Adjourn El4CLOSUR1E 1 CITY OF OAK PARK HEIGHTS PLANNING COMMISSION MEETING MINUTES Tuesday, July 26, 2011— Oak Park Heights City Hall Call to Order: Chair Bye called the meeting to order at 6:00 p.m. Present: Commissioners LeRoux, Powell and Squyres; City Planner Richards, City Administrator Johnson and Commission Liaison Abrahamson. Applebee's Neighborhood Bar & Grill —13625 60 St. N.: Site Plan & Design Guidelines Review. City Planner Richards reviewed the planning report noting Applebee's proposal for exterior upgrades and interior updating to their existing restaurant and that they were seeking design guidelines approval for those changes. The applicant provided a building materials and color sample board for review. Brief discussion ensued as to the existing pylon sign design and original approval. Chair Bye invited the application and members of the audience to address the Commission. Randy Carr, Applebee's Director of Operations for Minnesota and Western Wisconsin introduced himself, along with Oak Park Heights Applebee's General Manager, Jay Noseworthy and Construction Superintendent Steve Townsend. Mr. Carr noted that site updating was occurring at 17 locations this year and that updating the same number of sites was anticipated for 2012. Discussion ensued among the Commission and the applicant as to matters such as changing the pylon sign to a monument sign, sign height, visibility, colors and building materials compatibility, whether the existing pylon sign pole could be used in such an alteration, landscaping alterations that would be required, and whether or not such an alteration was financially feasible. Planning Commission Minutes July 26, 2011 Page 2 of 4 It was noted that the proposed awnings design incorporated LED light fixtures and that the bulbs would not be visible and that the awning panel is to be comprised of a solid metal material. The incorporated lighting would serve as wash lighting upon the awnings and that no light would shine through the awnings. Richards inquired whether the applicant had any concerns with the trail conditions or other conditions recommended within his report and asked that they discuss sustainability initiatives built into the project. Review and discussion of the recommended conditions and incorporated sustainability initiatives ensued. Commissioner Squyres, seconded by Vice -Chair LeRoux, moved to recommend City Council approval, as set for in the July 7, 2011 planning report as amended; specifically that: 1. All lighting fixtures shall be full cut off and installed in compliance with the lighting standards of the Zoning Ordinance. All visible interior lighting shall also be full cut off. The lighting specifications shall be subject to review and approval of the City Planner at the time of permitting. 2. The outdoor lighting shall be turned off one hour after closing, except for approved security lighting. 3. The freestanding pylon sign shall be retained as is or if the sign structure or signage be changed, then the sign be constructed as a monument and be brought into conformance with the current sign standards of a 20 foot height and a maximum of 100 square feet of signage. 4. The Planning Commission is favorable to allowing the light wash of the awning of the LED fixtures. 5. The sign specifications and methods of illumination shall be subject to review and approval of the City Planner at the time of permitting. 6. Mechanical equipment that is located on the roof and is visible from street level or from neighborhood properties shall be screened with materials that blend harmoniously with the building facade materials. 7. The Planning Commission is favorable to the sustainability initiatives discussed by the applicant for the project. 8. The Planning Commission is favorable to the building material and colors selection board presented to them by the applicant. Planning Commission Minutes July 26, 2011 Page 3 of 4 9. The City Council intends to construct an eight foot bituminous trail on the south side of 60 Street North, adjacent to Applebee's. Applebee's agrees to a special assessment for this improvement and does hereby waive all rights they may have by Minnesota State Statutes 429.081 or otherwise challenge the amount or validity of the assessments or procedures used by the City in levying the assessments. 10. The applicant shall provide a plan with a location of the trail and a trail easement, subject to the review and approval of the City Engineer and City Attorney. 11. A bike rack shall be added at the front entrance of the building. Carried 4 — O. VIII. Old Business: A. Zoning Ordinance 401.30: to review B -2, General Business District performance standards related to energy efficiency, green space and building standards. City Planner Richards reviewed the July 7, 2011 Planning Report and briefly reviewed earlier discussions to amending the B -2, General Business District including a conditional use permit allowance for structures to exceed three stories and 35 feet. Richards asked that the Commission review the proposed language and consider whether the B -4, Limited Business District CUP allowance should also be changed to add the proposed additional conditions and whether the allowance should also be added to the B -3, Highway Business and Warehousing District. Discussion ensued as to the suggested conditions and considerations of the planning report including establishing setback maximums versus minimums as a design tool and its potential applicability for use in Oak Park Heights. Commissioner Squyres, seconded by Commissioner Powell, moved to recommend City Council approval of: 1. Zoning Ordinance amendment as presented by the City Planner in his July 7, 2011 planning report, including the changes to the B -3, Highway Business and Warehousing and B -4, Limited Business Districts. 