DOCUMENT DESCRIPTION: Resolution terminating the Conditional
Use Permit for A -1 Maintenance.
BACKGROUND: Mr. Nelson appeared before the Council November 25,
1997 and several conditions with deadlines were outlined. Mr.
Nelson assured the Council that he would complete said
projects. The building official (see attached letter) has
noticed noncompliance of the permit and has attempted to
contact Mr. Nelson. The City Planner has also tried to discuss
these issues with Mr. Nelson, but he does not return the phone
calls.

Resolution Terminating the Conditional Use Permit of A -1
Maintenance.

CITY OF OAK PARK HEIGHTS
WASHINGTON COUNTY, MINNESOTA
A RESOLUTION TERMINATING THE CONDITIONAL
USE PERMIT OF A -1 MAINTENANCE
WHEREAS, the City Council of the City of Oak Park Heights
previously issued its order to Mr. John Nelson, the owner of A -1
Maintenance, who had been previously issued a Conditional Use
Permit in the City of Oak Park Heights, which order required him
to show causes as to why the Conditional Use Permit should not be
terminated for noncompliance with the original conditions imposed
by the City Council; and,
WHEREAS, Mr. Nelson made an appearance at the November 25,
1997 Council meeting; and,
WHEREAS, the City Council in the November 25, 1997 meeting
imposed deadlines for Mr. Nelson to finish projects as follows:
1. Fencing to be completed by January 15, 1998;
2. Submitting a parking lot plan to the City Engineer for
r1 curb and gutter by May 1, 1998; and,
3. Parking lot to be completed by July 1, 1998; and,
WHEREAS, the City Council has received a report from the
building official indicating the property is now being used for
unauthorized exterior storage and that the fencing that was
ordered to be completed on January 15, 1998 has not been done by
the permit holder; and,
WHEREAS, it appears to the City Council that the Conditional
Use Permit is in noncompliance and a good faith effort has not
been made by the permit holder to comply with the terms and
provisions of the Conditional Use Permit.
NOW, THEREFORE, BE IT RESOLVED, By the City Council for the
City of Oak Park Heights as follows:
1. That the Conditional Use Permit originally issued to John
A. Nelson, operating under A -1 Maintenance, Inc., shall be and
the same is hereby terminated and revoked effective July 2, 1998.
BE IT FURTHER RESOLVED, that Mr. Nelson of A -1 Maintenance,
Inc. may petition for re- instatement of said permit prior to July
2, 1998 should he perform the following:
1. Demonstrate full compliance with the terms and
condition of the original permit as issued and as clarified by
'-` the Council order of November 25, 1997 requiring fencing to be
completed by January 15, 1998, submission of a parking lot plan
to the City Engineer for curb and gutter by May 1, 1998, and
parking lot completed by July 1, 1998; and,
2. Demonstrating full compliance with the balance of the
terms and provisions contained within the ordinance of the
City of Oak Park Heights as it affects said property.
Passed by the City Council of Oak Park Heights this 10th day of
February, 1998.

The following conditions of Mr. Nelson's Conditional Use Permit have not been met or are in
violation of the conditions set for his permit.
1) I have not received a letter verifying that the facility has been inspected by Fire Chief
Schwartz. The Chief was to inspect the storage of gasoline and verify that it was being
stored in approved containers as required in Item II -D of Mr. Nelson permit.
2) Item II -C of Mr. Nelson's permit does not allow exterior storage. At this time there is an
old truck and also an old car being stored outside.
3) Item II -B covers the fencing of the facility. It is my understanding that Council, at the
request of Mr. Nelson, was going to permit Mr. Nelson to leave openings of approx-
imately 10 feet in his north and south fence for snow removal. At this time there is
an opening of approximately 60 feet. From the front fence Mr. Nelson has installed 24
feet of fencing going towards the rear of his property. From the swing gate he has
installed 16 feet of fence towards the rear of his property. Please refer to the enclosed
plan for these details.

