Present: Councilmernbers Abrahamson, Doerr, McComber and Swenson. Staff present: City Administrator Johnson, City Attorney Vierling, City Planner Richards and City l"ngineer Erickson. Absent: None. Department/Council_Liaison Reports: A. Planning Commission: City Planner Richards reported that the last meeting of the Planning Commission was August 9, 2007. At that meeting they had two public hearings: one on Nova Scotia Avenue and one on Bremer Bank. He reported that the Planning Commission had not planned to meet on September 13, 2007, but that there will be a Comprehensive Plan meeting on that date. B. Parks Commission: Councihnember McComber reported that the Parks Commission's last meeting was August 18, 2007. She reported that the next meeting of the Parks Commission is September 17, 2007. C. Cable Commission: Councilmernber Doerr reported that the next meeting of the Cable Commission is September 18, 2007, at 7:00 p.m. at the Access Center. Ile stated that they have hired two new temporary employees. Councihnenber Doerr reported that the first meeting for the task force started by the League of Minnesota Cities is Thursday, August 30. PI-esentation Jennifer Severson, Executive Director of the Greater Stillwater Chamber of Commerce provided information on the proposed Convention and Visitors Bureau and the proposed lodging tax to pay for the project. VIL Old Business: A. Jerden LLC -- Request for Comprehensive Plan Amendment Conditional Use Permit, Sign Variance, Subdivision Replatting, Vacation of Existing Utility and Drainage Easements and Site Plan/Design Guideline Review — Street and Memorial Ave.: City Planner Richards reviewed his August 24, 2007 memo regarding zoning;, easements, access, and the final plat. He stated that these issues previously came before the City Council at its meeting on July 24, 2007. City Planner Richards reported that the Planning Commission recommended the zoning be changed to B-2 for that area. He also stated that it has been brought rip that some amendri-ients could be made to the B- 3 zoning to address some of the concerns of the Denny Hecker group ort marketing their property. City Planner Richards stated that there are some easements that would need to be vacated on the old plat and that would have to be done by Page 7 of 64 City Council Meeting Minutes August 28, 2007 Page 3 of 6 public hearing. I -le stated that the applicant has not yet submitted a final plat. That would also need to be processed by final hearing. City Planner Richards reported that the Denny Hecker group has revised their access plan which is acceptable to the City E"ngineer. Fle stated that trails have been proposed along 58t" Street and Memorial Avenue which was reflected in the Resolution before the council. Mayor Beaudet, seconded by Councilmember Abrahamson, moved to amend number I I of the Resolution to designate bow many parking spaces are for sales and how many are for other parking. Carried 5-0. Mayor Beaudet questioned whether Morning Dove should remain as a public street. Kevin I.,aCosse, a representative of Denny I Iecker, stated that it is their position that it should be a public street. City Planner Richards stated that once the area is developed, Morning Dove will be straightened out and the utilities will need to be straightened out. Regarding the issue of rezoning the area, City Planner Richards questioned the city council on what would they allow in the area. Councilmember Swenson stated that he would not like to see auto repair type shops. Ile stated that he feels the market will dictate what businesses core to the area. Councilmember MCComber stated that she would like to see more variety in the area. She stated that she does not want to see an auto mall. City Planner Richards stated that B-3 does allow for multi - tenant auto set -vice centers as a conditional use which could include freestanding auto repair centers and oil change facilities. Mayor Beaudet, seconded by Councilmember Doerr, moved to an -end the Resolution to postpone the rezoning issue to the October meeting agenda with the provision that the applicant submit a letter extending the deadline, and that section should be removed fi-om the Resolution as drafted. Carried 5-0. The City Council approved the Resolution with amendments at the July 24, 2007 City Council meeting. City Administrator Johnson stated that the Resolution before the council on this date includes the amend►nents made at the July 24, 2007 City Council meeting. On the an -ended Resolution and including the amendments made on this date, roll call vote taken. Carried 5-0. Mayor Beaudet, seconded by Councilmember Abrahamson, moved to request staff schedule the final plat for the September Planning; Commission reeting and the vacation issue for the City Council's second meeting in September. Street lm rovements North of HiOY iway 36 Brekke Park Parking Lot Vallev View Entr and Parking Lot and Alleyway — Review and Award Bid: Public Works Director Ozzello reported that one bid was received for the street improvement project. He stated the bidder outlined the areas into a base area and some alternate areas. He stated that the repairs would need to be completed prior to the snow plow season. Ile reported that the