2. Zoning Ordinance amendment adding conditional permit use allowances for buildings in excess of three stories or 35 feet within the B -2, General Business District, the B -3, Highway Business and Warehousing District and amending the B -4 Limited Business District, P -I, Public - Institutional District, and R -B, Residential - Business Transitional District accordingly. The property is west of the Super America at the corner of Olene Avenue North and 60 Street. The application consists of requests for a conditional use permit to allow a tire and service store in the B -2 General Business District, a conditional use permit for outdoor storage and site plan /Design Guidelines review. The property has previously been a vehicle sales lot and the building on the site will be removed as part of this proposed development. The site is 1.31 acres and the building is approximately 6,800 square feet in size. Tire • Proz would vacate their current location at 14661 60 Street North. It will be a one story building of 6,800 square feet with a mezzanine for storage. Access for the site is from 60 Street. The parking lot will provide 24 parking spaces, one of which will be disability accessible. Two access points are currently provided from 60 and one access will remain with this redevelopment. The site will also be provided access to the property to the east. The applicants have provided a project narrative that is found as Exhibit 19 of this report. An area directly to the east of the proposed Tire Proz and west of the Super America will remain as a paved area. This was a portion of the former used car sales lot. The lot is platted as a separate parcel that is not part of the proposed Tire Proz or the Super America site. All of these properties are under the same ownership. The paved parcel adjacent to the Super America will remain as a parking area for Super America employees and customers. It is assumed that this lot would be combined with the Super America site for future development. The parcel cannot be developed as a separate parcel in that it does not have adequate frontage on 60 Street. A ten foot grassed area will be created within the parking lot adjacent to the Tire Proz site. It will be required to be irrigated from the Tire Proz system and maintained by the owner of the property. The applicant will need to provide a boundary development agreement for maintenance of this grassed area. The City will require a copy of the final agreement as a condition of approval. ISSUES ANALYSIS - Comprehensive Plan. The property is designated as Commercial on the Proposed Land Use Map. The Tire Proz store will be consistent with this land use designation. Zoning. The property is zoned B -2 General Business District. A conditional use permit is required to allow a tire and service store and another is required for outdoor storage. 2 Section 401.30.E.3 of the Zoning Ordinance lists criteria for review of auto repair minor and tire and battery stores. All of the issues raised in those criteria have been addressed in this report. The one item that should be reviewed carefully by the Planning Commission is the second criterion that specifies compliance with the Design Guidelines... The site plan includes an enclosed tire storage area that requires CUP review of the criteria found in Section 401.30.E.5 of the Zoning Ordinance. A review of those criteria is included in this report. The District requires a 40 foot front yard setback,10 foot side yard setback and 20 foot rear yard setback. The building meets or exceeds these requirements. The building height maximum in the B -2 District is 35 feet. At its highest point, the building will be approximately 22 feet to its highest point. Subdivision. The property is currently in a meets and bounds description. The property owner has the option of plating it as a one lot subdivision and pay park dedication at this time, or to leave it in the current description. If left in a meets and bounds description, 10 foot utility easements along all lot lines will need to be provided to the City at this time. Access. As indicated, the site will be accessed by one curb cut off of 60 Street. The property will also be provided access to the east to the existing parking lot adjacent to Super America. The location of the access points are subject to review and approval of the City Engineer. Parking. Section 401.15.F.9 of the Zoning Ordinance requires eight parking spaces and one additional space for each 800 square feet of floor area over 1,000 square feet. The parking calculation for this site is as follows: 8 parking spaces 8 spaces 5800 square feet x .9 = 5,220 / 800 = 6.5 spaces Total Requirement 15 spaces The site plan indicates that there are 24 parking stalls planned for the development, one of which is disability accessible. The layout as designed will meet the required number of parking stalls and disability accessible stalls. The parking spaces are 9 foot wide stalls with 24 foot driveway aisles in compliance with the Zoning Ordinance. The parking area will be completely surrounded by curb and gutter. All of the parking areas are setback from the property lines at least 20 feet in compliance with the requirements. The setback areas will be landscaped. Two rain gardens are provided, one in the northwest corner of the site and the other on