Ref: Oakgreen Village and Oakgreen Commons Development Site Violations
Dear Tim,
On October 7 I addressed a letter to you regarding the cleanup of the site, erosion control,
completion of the remodeling of 13924 Lower 59 Street, and the removal of two driveways
located off of Oakgreen Ave. N. The items listed in the letter were to be completed by October
14, 2011, and to date some of these items have not been addressed or completed. This
morning I conducted a site investigation of the development and the following items listed
below have not been corrected for compliance to the City's Zoning Ordinance and the
Development Agreement (D.A.) with the City for this project.
Regarding the remodeling project of 13924 Lower 59 Street, the following items need to be
completed or corrected for compliance to the conditions set in the D.A. and the Zoning Code:
1) The siding project needs to be completed. The flashing over the blocks needs to be
properly secured. Garage foundation blocks in the front Southeast corner need to be
filled with concrete or properly capped. The Northeast corner of the building is missing
a corner board. The siding needs to be painted or replaced with siding to match the
building.
2) Erosion Control of the East Yard. The East side yard appears to need more dirt to
establish a positive drainage away from the building. At this time all the drainage from
the east is directed to the structure. A defined swale is to be put in place to carry the
storm water to the North as indicated in the grading plan submitted to the City. After
creating the proper drainage the side yard is to be sodded.
3) Erosion Control of the South Yard. It is to be graded and sodded.
4) Erosion Control of the West Yard. It is to be graded and sodded.
5) Erosion Control of the North Yard. It is to be graded, a silt fence is to be installed at the
north property line by the City Trail, and the area is to be seeded and covered with a
erosion blanket or weed free mulch. Another option is to sod the area.
Construction debris @ 13910, 13918, & 13924 Lower 59 Street. There is debris in front and
in the rear yards that needs to be either stored in the garage or removed from the site. In
addition, the front end loader with the construction platform in the rear of the building is to be
removed from the site.

The two green street lights and their concrete footings are to be installed on the site or
removed from the site.
The two driveways off of Oakgreen Ave. N. that were for the old dwellings are to be removed
and the drainage ditch formed to a natural state.
Grading and Erosion Control Plan C3.1 The present grading and seeding is unacceptable. The
area south of the Assisted Living Building shall be graded and seeded as per C3.1 of the plan
submitted to and approved by the City. As noted, top soil is needed, seed shall be drilled and
not spread, and all seeding shall be covered with weed free MN /DOT type II mulch. Provide an
even transition between seeded areas and the sod.
Compliance to the items above must be met no later than October 31, 2011. If compliance is
not met by this date the City shall have no alternative other than to take further action to
resolve these conditions. Any expenses and administration fees incurred by sub - contractors
and staff shall be billed to the owner of the property or the City shall extend a tax to the
property in a form of an assessment to the property for these services. In addition, no further
Permits will be issued to this development. All the Code violations shall be turned over to the
Police Department for review and citations will be issued for those code violations.