8. Approve the Purchase of Surveillance Camera and Varda Alarm
System by the Police Department at an approximate cost of
$7,000, Using Grant Money.
Councilmember Turnquist, seconded by Swenson, moved to pull the
minutes from November 12 off the Consent Agenda.
Councilmember Turnquist, seconded by Swenson, moved to approve
the Consent Agenda as amended. Roll call vote was taken.
Carried 4 -0.
Turnquist said that he voted against the Osgood /Highway 36
Preliminary Study. Minutes amended to read, Ca.L.i 1 5 -0.
"Carried 4 -1, Councilmember Turnquist voting against."
Councilmember Turnquist, seconded by Beaudet, moved to approve
the minutes as amended. Carried 4 -0.
Public Hearings:
Off -Sale, Non - Intoxicating Liquor License and Tobacco License to
Fleming Companies, Inc. dba Rainbow Foods - Acting Mayor
Turnquist opened the Public Hearing at 7:30. With no one wishing
to speak, Councilmember Beaudet, seconded by Swenson, moved to
close the Public Hearing. Carried 3 -0. Councilmember Swenson,
seconded by Beaudet, moved to approve the licenses to Rainbow
Foods. Carried 3 -0; Mayor Schaaf absent from vote.
1 ( Unfinished Business:
Jon Nelson - A -1 Maintenance - Mr. Nelson was present to discuss
concerns that he had not fulfilled his Conditional Use Permit
requirements. Mr. Nelson said that all conditions from the
original 1994 CUP had been satisfied except the parking lot.
There is to be no outside storage, and Nelson said that he has
complied except for the week and a half time where he was in
transition between fall and winter equipment. Planner Richards
said that the driveway is supposed to be completely paved, and
that Mr. Nelson has only paved the driveway portion. Nelson said
that he was planning on using Class 5 for the lot and that he had
spoken with former administrator Robertson about that. Richards
indicated that the Council can change the conditions of the CUP
if Class 5 is adequate. Council agreed that they did not want to
change the conditions and that Nelson should pave the lot.
Richards also said that the fencing was not complete. Council
set deadlines for Mr. Nelson to finish these projects:
1. Fencing to be completed by January 15, 1998;
2. Submission of parking lot plan to the City Engineer for curb
and gutter by May 1, 1998;
3. Parking lot to be completed by July 1, 1998.
Nelson said that he has applied for a cold storage space in
Oakdale in which to store equipment not in season. Planner
Richards said that he would draft a letter to the Oakdale City

Council indicating Nelson's desire to cooperate and comply with
Oak Park Heights regulations. —
New Business:
Resignation of City Arborist Ken Kaiser - Mayor Schaaf said that
Mr. Kaiser has resigned after 18 years with the City. He thanked
Mr. Kaiser for all his work for the City. Councilmember Beaudet
noted that Kaiser contributed a lot to the City: he started the
boulevard tree program in Oak Park Heights, helped the City
become part of the Tree City USA program, and noticed and removed
Dutch elm diseased trees.
Local Board of Review Status - Mayor Schaaf said that legislation
has allowed local governments to turn this review board over to
the County. Interim Administrator Holst has recommended against
this. Councilmember Turnquist said that he felt that this board
was an opportunity for elected officials to work with citizens
and he felt that it was an effective tool. Council directed
staff to write a letter to the County indicating that the City is
not interested in turning the board over to the County at this
time.
EVP - Councilmember Swenson said that he has researched the EVP
for the Osgood and Highway 36 intersection and that there is
state aid available for this type of upgrade. He recommended
that the Council direct the City Engineer to work with MN /DOT,
the Metro State Aid Section, Washington County Sheriff's Office
and surrounding communities to prepare a plan for joint funding
and implementation of this system to present to the Council.
Councilmember Beaudet said that he felt the City should wait
until the bridge issue has been resolved, because the State would
then pay for the upgrades. Councilmember Swenson, seconded by
Schaaf, moved to have the City Engineer work on this project.
Carried 3 -1, Councilmember Beaudet voting against.
Adjournment: Councilmember Swenson, seconded by Beaudet, moved to
adjourn at 7:45 P.M. Carried 3 -0; Mayor Schaaf absent from vote.

ITEM /ACTION DESCRIPTION: Review of Conditional Use Permit for A -1
Maintenance.
BACKGROUND: Jon Nelson of A -1 Maintenance was issued a Conditional
Use Permit in 1994 with planners conditions:
1. No outside storage;
2. Submission of landscaping plan-
3. Submission of improvement schedule;
4. Parking & driveway paved
Mr. Nelson was before the Council June 24, 1997 to explain why he
was not in compliance with the conditions. He told the Council that
he was finishing up projects and that the driveway was to be poured
the next week. He assured the Council that he would be in
compliance with the CUP at that point. Jim Butler viewed the
property and found that it was not in compliance as of November 14,
1997.

