Wolff (1944 -1996) *Qualified Neutral Arbitrator * C'ertified Real 1,.state Spmalist �Quahfied Neutral Mediator Pursuant to the requirements of counsel and ordinance imposed relative to this development, this office will not approve the Development Contract for execution by the City until the following is performed: 1. Proof of ownership is provided, listing all fee owners and encumbering parties. We note that the sane is required for perfection of the plat. 2. Developer will have to produce, a hard shell plat, again with signatures by all fee owners and encumbering parties, also demonstrating proper drainage and utility easements. 3. As the preliminary draft of the plat has been forwarded with no indication as to cross easements thereon, I assume that there will be a separate easement with regard to cross easements for access and traffic circulation. This office will not approve the plat nor the Development Contract for execution until those cross easements have been presented and approved by this office, and recording is secured in conjunction with the plat recording of those cross easements. 4. The developers must produce a letter of credit or performance bond in the amount of $47,700.00 to secure the Plan "A" improvements. Mr. Eric Johnson January 8, 2004 Page 2 5. Connection charges must have been provided by the developers in the amount of $5,770.95 for sanitary sewer, $10,045.00 for municipal water, and $12,720.25 for storm sewer. 6. That the exhibits as identified within the Development Agreement have been secured and approved by City staff for appendage and exhibit status to the Development Contract. They are, of course, as follows: Exhibit "A" a Legal description or final plat; Exhibit "B" - Final landscaping plan; Exhibit "C" - Final site plan; Exhibit "D" W Final building color and design plan.