repairs proposed by the contractor would be a temporary fix that will hold out until 2008. Mayor Beaudet, seconded by Councihnember Abrahamson, moved to allow up to $57,500 for patching base areas, alternate 1, and alternate 2. Alternate 1 would only go forward if an agreement could be reached with Stillwater. Carried 5-0. C. _Water Tower ##1 Update — Construction Commencement: Public Works Director Ozzello reported that because of the water tower rehabilitation project, the cast entrance to the City Hall parking lot would need to be closed. He reported that barricades will be placed at the entrance on September 4. Councilmember Abrahamson suggested that signs be placed at 56`x' and 57`x' Street warning motorists that the road will be closed ahead. Public Works Director Ozzello reported that a sign will be placed at the entrance informing motorists that it will be closed beginning September 4. D. Set Worksession to Discuss New Building: Councilmember Doerr, seconded by Counci]nre€nber Abrahamson, moved to set worksession for September 12, 2007 at 5:30 p.rn. Carried 5-0. VIII. New Business: A. Bremer Bank -- Planned Unit Development; General Plan Review; Site Plan Review and Variances for Si ynage w/ Drive Thru — Corner of 60`x' Street and Nova Scotia Ave: City Planner Richards reviewed his memo regarding the application by Bremer Bank. He reported that the Planning Commission recommended denial of Bremer Bank's request for a freestanding monument sign because of the limitation in the sign ordinance. Councihnember Swenson stated that the parking lot access is not wide enough to get large trucks in, such as emergency vehicles. He suggested the plan be modified. Eric Ryners, the architect for the Bremer Bank project, came forward and stated that they have widened the one way entry to 22 feet. He requested the truck dimensions of the fire truck so that they Page 9 of 64 City Council Meeting Minutes August 28, 2007 Page 5 of 6 can complete a radius study. Councilmember Swenson stated he will submit the dimensions to the City Administrator the next day. Mayor Beaudet stated that the City Engineer can review the issue. Eric Ryners stated that the Planning Commission recommended a sidewalk from the east side to the front door. I -Ie reported that the grade is too steep on the east to put a sidewalk in. He stated they would need to put four steps in, which could create a liability. He stated that they would be able to put a pedestrian connection on the north side of the site that would be level Councilmember Abrahamson suggested a pedestrian coinfection on the northeast corner of the site. The architect stated there may be grade problem there as well. Mayor Beaudet stated that the City Engineer can review sidewalk proposal and elevation issues for the north side of the property. Councilmember McComber, seconded by Councilmember Doerr, moved to approve the Resolution with the conditions set forth. Roll call vote taken. Carried 5-0. B. Approve Resolution Authorizing the Installation of Parking Restrictions on Oxboro Ave N.: Councilmejnber McComber, seconded by Councilmember Swenson, moved to approve the Resolution. Roll call vote taken. Carried 5-0. Councihnernber Swenson requested that staff send a letter to Washington County asking for common courtesy on not parking in the 6060 Oxboro and 6120 Oxboro apartment complex parking lots. C. Approve Resolution Authorizing the Installation of an All -Way Stop at the Intersection of 62"' Street N. and Oxboro Ave. N.: City Administrator Johnson reported that he has not seen an agreement from the City of Stillwater. Mayor Beaudet, seconded by Councilmember Doerr, moved to approve the Resolution. Roll call vote taken. Carried 5-0. Mayor Beaudet, seconded by Councilmember Abrahamson, moved to provide leeway to staff on the Resolution and working with Stillwater regarding the westbound and southbound intersections. Carried 5-0. D. Autumn Ifills Park Shelter --Ribbon Cutting 1 Dedication Event: Mayor Beaudet provided the councilnernbers with proposed wording for a dedication plaque. Councilmember Abrahamson thanked Mayor Beaudet for his offer to donate the plaque for the dedication event. Councilmember Abrahamson suggested that Parks Comrnissioners' names be added to the plaque. Councilmember Swenson suggested that only tlhe current mayor and councilnember names be included on the plaque. Because there have been numerous Parks Commissioners since the project Page 10 of 64 City Council Meeting Minutes August 28, 2007 Page 6 of 6 originated, Mayor- Beaudet suggested that the names of the Parks Commissioners since 2000 be included on the plaque. Discussion ensued about a possible date for the ribbon cutting and dedication. Councilmembers agreed that the dedication event should be scheduled for October 9, 2007 prior to the City Council meeting. Mayor Beaudet, seconded by Councilmember McComber, moved to approve the proposed text for the dedication plaque subject to final review and approval of the City Administrator using the names of the current mayor and council and up to 5 to 7 Parks Commissioners' names. Page 12 of 64 CNULUSURE -3 Oak Park Heights Request for Council Action Meeting Date September 11, 2007 Agenda Item Title WATER TOWER WORK ADDITION