the east property line. 3 Loading areas /Trash Enclosure Location. The loading access to the building will be at the rear /south side of the building and will not impact parking stalls or drive aisles. A rear entrance door provides access into the building. Trash Enclosure /Tire Storage. Trash and tire storage areas are at the rear of the site. They are to be constructed of rock face concrete masonry units to match what is used on the buildings. The gates will be a metal frame with cedar board screening. The tire storage area requires a CUP in that the B -2 District allows outdoor storage of materials only through that process. A review of the criteria specified in Section 401.30.E.5 is outlined later in this report. Grading /Drainage /Utilities. Grading, drainage and utility plans have been provided by the applicant. The City Engineer will provide a separate report on engineering issues. The grading, drainage and utility plans shall be subject to review and approval of the City Engineer and the Middle St. Croix Watershed District. Lighting Plans. Fixtures. The lighting plan indicates that the parking lot lighting will be a shoe box style, full cut off light fixture mounted on a pole and base. The specifications do not indicate a height of the pole and base. The Zoning Ordinance specifies a total height of not more than 25 feet. The specifications also indicate a compliant building mounted light fixture. The lighting plan should be updated to also specify the locations of the parking lot and building mounted lighting. Photometrics. The lighting plan is in compliance with zoning requirements for lighting intensity. The light intensity is required to be Tess than one foot candle at the centerline of adjacent streets and 0.4 foot candles at the property line. Hours. Outdoor lighting for parking lots shall be turned off one hour after closing, except for approved security lighting. Landscaping. The submitted plans indicate plantings at the front of the building, and surrounding the parking lot and drive aisles. The City Arborist has provided a report on the landscaping as attached to this report. The final landscape plan is subject to the review and approval of the City Arborist. The plans also include a tree inventory and identify the trees to be removed along the south side of the lot. The trees at the southerly most portion of the lot will be preserved. This will provide a screen to the properties to the south. The landscape area along the east property line will abut the existing parking lot of the former used vehicle lot. The elevations of the parking lot and landscape area have been matched. As indicated, the applicant will install a 10 foot grassed area on the adjacent site as a transition to the parking lot. Mechanical Screening. The applicants have indicated that there will be no exterior mechanical equipment. 4 Signage. Freestanding Sign. The Zoning Ordinance allows for one freestanding sign not exceeding 20 feet in height and 100 square feet in sign area. The plans indicate that the existing freestanding sign will be enclosed to appear as a monument sign. The sign is 14 feet in height and the message portion of the sign is 24 square feet. The Planning Commission should comment on the design of the sign. It should incorporate other materials to tie in with the building such as the concrete masonry units. The base of the sign has been landscaped. Wall Signage. The Zoning Ordinance allows for a total of two wall signs, each on separate facades. The proposed sign plan indicates two wall signs, one on the front facade facing 60 Street and the other facing east. Total Allowable Signage. The total square footage of signage shall not exceed 300 square feet for the site. The wall sign facing 60 Street is 61 square feet and the other facing east is 137 square feet. The total signage proposed for the site, including the monument sign is 222 square feet. Sign Illumination. The wall signs and the monument sign are to be internally lit. The sign plans do not provide sign lighting details. The sign lighting should be designed such that only the text and logo portions of the signs are to be lit at night. The sign background will need to be dark. Staff will approve the lighting specifications for the signs at the time of permitting. Design Guidelines. Sustainable Guidelines. The Planning Commission will ask the applicant on how the project has been designed to achieve at least a certain degree of sustainability. The applicant will need to discuss the methods in building construction and site design with the Planning Commission of how these issues have been addressed. Architectural Guidelines. Facade Treatments The building will have a definite base, middle and top on the front and side facades. Ground Level Expression This is a one story building with a raised parapet feature at the center of the front facade. The main entrance is defined by an awning. The Planning Commission should comment if the ground level expression is adequately addressed. 