Oak Park Heights, MN 55082 Re: Outside Storage & Possible Home Based Business Occupation Dear Mr. Larson, It has been brought to my attention that you have several appliances stored in your driveway. My site investigation of yesterday found this to be true. This letter is to inform you that this outside storage is a violation of section 401.15.B of the City's Zoning Ordinance. Ordinance Section 401.15.B. states that all materials and equipment shall be stored within a building or fully screened so as not to be visible from adjoining properties and the public right -of -way. I have enclosed a copy of this section for your review. At this time I am requesting that you either store all of these items, including the washing machines, shelving, 2 wheel dolly, and all the items beneath the blue tarp, within your garage or remove them from the premises. Compliance to this must be met within ten days of the date of this letter. Additionally, please be advised that if you are conducting a business of repair and /or resale, etc. of these appliances from your home, this is considered a home based business occupation and by City Ordinance requires a home occupation license be obtained. This ordinance is in effect to prevent home occupations that may because of traffic or noises created, etc., may have a negative effect to the neighborhood. If this is the case, or if you have questions, please contact Julie Hultman. I appreciate your immediate attention to these requests. Odors. The emission of odor by any use shall be in compliance with and regulated by the State of Minnesota Pollution Control Standards, Minnesota Regulation APC 7005, as may be amended. 11. Noise. Refuse. Bulk Storage (Liquid). All uses associated with the bulk storage of all gasoline, liquid fertilizer, chemical, flammable and similar liquids shall comply with requirements of the Minnesota State Fire Marshal's and Minnesota Department of Agricultural Offices and have documents from those offices stating the use is in compliance. 17. Radiation Emission. All activities that emit radioactivity shall comply with the minimum requirements of the Minnesota Pollution Control Agency. 18. Electrical Emission. All activities which create electrical emissions shall comply with the of the. Federal, Communications Commission. 19. Building Security. All multiple family buildings shall be provided with security systems subject to comment of the Chief of Police and the Building Official. 20. Sales in Residential /Commercial Areas. a. Page l of l Julie Hultman From: Jennifer Thoen Sent: Tuesday, February 05, 2008 11:07 AM To: Julie Hultman Subject: Home Occ Gone Wild Julie, A concerned resident stopped in today (Feb. 5th) to inform us that a neighbor of hers has been running an appliance business out of his home. She explained that the neighbor is a renter and that the home owner does not have anything to do with the business. The house is located on 56th Street Circle North directly behind the house located at 14400 Upper 56t Street. She was unsure of the house number. The reason she is concerned is because the home occupation has gotten a little out of control. She stated that the neighbor used to store appliances in his garage but now they are spilling out into the driveway and the yard. The resident asked to remain anonymous so I did not ask her name, but she is wondering if you or Jim could drive by the residence and maybe send a letter.
