RE: Fence Installation — 58 stre - 0 Dear Mr. Nolde The City has been asked questions regarding the trail along 58 street and the split -rail fence. Per the approved plans, there is a required installation of a split -rail fence to protect against falls from lands adjacent to the pond along 58 Street. This fence will however be impacted by snow removal services as snow - benching will need to occur. Accordingly, you have a few options: 1. Submit a revised plan for review where the fencing is not needed, (this must result in a 3 -1 slope in this area or less steep). This may require DNR and/or MSCWMO approval and is your obligation to pursue and verify if these are needed. 2. Expand the distance between the trail edge and the fence location, to not less than 5 feet. This too may require DNR approvals which the City is not responsible for. 3. If the fencing remains as reviewed, at no time will the City accept responsibility for any such maintenance or damages as a result of snow removals. In theory, the rails could be removed preventing damages each season, but this would not be the responsibility of the City and this may damage the posts as well. Perhaps there are other options?