5 Transparency The building uses glass on all of the facades. The Design Guidelines requires at least a 20 percent transparency on ground floor, street facing facades. The facade facing 60 Street is approximately 60 percent transparent. The front of the side facade facing Olene Avenue has a transparency over 20 percent but the entire facade does not. The Planning Commission should discuss this. Entries The building features an entry on the east facade with a canopy. The Planning Commission should comment on the location of the entry door and the lack of architectural features to distinguish this as the main entrance. Roof Design The roofline is broken at the front by a raised parapet feature. There is no decorative or defining cornice on the building. There will be no rooftop mechanical equipment on the building. The Planning Commission should comment. Building Colors The Design Guidelines indicate that building materials should accent, blend with, or complement the surroundings. Warm toned colors are encouraged. The building colors selected are a gray and blue. Exhibit 18 shows an example of a Tire Proz with dark brown and cream colors. The Planning Commission should comment. Building Materials and Colors The applicant has provided elevations with the building materials identified and color elevations for review. The front facade will be glass, CMU's and a stucco finished metal wall panel. The Planning Commission should comment on the acceptability of these materials. The side and rear walls will be primarily a textured metal wall panel. The Planning Commission should comment on the acceptability of this building material. Building material samples will be available at the Planning Commission meeting. Franchise Architecture The building is a franchise design. The building is utilitarian in design and is not in keeping with recent buildings that have been constructed in the City. The Planning Commission should discuss whether the franchise design is compatible with the Design Guidelines. 6 Site Design Guidelines Building Placement The proposed building has an entrance facing the access driveway. The building is set back to allow for landscaping. Parking Areas The parking area is landscaped with perimeter plantings and rain gardens. Storm water Storm water will be addressed in the City Engineer's report. Pedestrian and Common Space Currently, there is no trail along 60 Street at this location. The trail issue is discussed below. Landscaping Building entrance plantings are required and are provided at the main entrance to the building. Trees /Shrubs The trees and shrubs used in the landscape plan shall be subject to the review and approval of the City Arborist. The Arborist has indicated that the plan is well designed with a good variety of plant materials. Fencing No fencing is proposed. Utilites /Service /Loading /Drive - Through /Storage Areas Addressed elsewhere in the planning report. Lighting Addressed elsewhere in the planning report. Signage Addressed elsewhere in the planning report. Pedestrian/ Bicycle Routes The Comprehensive Park and Trail Plan includes a trail location along the south side of 60 Street. There are no trail connections on either side of this property at this time. The applicant shall develop a plan for the trail location, provide the City a trail easement and agree to build the trail at a later date when required by the City. 7 The plans should also include a connection from a future trail to the front entrance of the building. A bike rack will need to be provided near the front entrance of the building. Conditional Use Permit Review Criteria. Auto Repair -Minor and Tire and Battery Stores. The CUP criteria, found in Section 401.30.E.3. for review are found as follows with staff comments: a. Regardless of whether the dispensing, sale of offering for sale of motor fuels and /or oil is incidental to the conduct of the use or business, the standards and requirements imposed by this Ordinance for motor fuel stations shall apply. These standards and requirements are, however, in addition to other requirements which are imposed for other uses of the property. Comment: The project will comply with these standards. b. The architectural appearance and functional plan of the building and site shall not be so dissimilar to the existing buildings or area as to cause impairment in property values or constitute a blighting influence within a reasonable distance of the lot. Comment: The Design Guideline review of the building and site is included in this report. c. The entire site other than that taken up by a building, structure or plantings shall be surfaced with a material to control dust and drainage which is subject to the approval of the City Engineer. Comment: The entire site will be hardcover, landscaped or left as existing tree cover. d. A minimum lot area of twenty thousand (20, 000) square feet and minimum lot widths of one hundred fifty (150) feet. Comment: The property is 1.31 acres in size and the lot width is over 200 feet. e. A drainage system subject to the approval of the City Engineer shall be installed. Comment: The drainage system will be subject to review and approval of the City Engineer and Middle St Croix Watershed District f. A curb not less than six (6) inches above grade shall separate the public sidewalk from motor vehicle service areas. Comment: Curb and gutter will be installed. 8 g. The lighting shall be accomplished in such a way as to have no direct source of light visible from adjacent land in residential use or from the public right -ofway and shall be in compliance with Section 401.15.8.7. of this Ordinance. Comment: The lighting will be required to be installed to City full cut off standards and all other lighting standards. h. Wherever fuel pumps are to be installed, pump islands shall be installed. Comment: Not Applicable. i. At the boundaries of a residential district, a strip of not less than five (5) feet shall be landscaped and screened in compliance with Section 401.15.E. of this Ordinance. Comment: The setback at the rear of the site is at least 20 feet. Much of the existing tree cover will remain in this area. j. Parking or car magazine storage space shall be screened from view of abutting residential districts in compliance with Section 401.15.E. of this Ordinance. Comment: The nearby residential areas will be provided with adequate screening. k. Vehicular access points shall create a minimum of conflict with through traffic movement, shall comply with Section 401.15.F. of this Ordinance and shall be subject to the approval of the City Engineer. Comment: The access points have been approved by the City Engineer. 