ACTION REQUESTED: Because Mr. Nelson has not complied with the
conditions after the initial permit nor after revisiting the Council
in June Councilmember Turnquist is requesting that the Council
reconsider allowing Mr. Nelson to keep his Conditional Use Permit.

UPON COUNCIL'S REQUEST I DID A SITE INVESTIGATION ON NOV. 14, 1997 TO
FOLLOW UP ON THE CONDITIONS SET FORTH FOR MR. NELSON CONDITIONAL
USE PERMIT. ON NOV. 18TH I RETURNED TO TAKE PICTURES OF THE SITE FOR
COUNCIL TO REVIEW.
#1 SHOWS THE ENTRY FENCE WITH TWO SMALL PINES. THE SOUTH ENTRY
FENCE IS THE SAME.
#2 THE ENTRANCE SHOWING EMPLOYEE VEHICLES PARKED ON THE STREET.
AT THIS TIME THE CONCRETE DRIVE WAS COMPLETED AND THEY WERE
IN THE PROCESS OF PUTTING DOWN CLASS 5 MATERIAL ON THE REST OF
THE PARKING AREAS.
#3 SHOWS A TRAILER WHICH IS USED FOR HAULING LAWN MOWERS PARKED
ON THE STREET.
#4 THE SOUTH WEST CORNER OF THE PROPERTY SHOWS AND OLD TRUCK
WHICH APPEARS TO BE IN THE PROCESS OF BEING REPAIRED AND A PLOW
TO BE INSTALLED ON A TRUCK.
#5 THE SOUTHEAST CORNER HAD A TRAILER WITH A FERTILIZER TANK ON
IT, A TRAILER WITH MOWERS, AND OTHER MISCELLANEOUS ITEMS.
#6 THE REAR OF THE BUILDING HAD TRAILERS WITH MOWERS. AT THE TIME
HIS EMPLOYEES WERE TAKING INVENTORY.
#7 THE NORTH PROPERTY LINE SHOWS A TRAILOR WITH LAWNMOWERS AND
BUCKETS FROM BOBCATS.
ON THE AFTERNOON OF THE 18TH MR. NELSON CAME TO MY OFFICE TO DISCUSS
MATTERS OF CONCERN. HE INDICATED THAT HE WAS IN A TRANSITION PERIOD
BETWEEN LAWN MOWING AND SNOW PLOWING AND THAT EVERYTHING
SHOULD BE MOVED TO ANOTHER SITE WITHIN A WEEK. IN REGARDS TO A SITE
PLAN HE STATED THAT FOR THE MEETING ON JUNE 24, 1997 THAT HE HAD SUB-
MITTED A REVISED PLAN FOR COUNCIL'S APPROVAL. MR. NELSON SPOKE OF
INSTALLING CHAIN LINK GATES AT THE CORNERS OF HIS BUILDING TO
CONCEAL STORAGE ON THE SIDES OF HIS BUILDINGS.
IN REVIEWING THE FILE THERE IS TO BE NO OUTSIDE STORAGE. MR. NELSON
WILL BE ASKING COUNCIL FOR APPROVAL OF STORAGE BEHIND HIS SECURITY
GATES AND I RECOMMEND IT BE GRANTED, BUT LIMITED TO TRAILERS WITH
EQUIPMENT OR TRUCKS, AND ABSOLUTELY NO MISCELLANEOUS STORAGE.

Re: A -1 Maintenance Conditional Use Permit
I have enclosed several items relating to the A -1 Maintenance
Conditional Use Permit. Those are;
1) A packet of information (Enclosure 9B) provided by owner Jon
Nelson.
2) A copy of surveys (Enclosure 9C) Jon Nelson did of some
nearby property owners which includes their comments about his
business.
3) A copy (Enclosure 9D) of the Permit issued 11/15/94.
4) A copy (Enclosure 9E) of the planners report on the original
application.
Recommendation: Mr. Nelson has made large strides toward
bringing his property into compliance since the Council scheduled
the public hearing. If the Council is satisfied that Mr. Nelson
is willing to complete the remaining work necessary to come into
compliance with his permit, I would recommend he be given a
period of time to finish the remaining work, with any action on
the permit tabled until that time.

