Enclosed you will find four (4) copies of the issued Conditional Use Permit that allows permits
the Tire Proz new facility to be ultimately constructed in the City. These documents inust be
signed, by both the APPLICANT and LANDOWNER and returned to the City in order for the
permit to become valid. Once fully executed you may then commence with discussions with the
City's building official for final construction permits.
Please note, do not alter these documents nor remove any staples as this will invalidate such
documents. Please execute each copy. and send all four copies back to my office as soon as
possible. One will be recorded, one will be retained for City files and two will be returned to you
once executed by the City.

Permitted uses set forth in Ordinance 401 Section 401.30
The subject property requires a conditional use permit to allow a tire and service store in the B -2
General Business District, a, conditional use permit for the outdoor storage of tires, site plan and Design
Guidelines review;
1. Conditional Use Permits: As requested by the applicant the City has been granted the issuance
of a Conditional Use Permits subject to the following conditions:
1. The applicant shall provide an executed copy of the boundary development agreement
prior to issuance of the building permit.
2. Ten (10) foot utility and drainage easements along all lot lines shall be provided to the
City. The easement shall be recorded on the property subject to review and approval of
the City Attorney and City Engineer.
3. The access points are subject to review and approval of the City Engineer and permitting
by the Minnesota Department of Transportation•if required.
4. The grading, drainage and utility plans shall be subject to the review and approval of the
City Engineer. The drainage plans shall be subject to the review of the Middle St. Croix
Watershed District.
5. All lighting fixtures shall be full cut off and installed in compliance with the lighting
standards of the Zoning Ordinance. All lighting fixtures on the building shall be installed
in the locations shown on approved plans. Any changes shall be subject to review and
approval of City Staff.
6. The outdoor lighting shall be turned off one hour after closing, except for approved
security lighting, however all lighting shall be full cut -off design and wholly consistent
with the City ordinances.
7. The applicants provide elevation drawings and/or photographs to show how the back of
the building (west facing) and site will appear from Olene Avenue and from 60 Street
when traveling eastbound.
8. The landscape plan shall be revised to incorporate some large evergreen plantings on site
to provide visible vegetation during winter months, to also address the view of the back
of the building from Olene Avenue and the view from 60 Street when traveling
eastbound. The landscape plan must also incorporate a three (3) foot high planter around
the base of the freestanding sign. The landscape and tree removal /replacement plans are
subject to review and approval of the City Arborist.
9. The freestanding sign adjacent to 60 Street does not exceed 20 feet in height or 24
square feet per face as shown on approved plans. Only the sign letters may be
illuminated, not the background portion of the sign faces. All signage shall be subject to
final review and approval of City Staff for conformance with Zoning Ordinance
standards.
10. As indicated by the applicants, no mechanical equipment is to be located on the exterior
or roof of the building. lf, in the future, exterior mechanical equipment becomes
necessary, it shall be screened from street level view and from neighboring properties
with materials that blend harmoniously with the building facade materials.
11. The applicants shall give consideration to adding architectural trim details to the building,
particularly at the roof line.
12. All auto repair activities shall be conducted indoors and the overhead doors to service
bays shall be kept closed at all times except when moving vehicles in and out.
13. The City Council intends to construct an eight foot bituminous trail on the south side of
60 Street North adjacent to Tire Proz. Tire Proz agrees to a special assessment for this
improvement and does hereby waive all rights they have by Minnesota State Statutes
429.081 or otherwise challenge the amount or validity of the assessments or procedures

used by the City in levying the assessments.
14. The applicant shall provide a plan with a location of the trail and a trail easement, with a
connection from the trail to the front entrance of the building, subject to review and
approval of the City Engineer and City Attorney.
15. A bike rack shall be provided near the front entrance of the building.
16. The used tires will be required to be completely stored within the designated outdoor
storage area. No tires shall be allowed outside of the storage area or placed above the
height of the storage enclosure. The base of the storage area shall be paved or provided
a gravel surface.

17. Any new tire racks located outside shall be kept near the building and moved inside when
the store is closed.
18. The applicant shall accept oil for recycling and receive and retain, if required, a
Hazardous Waste Generators License for batteries, oil and tires from Washington
County.
All uses shall be subject to the following conditions and/or restrictions imposed by the June 22, 2010 .
Resolution of the City Council of the City of Oak Park Heights as follows:

amended by the City Council are annexed hereto by reference.
b. Report from the Minnesota Department of Transportation September 24, 2010
1V. Abandonment: This permit requires continuous use in order to preserve the Conditional Use granted
by the City under the terms hereof. Any discontinuation or abandonment of the uses permitted
hereunder upon the site for a period of 12 continuous months shall constitute abandonment and void
the permit.
V. • Annual review: Annual review is not imposed as a condition of this permit.

BACKGROUND
Jay and Deborah Andrews have made application to construct a Tire Proz at 14447 60 Street
North. The property is west of the Super America at the corner of Olene Avenue North and
60 Street. The application consists of requests for a conditional use permit to allow a tire and
service store in the B-2 General Business District, a conditional use permit for outdoor storage
and site plan/Design Guidelines review. The property has previously been a vehicle sales lot
and the building on the site will be removed as part of this proposed development.
The site is 1.31 acres and the building is approximately 6,800 square feet in size. Tire Proz
would vacate their current location at 14661 60 Street North.

Project Narrative
"TireProz & Wheel Experts currently operate an existing business, in the building they
lease at 14661 60th St. N. TireProz are proposing to purchase the property at 14447 60
Street and relocate their business to that address. The proposed project includes removing
the existing building, bituminous and west driveway; constructing a new building, along
with a new tire enclosure, trash enclosure, bituminous parking lot /driveways, curbing,
rain gardens and landscaping, per all local and state codes and regulations.
The new building will be 6,800 sf in size and includes an exterior of glass stucco (ElF` )

The Minnesota Department of Transportation (Mn /DOT) has reviewed the above referenced site,
plan. Before any further development, please address the following issues:
As part of the St. Croix River Crossing project, Mu /DOT plans to widen the frontage road and
c stt:.uck.a4idsxspjk. The current letting for the St. Croix River Crossing Project is fall 0120133
The current shoulder along the property will be moved southward approximately 14' towards the
proposed development. When the frontage road for the St. Croix River Crossing Project is being
reconstructed the proposed signs, driveway, and fence for the future facility will be affected if
built as the plan indicates. These items should be relocated now by the developer to reduce the
impacts in the future, during the construction of the St. Croix River Crossing Project.
Ma/DOT recommends that the proposed exit -only bypass and through lanes be reconfigured to
provide maximum separation between the driveway and the east property line. The design of the
driveways should be consistent with the St. Croix River Crossing Project.
Additional details of the St. Croix River Crossing Project can be found at

for the project so refinements to the layout in this area are on- going. Please provide an as -built

A Mn/DOT drainage permit is required to ensure that current drainage rates to Mn/DOT right-of-
way will not he increased. The drainage permit application, including the information below,
should be submitted to:

The following information must be submitted with the drainage permit application:
1) A grading plan showing existing and proposed contonts,
2) Drainage area maps for the proposed project showing existing and proposed drainage areas.
Any off-site areas that drain to the project area should also be included in the drainage area
maps. The direction of flow for each drainage area must be indicated by arrows.
3) Drainage computations for pre and post construction conditions during the 2, 0, 50 and WO
year rain events, and
4) An electronic copy of any computer modeling used for The drainage computations.
5) Copy of the carom plan set that includes pond grading and drainage details.
