N., Oak Park Heights, MN Dear Mr. Nelson, This letter serves as a final reminder of the status of the Conditional Use Permit for the above referenced property. On February 13, 1998, Deputy Clerk/Finance Director, Judy Holst mailed you a letter notifying you of Council Resolution 98 -01 -12 being passed, which terminates your Conditional Use Permit effective July 2, 1998, due to non- compliance of conditions established at the November 25, 1997 City Council Meeting, to which you agreed. For your reference, I have outlined the conditions which need to be satisfied prior to July 2, 1998, to allow you to apply for re- instatement of your Conditional Use Permit. 1. Fencing to be completed by January 15, 1998; 2. Submission of parking lot plan to the City Engineer for curb and gutter by May 1, 1998; 3. Parking lot to be completed by July 1, 1998. To date, none of the conditions have been satisfied. You may apply for reinstatement of the Conditional Use Permit only if you come into compliance prior to July 2, 1998. On May 20, 1998, you and I met at the subject property to review these conditions and discussed the following: 1. With respect to the fencing condition, you were to submit for approval the following information: a. A revised plan of your fence showing the type of fence and accurate measurements of the fence location. b. A certificate of survey to locate your property pins prior to the dumping of any more fill on the perimeter of your property. I also requested that you properly install a silt fence to prevent further erosion. I've enclosed an acceptable design for a silt fence. Tree City U.S.A. 2 You questioned the need for curb and gutter and I did relay this question to City Planner, Scott Richards. Mr. Richards indicated that the plan is to be reviewed by the engineers and should you want to submit an alternate design you may do so, but it must be approved by the engineers. As I have discussed with you previously, your request to use class 5 material for the parking area was denied , and you are required to have the parking area paved. Erosion control must be provided on all lots. Silt fence is the recommended method until grass or sod can be established. Silt fence should be installed as shown on this sheet.
