Changes to Dev. Agreement
Here are my suggested changes to the Development Agreement for the two
issues we discussed this afternoon.
1. Sections 3 D and E should be supplemented to allow each Developer to
use a letter of credit in lieu of a performance bond to secure faithful
performance of the construction contracts, so long as the two LOI
documents having a term of one year and equally the total construction
amount.
2. Section 6 U should, be modified as follows
Delete the first sentence because no one really knows if there will be
a problem.
The second sentence should be amended to read as follows:
U. The PUD and CUD permit issued in this matter shall expressly retain
a right of review to the City for a period of six months following
execution of this Agreement and allow the City during such time period
to require the developer to make reasonable modifications to the site
access and traffic circulation patterns, at Developer's expense, if the
traffic use of or to the site creates a significant public safety
hazard.
