BACKGROUND
Tim Nolde, representing Oakgreen Commons, has made a request to allow the
architecturaVresidential style lighting that was installed at the Oakgreen Commons
Senior Living Facility located at 13936 Lower 59 Street North. The lighting consists of
six large carnage style lights at the front entrance and smaller residential scale Tights on
each of the residential unit decks.
The general plan approval for the Oakgreen Commons project was recommended by
the Planning Commission on May 14, 2009 and approved by the City Council on June
9, 2009.
The review is based upon the following submittals:

ISSUES ANALYSIS
Section 401.15.B.7.f.2) of the Zoning Ordinance specifies the requirements for lighting
within commercial districts. The property is zoned B-4 Limited Business District. It
indicates that all light fixtures shall be fully cut off and shielded at an angle of 90
degrees or less. Subsection c) of that Section provides for exceptions as follows:
Section 401.15.B.7.f.2.
c) Exceptions. Architectura!historical light fixtures that feature globes that are not
shielded or lighting of entire facades or architectural features of a building shall be
approved by the City Council. In no case shall the light affect adjacent property in
excess of the maximum intensity defined in Section 401.15.13.7.d.
The light fixtures are of a low intensity that will not produce excessive glare or change
the photometric plan that was approved as part of this project. The fixtures are of a
residential style that is consistent with the use of the building and the character of the
architecture.
The City Council approved a very similar request from Boutwells Landing a number of
years ago to allow residential style, non shielded lighting on some of their buildings.
CONCLUSION / RECOMMENDATION
City Staff recommends the City Council approve the Oakgreen Commons architectural
lighting as installed on the building. A resolution had been provided and is attached.
The recommendation is provided with the following conditions:
1. The bulbs to be used in the fixtures are not to exceed manufacturer's
specifications.
2. All other fixtures on site, not subject to this exception, shall be compliant with
the PUD approvals and the Development Agreement.

Dear Council,
On behalf of Oakgreen Commons, LLC; I am requesting your consideration in allowing
Architectural / Residential style lighting at the Oakgreen Commons Senior Living Facility
located at 13936 Lower 59 Street N. The lighting has already been installed and is appropriate
to the residential nature of the building.
I request that this consideration be based upon Section 401.15.B.7.f.2.c of the Zoning Ordinance
• that allows exceptions to the full cut off standards within the B-4 Limited Business District. I
would like to request that this be placed on an upcoming City Council agenda for consideration.
