AGREEMENT AND SWORN STATEMENT
The work for which this permit is issued shall be
performed according to : (1) the conditions of this
permit; (2) the approval plans and specifications; (3) the
applicable city approvals, Ordinances, and Codes; and
(4) the State Building Code. This permit is for only the
work described, and does not grant permission for
additional or related work which requires separate
permits. This permit will expire and become null and
void if work is not started within 180 days, or if work
is suspended or abandoned for a period of 180 days any
time after work has commenced. The applicant is
responsible for assuring all required inspections are
requested in conformance with the Minnesota State Building
Code.
SEPARATE PERMITS REQUIRED FOR WORK OTHER THAN DESCRIBED ABOVE.

Special Conditions For Montanari Homes
Excavation, Foundation, and Basement Wall Building Permit
Special Circumstances:
These special conditions are imposed on the Montanari Homes Office Building
construction site due the excavation having been started prior to the conditions of
the Conditional Use permit being met, prior to a building permit being issued, and
without required permits from the Browns Creek Watershed District and MNDOT.
Normally, a "Stop Work Order" would be issued for work that is started without a
building permit. In this special case the City will be better served by allowing the
permittee to continue with the construction of foundations and basement walls, the
back filling of the excavation ant the removal of the excess material from the site.
Limits of the Permit:
This permit allows the permittee to perform the following:
1. Construct foundations
2. Construct basement walls
3. Backfill the excavation against the basement walls.
4. Remove excess material from site
5. Establish and maintain erosion control measures
6. Repair Eagles Club sewer line damaged by construction activity
Prohibited Activities:
All activities other than those needed to accomplish the six items above are
prohibited until all conditions of the Conditional Use permit are met and a building
permit is issued by the City Building Official. Specific prohibited activities include but
are not limited to:
1. Staging of materials on site for future construction,
2. Any work within the MNDOT right of way,
3. Any plumbing or utility work,
4. Any storm water system construction,
Permittee Risk:
All work under this permit is at the risk of the permittee. If requirements of any other
governmental agency with jurisdiction over this project requires changes to the
foundation or basement walls of the building, all costs associated with the required
changes SHALL BE at the expense of the permittee.

Erosion Control and Removal of Water from the Excavation:
The pemiittee shall make daily inspections of the stockpile and immediately clean
any erosion residue moving onto the Eagles Club or McCormick Fumiture
properties. Roadways are to be maintained clean on a daily basis.
Water pumped from the excavation will be filtered of sediment with a filter device
equal to the Dirt Bag® or with an appropriate method described in Minnesota
Pollution Control Agency Publication, "PROTECTING WATER QUALITY
IN URBAN AREAS, Best Management Practices for Dealing with Storm Water
Runoff from Urban, Suburban and Developing Areas of Minnesota."
Conditional Use Permit Conditions:
Prior to issuing the permit for the construction of the building all conditions within
the attached Conditional Use Permit must be met. Specific conditions that are in
question are the following conditions from Section II Additional Restrictions and
Provisions:
"A.3. To accommodate the proposed access change, written approval from the
Eagles Club and an access permit from MNDOT be obtained.
The changes proposed will separate the Eagles Club driveway from the
shared driveway and reduces the width of the Eagles Club driveway. All of
these changes are done mostly within the MNDOT right of way. As of 6/6/03
written approval from the Eagles Club had not been received and the
MNDOT Access had been applied for. The Eagles Club approval and
MNDOT Access Permit must be received prior to any additional building
permits being issued.
"A.5. The landscape plan is subject to review and approval of the City Arborist."
The changes to site plan to include underground parking also caused the
landscape plan to change. We are contacting the City Arborist in insure that
the required changes have been made to the Landscape plan.
"A.6. The applicant verify the utility locations and address any utility service issues
for the Eagles Club."
It appears that the sewer line for the Eagles Club is located within the utility
easement between the Eagles Club and the Montanari property. There is a
sewer clean out a foot or two inside the Montanan property that is believed to
be from the Eagles Club. It has been damaged by the excavation and must
be fixed. Montanari Homes will need to determine how to best maintain the
sewer services for the Eagles Club. The property line sewer catch basin in
the valley gutter will be over the top of the sewer service line. The sewer
service line will need to be insulated at this location to prevent it from

freezing during the winter. Relocation of the sewer line onto the Eagles Club
property is another option that should be considered by Montanari Homes.
"A.9. The City Engineer and appropriate watershed district authority provide
comments and recommendation in regard to grading and drainage issues and the
applicant shall comply therewith."
The City Engineer has requested that Montanari Homes show how the water
from the valley gutter curb on the east property line will move from the gutter
curb to the storm water system. See A.14. below.
Application to the Browns Creek Watershed District is required for any site
disturbing 5,000 square feet of soil or more. Montanari Homes must receive
a permit from the Brown Creek Watershed District.
"A.11. The applicant obtain a MnDOT storm water permit."
Montanari Homes has applied for but has not received the storm water
permit from MnDOT.
"A.14. Curbing be provided at the perimeter of all off - street parking areas.
Recognizing that the drive aisle along the easterly property line abuts the Eagle's
Club parking lot, a "valley" curb shall be provided in such location."
The latest preliminary Grading, Drainage and Erosion Control Plan from
Plowe Engineering has the "valley" curb transitioning to a 6 inch high barrier
curb at the location of the catch basin on the east property line. This catch
basin needs to be changed to an appropriately designed Concave gutter inlet
style of catch basin and inlet. Also the plans indicate that the storm water at
the north end of the valley curb will flow out to the MnDOT frontage road into
the their catch basin. MnDot approval and our City Engineer approval for this
flow will be necessary. Mary Lacho is the MnDOT contact for storm water
(mary.lacho @dot.state.mn.us). Our City Engineer requires that the storm
water be redirected to the ditch (or install a catch basin - "V" grate - in the
northeast corner of the parking lot to catch water prior to exiting to the
driveway. It can be connected to the other proposed catch basin on the
north end of the parking lot with a short run of storm sewer.)
"A.16. neighboring properties shall not have to bear the cost of rerouting utilites
resulting from this development. All such cost shall be born by the applicant."
At the present time there are no utility relocations shown on the design.
However, as mentioned above the Eagles Club sewer line may be located on
Montanari Homes property and could be subject to relocation.

Other Agency Permits:
All conditions of the Conditional Use Permit must be met. Since some of the
conditions require permits from other government agencies the requirements of
their permits must be met.
Request From Other Agencies for Stop Work Order:
Request from other governmental agencies for a Stop Work Order for violations of
their rules or permit conditions will be considered by the City.
Stop Work Order:
The City shall issue a Stop Work Order for this project if the permittee is found to be
in violation of the terms of this permit and its special conditions or found in violation
of applicable local, state or federal laws.
