Dear Mr. Howard:
In response to a complaint on the condition of the residence referenced above, I
conducted a site investigation and found the following violation to the City's
Zoning Ordinance:
Ord. 1109.03 H - -- All noxious weeds shall not exceed a height more than six (6)
inches is in violation to the Code. The grasses on your property are greater than
(12) inches in height and are required to be cut to a length in compliance with the
ordinance and shall be maintained as such.
You are required to address the issue above to comply with the requirements of
the City's Zoning Ordinance within ten (10) days of the date of this letter and you
are to keep the property free from the re- occurrence of this nuisance for 160
days. If the nuisance is not abated ten days from the date of this letter, which is
October 2, 2011, the City shall have a sub - contractor enter the property to abate
the nuisance. The City shall assess the property for staff, contractor,
administration time, and all materials used to abate the nuisance. Should this

nuisance re -occur the City shall have no alternative other than to abate the
nuisance, for which you will be responsible for all associated costs.
In addition, I found and deemed the deck structure in the rear of this dwelling to
be structurally unsafe and a hazard to public safety. The structure's center post
for the beam supporting the deck is lying on the ground. The end footing and
post support by the stair structure has settled and separated from the beam by
about five inches. At this point it appears that the supporting post for the stair
structure may be all that is supporting that end of the deck.
I have posted three unsafe structure notices on the deck structure and also ran
police caution tape around the structure. An additional notice was posted on the
side window of the front entrance. This structure shall immediately secured from
the porch to stop access to this structure until such time that the structure has
been repaired, is inspected by the City's Building Inspection Department, and
approval granted by the Inspector that the structure is safe and compliant with
the Minnesota State Building Code adopted by the City. Please note that a
Building Permit is required for these repairs and the Contractor must be licensed
by the City or State.