1. All signing and informational or visual communication devices shall be minimized and shall be in compliance with Section 401.15. G. of this Ordinance. Comment: All signage shall be constructed and lit in conformance with the Zoning Ordinance. m. Provisions are made to control and reduce noise. Comment: The service doors to the building shall be closed at all times except when vehicles are moved in and out of the service bays. n. No outside storage except as allowed in compliance with Section 401.30.E.5 of this Ordinance. Comment: A CUP has been requested for the outdoor storage area. 9 o. Sale or products other than those specifically mentioned in this subdivision be subject to a conditional use permit and be in compliance with Section 401.30.E.6 of this Ordinance. Comment: No additional CUP's for sale of products shall be required. p. All conditions pertaining to a specific site are subject to change when the Council, upon investigation in relation to a formal request, finds that the general welfare and public betterment can be served as well or better by modifying the conditions. Comment: The Planning Commission and City Council should comment. q. The provisions of Section 401.03.A.8 of this Ordinance are considered and satisfactorily met. Comment: The criteria have been reviewed and the proposal has been found to be compliant. r. The City may allow a motor fuel pump canopy to encroach ten (10) feet into a required setback provided the canopy support structure does not encroach on the setback and the setback encroachment will not result in an obstruction of traffic visibility. Comment: Not Applicable. Open and Outdoor Storage. The CUP criteria, found in Section 401.30.E.5. for review are found as follows with staff comments: a. The area is fenced and screened from view of neighboring residential uses or if abutting a residential district in compliance with Section 401.15.E. of this Ordinance. Comment: The plans indicate the location and specifications for the tire storage area. The tires will be required to be completely stored within the designated area. No tires shall be allowed outside of the storage area or placed above the height of the storage enclosure. b. Storage is screened from view from public right -of -way in compliance with Section 401.15.E. of this Ordinance. Comment: The tires will be completely contained within the storage area. c. Storage area is grassed or surfaced to control dust. Comment: The base surface of the storage area would need to be paved or have a gravel surface. 10 d. All lighting shall be hooded and so directed that the light source shall not be visible from the public right -of -way or from neighboring residences and shall be in compliance with Section 401.15.8.7 of this Ordinance. Comment: The site lighting will be required to be compliant with the standards within the Zoning Ordinance. e. The provisions of Section 401.03.A.8 of this Ordinance are considered and satisfactorily met. Comment: The criteria have been reviewed and the proposal has been found to be compliant. CONCLUSION / RECOMMENDATION Upon review of the requests for Conditional Use Permits, Site Plan and Design Guidelines Review, City Staff would recommend the project with the conditions as follows: 1. The applicant shall provide an executed copy of the boundary development agreement prior to issuance of the building permit. 2. The applicant has the option of plating the property as a one lot subdivision and pay park dedication at this time, or to leave it in the current description. If left in a meets and bounds description, ten foot utility and drainage easements along all lot lines shall be provided to the City. The easement shall be recorded on the property subject to review and approval of the City Attorney and City Engineer. 3. The access points are subject to review and approval of the City Engineer and permitting by the Minnesota Department of Transportation if required. 4. The grading, drainage and utility plans shall be subject to the review and approval of the City Engineer. The drainage plans shall be subject to the review of the Middle St. Croix Watershed District. 5. All lighting fixtures shall be full cut off and installed in compliance with the lighting standards of the Zoning Ordinance. TireProz are proposing to purchase the property at 14447 60 Street and relocate their business to that address. The proposed project includes removing the existing building, bituminous and west driveway; constructing a new building, along with a new tire enclosure, trash enclosure, bituminous parking lot/driveways, curbing, rain gardens and landscaping, per all local and state codes and regulations. The landscape plan has been changed to reflect the comments in my review of 8/26/11. Additional plants added are acceptable and should enhance the plan. A list of appropriate rain garden plants has been added. A tree inventory has been completed and added to the plan. I will need to do a site visit to verify the tree inventory and make a calculation regarding possible tree replacement requirement.