REQUEST Time Required 0 min Agenda Placement Originating Department/Requestor Public Works Dire Requester's Signature Action Requested: Authorize Change Order for deck and condensate drain in Water Tower 1 Background/Justification: We are in the process of rehabilitating tower 1. During inspection it was noted that the deck area immediately under the 250,000 gallon water bowl at the top of the tower was open at the sides. This walkway crosses immediately under the water bowl and is used to access the ladder that goes up a dry tube thru the water bowl to access the top of the tower. There is a railing along each edge of the decking for fall protection. We also dealing with a lot of condensate water from the bottom of the bowl dripping down the interior of the pedestal and down the water fill line. Significant rust and corrosion was increased from the water previously penetrating the coating on the fill line. We have standing water in the pipe and valve pit under the tower from the condensate water dripping to the bottom of the tower. We asked the Contractor, LeadCon, for a price to fully enclose the decking under the bowl and set it up as a condensate drain. We thought this would help protect the interior coating of the tower by removing a lot of the condensate water. This would help on long term corrosion and the water accumulation under the tower. It would also provide an added measure for fall safety when accessing the top of the tower and eliminate any chance of an item being dropped through the tower and becoming a missile on the way down. Hardhats are required when working in the tower because of this concern, also. LeadCon submitted a price of $9800 for this added metal decking and retrofit to become a condensate drain. They also requested a five day extension for completion date if this item is added. Adding an item like this in the future would be very costly and require a recoating after the addition was made to reseal all surfaces after work and welding. Adding the item now would be the only cost effective option. A copy of the proposal is attached. Bids for this total project come in lower than engineering estimates. We have also planned on some contingency money for field changes in our budget. This addition would be in the long term interest of the City of Oak Park Heights for future tower maintenance and would also address some added safety concerns. Public Works has discussed this item with Bonestroo staff and feels this improvement would be in the city's best interest. These lift stations receive electrical service from Xcel Energy. When power is lost, the city has previously used sewer service companies to haul wastewater by truck if the stations were approaching an overflow point. However, in the event of tornado, ice damage, straight line winds or other disasters that affect a large area, the trucking option may be insufficient or unavailable. Public Works requested and received a $32,000 transfer to the sewer rehabilitation fund for the purchase of an emergency generator in 2007. We also have money allocated in the 2007 budget to upgrade the electrical services and alarm point at each lift station to allow a generator to be plugged in to and run the lift station in an emergency. Public Works will contract with a local commercial electrician to start the electrical upgrades at each station to be able to use a generator for back-up power. We would like to solicit bids for a portable generator to operate the lift stations in an emergency. Generators are available in the Metro area for rentals for such work, but, when an emergency happens or protracted issues arise, it is best to have our own unit to guarantee availability. We hope it never happens, but we must be able to operate our lift stations even if a large ice storm takes out electrical service for multiple days. Rental units may not be available under those circumstances and would not be timely for emergency use. We are requesting Council authorization to solicit bids for a portable generator that is capable of running any our lift stations and that can be moved from station to station in the event of an area wide emergency or can be left at one station if power is lost for a temporary period at one station. The generator will require multiple voltage operation since we have 3 different voltages that are used to operate our lift stations. It will be stored in the public works garage and be operated and maintained on a regular schedule to verify its availability in an em� �� of the city vehicles will need to be moved outside to allow the generator to M be ke�t in a ted environment and ready to operate. It will be set up for cold weather operations but it is best to be able to start the generator in a warm environment and then transport to the site. This eliminates warm up and run in times and allows immediate connection and lift station start-up in emergencies. We would ask council to authorize the bid to allow evaluation and selection of the generator based on the best interest of the city. Because we are looking at a trailer mounted, diesel driven, multiple voltage unit, we think it might be cost effective to evaluate used rental units. This would only be considered if the hours are low and