This permit is for only the work described, and does not grant permission for additional or related work which requires separate permits. RESOLUTION NO. 11 - 07 - 20 CITY COUNCIL CITY OF OAK PARK HEIGHTS WASHI'NGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RESOLUTION OF THE CITY COUNCIL THAT THE REQUEST BY APPLE MINNESOTA, LLC FOR DESIGN GUIDELINES REVIEW FOR THE REMODEL OF AN APPLEBEE'S - RESTAURANT AT 13625 60 STREET NORTH BE APPROVED WITH CONDITIONS WHEREAS, the City of Oak Park Heights has received a request from Apple Minnesota, LLC for Design Guidelines review for the remodel of an Applebee's Restaurant at 13625 60 Street North; and after having conducted a review relative thereto, the Planning Commission of Oak Park Heights recommended that the request be approved with conditions. The City Council of the City of Oak Park Heights makes the following findings of fact and resolution: 1. The real property affected by said application is legally described as follows, to wit: SEE ATTACHMENT A and 2. ' • The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B and 3. The property is zoned B -4, Limited Business District. Restaurants are a listed permitted use but the project requires Design Guidelines review; and 4. The building will be remodeled to include the addition of a tower architectural feature at the front entrance, new awnings, signage and lighting, and an update to the interior. There are no changes to driveways, parking or landscaping that would require site plan review; and 5. City staff prepared a planning report dated July 7, 2011 reviewing the request; and 6. Said report recommended approval of the Design Guidelines review subject to the fulfillment of conditions; and 7. The Planning Commission discussed the application at their July 26, 2011 meeting, took comments from the applicants and public, and recommended. that the application be approved with conditions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE FOLLOWING: A. The application submitted by Apple Minnesota, LLC for Design Guidelines review for an Applebee's Restaurant at 13625 60 Street North and affecting the real property as follows: SEE ATTACHMENT A Be and the same as hereby approved by the City Council of the City of Oak Park Heights with the following conditions: 1. All lighting fixtures shall be full cut off and installed in compliance with the lighting standards of the Zoning Ordinance. All visible interior lighting shall also be full cut off. The lighting specifications shall be subject to review and approval of the City Planner at the time of permitting. 2. The outdoor lighting shall be turned off one hour after closing, except for approved security lighting. 3. The City Council resolved that the freestanding pylon sign be retained as is or if the sign structure or signage be changed, then the sign be constructed as a monument and be brought into be brought into conformance with current sign standards of a 20 foot height and a maximum of 100 square feet of signage. 4. The City Council was favorable to allowing the light wash of the awnings with LED fixtures. 5. The sign specifications and methods of illumination shall be subject to review and approval of the City Planner at the time of permitting. 6. Mechanical equipment that is located on the roof and visible from street level or from neighborhood properties shall be screened with materials that blend harmoniously with the building facade materials. 7. The City Council was favorable to the sustainability initiatives discussed by the applicant for the project. 2 8. The City Council was favorable to the building material selection and colors. A materials board was approved by the City Council. 9. The City Council intends to construct an eight foot bituminous trail on the south side of 60 Street North adjacent to Applebee's. Applebee's agrees to a special assessment for this improvement and does hereby waive all rights they have by Minnesota State Statutes 429.081 or otherwise challenge the amount or validity of the assessments or procedures used by the City in levying the assessments. 10. The applicant shall provide a plan with a location of the trail and a trail easement, subject to review and approval of the City Engineer and City Attorney. 11.
