandise. In the past, recreational vehicles have been placed in the yard /parking area as an advertisement for sale. The applicant has requested a continuation of this practice as a conditional use. City staff suggests that the request is compliant with the provisions for outdoor sales in the B -3 District (Section 401.300.E) although conditions should be added to an approval. The following are suggested for Planning Commission and City Council consideration: 1. Vehicles for sale shall not be displayed in required parking stalls. All vehicles for sale must be placed on a concrete or asphalt surface. 2. Outside sales shall be limited to 20 percent of the interior retail sales area or 3,000 square feet. 3. No long term storage of vehicles shall be allowed outside of the building. 4. All repairs shall be conducted inside of the building. No parts storage or parts vehicles shall be stored outside of the building. The applicant has indicated that they would like to continue displaying vehicles for sale on the grassed berm area adjacent to Highway 36. The City would need to review that request under a separate variance request. 2 • • • Lot Performance Standards. The Zoning Ordinance specifies lot g p setback requirements for new and expanded buildings. The B -3 District requirements of the Zoning Ordinance require that all loading areas should be screened from surrounding areas by landscaping, berming, or fencing. The landscape plan should be reviewed to address loading dock screening, especially from Highway 36. Landscaping. A landscape plan and a tree preservation plan has been submitted. Kathy Widen, the City Arborist, has made comments on the plans. The final landscape plan and tree preservation plans are subject to review and approval of the City Arborist. The landscape plan, as submitted, provides a minimal mount of landscaping on the north and south property lines. Additional trees and plant materials shall be required as necessary on the south property line and shall complement the MnDOT landscaping along Highway 36. The City Arborist should comment on this issue. As indicated, the loading dock will need to be screened. Screening. The B -3 District requirements of the Zoning Ordinance require adequate screening of storage areas, heating /air conditioning units, air handling equipment, trash receptacles, and rooftop equipment. Screening of these site and building elements shall be required as part of the landscaping plan. Building Height and Design Guidelines. These materials, in addition to glass windows, and compliant with the standards for a warehousing building. The applicant must submit material samples to ensure that the colors comply Design Desi n Guideline standards. The applicant has indicated the exterior colors will be the same or similar to what exists. The east exterior elevation is adequately detailed with significant window area and the peaked roof element above the front entrance. The north and south elevations have vast expanses of blank block areas that could be improved with additional vertical elements. CMUs could be used to provide vertical elements at the corners and at points along the building facade. Architectural elements could be added where the storm water is brought from the roof to the parking lot. More variety in CMU colors with additional banding may also assist in providing the building more character. Lighting Plan. The lighting plan indicates the fixture placement and photometrics for the site. Also included is a cut sheet with specifications for the proposed fixtures. The applicant will need to verify that the total height of the pole and fixture will not exceed 25 feet. Additionally, the photometric plan indicates that the allowable light exceeds 0.4 foot candles along the east property line. This issue will need to be corrected so as to be compliant with the Zoning Ordinance requirements. The applicant will need to submit a revised lighting plan indicating conformance with the 25 foot fixture and pole standard, and a revised photometric plan. The fixtures and plans will be required to comply with Section 401.15.7 of the Zoning Ordinance and all the luminaries will need to be installed so that they provide a cutoff which directs light at an angle of 90 degrees or less. • Signage. The plans do not provide signage details. The existing pylon sign will need to be removed for the expanded parking area. The existing sign is not compliant with freestanding sign structure requirements for the B -3 District. The property will be allowed one freestanding sign to not exceed 50 square feet and a maximum height of . g 20 feet. The building will be allowed one 64 square foot wall sign. Signage plans will need to be submitted for review and approval. proposed os Trash. The site plan indicates a trash storage /enclosure to the west of the ro ed building expansion. The enclosure is proposed to be constructed of wood fencing materials. The performance standards of the Zoning Ordinance require that the materials of the enclosure be similar or complement the principal building. It is suggested that the walls of the enclosure be constructed of CMUs with wood gates. Appropriate landscaping should be provided around the enclosure. Snow Removal. The applicant shall submit a plan for site snow removal. 5 Grading, Drainage, and Utility Plans. A grading and drainage plan, as well as drainage calculations, have been submitted to the City Engineer for review. The p lans are also subject to review by the Browns Creek Watershed District. Building Code. The existing /proposed building shall be brought current with all building /fire codes as required by the Fire Marshal and Buildin g Official and in compliance with all fire and building codes. CONCLUSION /RECOMMENDATION The proposal for an expansion and remodeling of the existing Centu Power with g ry Equipment at 5920 Memorial Avenue North is generally consistent wi the provisions of p the Zoning Ordinance and Design Guidelines. As such, our office recommends approval of the conditional use permits for outdoor sales, and to exceed the allowable impervious surface coverage of the buildable lot area, site plan review and Design p g Guideline review subject to the following conditions: 1. Vehicles for sale shall not be displayed in required parking stalls. All vehicles for sale must be placed on a concrete or asphalt surface. 2. Outside sales shall be limited to 20 percent of the interior retail sales area or 3,000 square feet. 3. No long term storage of vehicles shall be allowed outside of ' the building. 4. All repairs shalt be conducted inside of the building. No arts storage or parts p g p vehicles shall be stored outside of the building. 5. Any allowance for display of vehicles for sale in the yard or on grass areas shall require application of a variance, as specified in Section 401.04 of the Zoning Ordinance. 6. The Planning Commission and City Council shall require additional landscaping in p g and building facade improvements, as required below, to address the allowable impervious surface coverage conditional use permit. 7. The site plan shall be revised to accommodate at least 115 parking stalls. Proof p g of parking stalls will be allowed, as provided for on the approved site plan. The City Council may order, at any time, the construction of the roof of parking p g stalls. 8.
