The original Cross Easement Agreement between STD Properties, LLC, a Nevada limited liability company, and L &L Holdings, LLC, a Minnesota limited liability company. 4. Enclosed are four (4) originals of the City's Development Contract. Pursuant to your letter of commitment to the City of Oak Park Heights, as directed to this office in your correspondence of January 14, 2004, these documents are being provided to you based on your assurance that all documents will be properly executed and the recordings will occur 1 ' in the manner set forth within your correspondence of January 14 Mr. Jeff Christian January 15, 2004 Page 2 Not withstanding that recording, please understand and convey to STD Properties and L &L Moldings, LLC, as well as JTB Properties, LLP, that no building, grading or other permits shall be issued by the City of Oak Park Heights relative to this project until and unless a signed and fully executed Development Contract is returned to the City's offices, the letter of credit and securities as required under the terms of that Development Contract, and all payments referenced within the terms of the Development Contract are tendered to the City and the Planned Unit Development Permit is signed and returned to the city (copy attached). There must also be confirmation from your office that the recordings have occurred in the manner identified in your January 14 correspondence. Please also provide our offices with the recording data from the Development agreement or an attested copy upon recording. We are providing four (4) copies of the Development Contract so that both STD Properties and L &L Holdings, LLC, can retain an original for their records. The third original will be retained by your office as part of the recording obligations that you have undertaken in this matter, with the fourth original being returned to the City of Oak Park Heights. If for any reason all of the documents as referenced within your January 14, 2003 correspondence are not fully or properly executed or are not recordable for any reason, y ou are to contact this office immediately, and advise nee of that condition9 do not proceed to record until such time as any defects or deficiency have been corrected. directly.
