Your correspondence and accompan materials of Januar 23 ), 2004 have been
referred to this office for commentar relative to this project.
1. I note that y ou enclosed a check in the amount of $14,268. O, '.'re the
connection fees." The Development Contract specified that connection fees for this project is in the
amount of $28, 536.20. Notwithstandin that the Cit has checked its past records and determined
that connection fees on this land had been previousl paid. Therefore the check will be returned to
you.

2. The Planned Unit Development Permit, altered on page 1 to correct the
proper initials for SDT, was sent in. Unfortunately, there were also alterations at page 3 as to item 6,
referencing, "see attached," and on page 4 at item 6, again with initials. I am unsure as to what the
nature of the proposed amendment, if any, may be, other than that I suspect that the two items
referenced by initialing relate to common or sane conditions. If it was merely to note the duplicity
of the two, that would be understood. If there was, however, some other intent or meaning relative
to that initialing, we need to know same immediately.
