Drive Place Stillwater, MN 55082 Re: KFC /A &W —Taco John's /Steak Escape (Oak Park Marketplace) Letter of Credit Reduction Request BRA File No. 55 -04 -000 Dear Mr. Galland: It is our understanding you have informed the City of Oak Park Heights that all outstanding punch list items have been completed for the above-referenced project, and you are requesting the the existing $8,400 Letter of Credit be released. This existing Letter of Credit is for punch list items including erosion control (silt fencing and rip rap) and pond protection and repair. I reviewed the site on Friday, December 10, 2004. The silt fencing around the pond has been repaired and vegetation immediately west of the parking area partially established. However, erosion is still occurring on the site from several sources. 1. A significant washout exists in the northeast comer of the pond. The .restored silt fence was basically installed over the top of this washout, with no earthwork repair being per-formed. This washout needs to be repaired, and the corresponding sediment cleaned from the rip rap , 2. The bituminous trail along the north side of the pond. was cut into the side of the (existing northerly pond) slope and has an approximately V high exposed dirt embankment along the edge of the trail. The slope of this embankment is too steep as currently constructed, and is resulting in sediment washing over the trail into the pond area. This area needs to be better stabilized by either- creating a flatter slope and blending it into the existing slope and revegetating, or by installing a small retaining wall. 3. The boulevard areas where the KFC /A &W drive -thru lane meets the parking area are not completely established, and a pile of dirt also exists at this location.