To City of Oak Park Heights Council Members:
This letter is in regards to our Use Permit for the property located on 5845 StageCoach Trail. The
following is a list of the issues regarding this use permit.
• Dumping on the grounds of A -1 Maintenance, Inc.
• All Dumping has been clean fill which has been approved by the City of Oak Park Heights to
prevent erosions problems around the facility.
• Please see attached receipts of payments made to Buberl. (The place where we dump
composting and brush.)
• Delay in driveway
• Jim Butler and Michael Robertson were aware of that I was trying to purchase the adjoining
lot North of A -1 Maintenance, Inc.
• Please see attached copies of certified letters sent to Mr. Wellmen regarding the purchase of
his property.
• If the purchase was completed, I would have to have the lot filled which would result in heavy
damage done to the parking areas from all the heavy equipment and dump trucks driving
across the property of A -1 Maintenance, Inc. We would have to redo the driveway at this
time. I was hoping for a little leeway from the City Administrator so we would only have to
put in one driveway instead of two.
• Impact on Neighborhood
• I sent out a survey to all neighbors across the street that are directly impacted by the
environment of A -1 Maintenance, Inc. The resuits were positive. Please see the attached
copies of the surveys. Please note all surveys are signed.
• I also met with each neighbor to talk about any concerns they might have. I think you will see
the overall opinion is positive regarding the impact that A -1 has on the community.
• One issue that has already been addressed is the noise pollution. I have taken steps to decrease
this noise: moving different work stations in the shop and making sure doors are closed when
heavy mechanicai work is being completed.
• Outside Storage
• A -1 Maintenance, Inc. grew over 75% in 1996. We are showing the same rapid growth in
1997. To keep up with this growth, we needed to purchase more equipment/trucks than the
facility could hold. This obviously caused concern to Mike Robertson and Jim Butler.
• We have acquired some off -site facility to handle the overflow. I would like to ask the City
Council to approve fencing running from North & South of the side of the building that would
block any sight of a trailer /vehicle having to be left outside
• I have moved my personal watercraft and it will not return to the facility.
Overall, our improvement to our facility has had a positive impact to 5845 StageCoach Trail. We have put
in new screen fencing, awnings, new garage doors & windows, Landscaping, painting, and decade trees
taken down. Future improvements are planned for driveway, extended fencing, front gate, plumbing to
eliminate the satellite. Please see attached picture of other businesses in the area and compare them to A -1
Maintenance, Inc. There is no comparison for the short-time I have been there.
I apologize for the concern that I have cause the City of Oak Park Heights. All items on the special use
permit will be carried out unless I have direct written approval from the City Administrator. I extend an
open invitation to all City Council Members to visit the sight of A -1 Maintenance, Inc.

COUNCIL ACTION REQUESTED: Review of A -1 Maintenance Conditional
Use Permit.
BACKGROUND /JUSTIFICATION: A -1 Maintenance has not lived up to the
conditions of their Conditional Use Permit. In discussions
between the City Administrator, the Building Inspector, and Mr.
Nelson this winter, Mr. Nelson said he would clean his property
up in the spring. Mr. Nelson was told this would involve
removing all those items stored outside. He was also told to
remove the piles of leaves and soil stored on the property and
not to place any more on the property. A recent inspection
showed Mr. Nelson had not complied with this request. During
conversation with Mr. Nelson he questioned the fairness of some
of the requirements and so he has been invited to come before the
City Council.
STAFF RECOMMENDATION: Since Mr. Nelson has received requests in
the past to bring his property into compliance, staff recommends
giving Mr. Nelson two weeks to comply with the conditions of his
Conditional Use Permit. If he is not in compliance by June 10,
1997 staff recommends that Mr. Nelson's permit be revoked at the
Council meeting that evening.
FINANCIAL IMPLICATIONS: None.

Dear John:
This letter is to inform you that our building inspector has
examined your property and found that it is not in compliance
with all the conditions listed on your Conditional Use Permit.
.Specifically you have a variety of items including a boat,
trailer, pickup bed, wood pallets, and other miscellaneous items
stored outside of your building, which are in violation of your
. permit which does not allow any outside storage. In addition,`
. your landscaping, screening, and parking area have not been
. _completed according to the conditions laid out in the City
Planner's report of November .4, 1994. - -
• You.have indicated to the in a telephone conversation that you
feel these conditions are either unfair or being interpreted
incorrectly. I invite you to attend the City Council meeting of
Tuesday,,May 27;-1997 -to discuss this with Council. I have
listed you on the agenda and the Council should be at you agenda
item at about 8:00 p.m.
