Box 2007 • Oak Park Heights, MN 55082 -2007 • Phone: 651/439 -4439 • Fax: 651/439 -0574 October 7, 2011 Mr. Tim Nolde 775 Green Twig Way Stillwater, MN 55082 Ref: Oakgreen Commons Site Dear Tim, Below is a list of items regarding your development site that need to be address and resolved / corrected by not later than Friday, October 14, 2001. • 1) The power lines going over Oakgreen Ave. N. need to go underground or the City needs a letter from you confirming that you shall complete this with the reconstruction of Oakgreen Ave. N. Please see attached letter dated 4/12/2011. 2) Pallets and retaining wall blocks on west end of Lower 59 St. N. are to be removed. 3) Concrete debris on the North side of Lower 58 behind the Triplex to be removed. 4) Siding of the triplex is not acceptable and the siding needs to be painted or replaced with siding to match the building. Extra siding lying on the ground needs to be stored indoors or in a garage. 5) There are two green colored street lights in the area between Upper 58 & Lower 59 that need to be removed or set in the proper location along the roadway. 6) There is a pile of concrete across the road from the triplex that needs to be removed. 7) On the North side of Upper 58 there is a pile of mulch, pallets, and two fire hydrants that need to be removed. 8) On the South side of Upper 58 there is a pile of miscellaneous debris that needs to be removed, a pile of large stones that needs to be removed or incorporated into your landscape design of the area. 9) The following equipment needs to be removed from the site: two street sweepers, Ford pickup with plow, horse trailer, water pump trailer, and miscellaneous attachments for a bobcat. 10) There are two driveways from the old dwellings that were located on Oakgreen Ave. N., of which the culverts and drives are to be removed and the ditch formed to a natural state. 11) All of the areas that have been stripped of vegetation are to be seeded. Craig has stated that the mixture of rye and blues grass will appear within five days after a rain. The City will give it ten days or the area will have to be covered with an erosion mat to prevent erosion and control the dust. Instead, all of these facilities are to be installed underground pursuant to City Ord.1008.030 / .040. (enclosed). At this time you make take one of two actions: 1. Reinstall these lines so that all elements are underground from the power distribution lines currently running north -south along the east side of Oakgreen Ave. 2. Commit to the City, via a letter bearing your signature as the developer, that these lines will be replaced and reinstalled at your expense to an underground location when the City undertakes a major rehabilitation or expansion of Oakgreen Ave. These dates are unknown but may be precipitated by a St. Croix River crossing project possibly slated for 2013.