the maintenance records are very good. The specification sheet (attached) will include directions in the cover letter that the City is open to considering used units if it is found to be in the best interest of the city. Our discussion with Zieglers suggests that, depending on the units available, this might be a good option for the City of Oak Park Heights. The generator will be fitted with unique plug -ins for each voltage and the connection cords for each lift station will be of such a design that it will not be possible to supply an improper voltage supply to a lift station. We are coordinating with Bayport and Stillwater to match their generator set-up and plugs to allow inter -city assistance, if needed. Evaluations and recommendations will be brought to the Council in October. Recommendation We request Council Authorization to proceed with soliciting and evaluating bids for the supply of a portable generator capable of operating any of the City of Oak Park Heights lift stations. The unit will be stored in a heated area but must be capable of full use and operation if left outside. Vendors are encouraged to discuss potential options with Public Works prior to submittal of the bid(s). Vendor must include an estimated delivery time. Two budget workshops have been held for the 2008 proposed budget and tax levy. At this time the proposed revenue budget is $4,017,336 and the proposed expenditure budget is $4,017,140. The proposed General Fund levy amount is $3,411,780. My preliminary calculations indicate a 22.3% or $622,125 increase in Levy and a 3.2% increase in tax rate over 2007. After all expenditures have been taken into consideration we have a 22.2% or $729,910 increase in the expenditure budget over the 2007 budget. The departments with increases over 10% are Mayor 8s Council, Elections, Audit, Assessor. Public Works -Street Maintenance, Tree Removal, Sanitation and Waste, Parks, and Transfers Out. The largest increase is Transfers Out, 86.6% or $427,000. The increase is for future capital expenditures. Mayor & Council increase is due to anticipated increase in Professional and Consultant Services and additional attendance at NLC conferences. Elections increased due to the Primary and General Elections for 2008. Audit will increase due to additional internal control requirements. Assessor will have increased costs for the assessing contract with Washington County. The Public Works -Street Maintenance will increase due to increase in salaries and increase costs for bituminous for patching. The Tree Removal budget increased for additional costs for the arborist's services for reviewing the trees in the new property acquired for the parks and for tree removal in that area. Sanitation and Waste will increase to reflect the City paying for 100% of waste removal for low density residential property. Parks will increase for salaries, planning and developing the new park property, prairie restoration and increased costs for materials. All counties, school districts, cities over 500 population, and metropolitan special taxing districts are required to hold Truth in Taxation public hearings for the taxes payable year 2008, to give notice of their public hearings, and to certify their compliance with the Truth in Taxation Law. Counties, school districts, cities and metropolitan special taxing districts may be exempt from the Truth in Taxation hearings if its total proposed property tax levy does not exceed its previous year final property tax levy by more than the percentage increase in the 1PD (4.2853%). The maximum levy for our city to qualify for the exemption is $2,909,200. Our proposed levy is $3,411,780, therefore Oak Park Heights is required to hold a Truth in Taxation hearing. Hearing dates and times cannot be held before November 29, 2007 or after December 20, 2007. The City hearings cannot conflict with the County, School District, and Metro Special Taxing Districts. The hearings cannot be scheduled before 5:00 p.m. Monday through Friday. if scheduled on Saturday, they have to be at a reasonable time. No hearings are permitted on Sunday or Holidays. A city may select a date for its continuation hearing that conflicts with the continuation hearing date of another taxing authority if the city deems it necessary. December 5, 6, 12, and 18 are reserved for the County and Metro Special Taxing Districts, The School District has chosen December 4 for its initial hearing and December 13 for its continuation hearing. Monday December 3 and 10 has been reserved for Cities. This is expected to be no later than December, 2010. Specific issues related to this request and comments include: • Parking — There will be room for 16 vehicles at this location. This is adequate based on history. The lot and parking areas will be covered with class 5 gravel. • Traffic — participants in the STS program will access the site via the alley located to the south of the main Government Center complex. The traffic will occur between 8:00 a.m.-8:45a.m. and 4:00 p.m. - 4:30 p,m.. This is not an increase or change over current traffic levels. • Adjacent Residence — A privacy fence' constructed per city code will be erected along the lot -line between the proposed site and the residence to the east.
