Call to Order/Pledge of Allej4iance/Approval..of Agenda: The meeting was called to order at 7:00 p.m. by Mayor Beaudet, Present: Councilmembers Abrahamson, Doerr, McComber and Swenson. Staff present: Administrator Johnson, City Attorney Vierling, City Engincer Postler, and City Planner Richards. Absent: None. Mayor Beaudet added "Approve Amended Resolution to Sell Property Within Oak Park. Heights" and "Approve Lawn Care Contract" as items G and 1-1 on the Consent Agenda; "Request State to Televise final Stakeholder Meeting" as item 1-1 under New Business; and "Cover Park Mulching Project" as item A under Old Business. Plannim)- Commission: City Planner Richards reported that the Planning Commission will meet on May 1 1 ", with two new items on the agenda and possibly the general plan for Oakgreen Village. 13. Parks Commission: Councilmember Abrahamson reported that there has been no activity since the last Council meeting. C. Cable Commission: Councilmember .Doerr reported that the Cable Commission made budget revisions at the April 19"' meeting. Councilmernber Doerr also reported that he and Commission representatives met with Senator Kennedy's staff to discuss concerns on pending legislation. D. _Water Management Or ganizations/Middle. St. Croix: Mayor Beaudet reported that the Middle St. Croix will meet on May l lig', 7:00 p.m. at the Conservation District office and noted that BWSR should be approving the Plan very soon. EL Other Liaison/Staff Kepoz.tL. Mayor Beaudet provided a reminder of the Spring Clean-up to be held on Saturday, May 20'x' and the Washington County hazardous waste collection event that will also be held on May 20'x' Councilmember McCoinber reported that the final Stakeholders meeting will be held in July. Xcel I ner .. __Amended CU]' for the Welter I..andfill Site City Planner Richards reviewed the application and plans for the site, noting that the Planning Commission recommended approval of the application and also reviewed the recommended conditions for approval. Planner Richards also noted that the proposed relocation of the road would be better for the neighboring properties. Discussion was held concerning replacement of trees that were planted at the beginning of the project and have since died. Project Manager Darrell Knutson reported that Xcel Flnergy is planning on Mobilizing equipment May 1" if the amendment is approved. Mr. Knutson explained the proposed change in location of the host closure access road and noted that the proposes{ location is much better for the neighbors than the permitted location. Mr. Knutson reported that Xcel has engaged a new engineering firm that has reduced the footprint of the construction area while providing the same capacity which reduces the A City Council Meeting Minutes April 25, 2006 Page 3 of C impact on the neighboring properties. Mr. Knutson also reported that this will be the last major construction in that area and that the inactive sites will be capped soon. Mayor Beaudet asked that staff' monitor the site to ensure that the cell and roadway are kept watered to minimize dust. Councilmember Swenson, seconded by Councilmember Abrahamson, moved to approve the Resolution approving the CUP amendment for the Moelter landfill site. Mayor Beaudet, seconded by Councilmember Swenson, moved to amend the Resolution to add a condition that staff.' will review the road off of 58'x' Street at the end of the project for possible paving, Carried 5 -- 0. Mayor Beaudet, seconded by Councilmember Abrahamson, moved to acid a condition to the Resolution requiring that the parking area adjacent to Cover Park be reviewed and addressed at the closure of the project. Carried 5 -- 0. Chuck Dougherty of 15330 58'x' Street North stated that he likes the revised plan and requested that the City look into a drainage problem at his property caused by the water from the cul-de-sac draining into his driveway. Mayor Beaudet, seconded by Councilmember Swenson, moved to direct the City Engineer to review the drainage issue between the cul-de-sac and Mr. Dougherty's property. Carried 5 0. Brian Jones of 15331 58'x' Street North stated that Xcel Energy should replant large trees in place of the trees that have died. City Adn-iinistrator Johnson reviewed data concerning the City receiving; payment in lieu of taxes. Administrator Johnson reported that the 40.2 acre site presently bays `f;6,300 to the City in property taxes and noted that if current commercial property values were applied to the site the City could receive as much as $90,000 in taxes. Administrator Johnson added that the City has held many discussions with Xcel 1? City Council Meeting Minutes April 25, 2006 Page 4 of 6 1:3. Jacob I Ioldin js of Stillwater LLC -- Amended CUP City Planner Richards reviewed the application and reported that some of the conditions placed on the original CUP have, not been net. The Planning Commission recommended approval of the amendment with the original conditions in place. City Administrator Johnson noted that the applicant would be required to post security with the City equal to the cost of completing the items outlined in the conditions if they move forward with an application for a new building. Councilmember Swenson, seconded by Mayor 13eaudet, moved to approve the Resolution approving the CUP amendment for Jacob I-Ioldings, Roll call vote taken. Carried 5 -- 0. C. Moratorium oil Mc aa-Sk-)ns City Planner Richards reviewed concerns brought on by a national sign company that has been installing large animated billboards and challenging sign ordinances in court. Planner Richards recommended that the City impose a nloratoriunl on mega -sighs while his lirnl conducts further research oil the topic. Councilmember Swenson, seconded by Councilmember Abrahamson, moved to impose a moratorium on mega -signs until November 1, 2006, Carried 5 — 0. D. Schedule Worksession 1.61- Discussion of City Infrastructure L. Schedule Worksession with MnDOT F. Schedule Worksession to Discuss New Connection Charges „Rate City Administrator Johnson suggested an untelevised worksession prior to the May 9`" meeting to discuss city infrastructure and connection charges and to invite MnDOT 1:or a discussion trail layout and the Beach Road bridge. Mayor 13eaudet, seconded by Councilmember MCComber, moved to schedule untelevised worksessions for 5:45 p.m. on May 9, 2006 to discuss city infrastructure and connection charges and on May 23, 2006 at 6:00 p.m. to meet with MnDOT. Counclimember Abrahamson, seconded by Councilmember McComber, moved to schedule a teambuilding worksession for 6:00 p.m. oil May 17, 2006 without a facilitator. Carried 5 — 0. 11. I ec pest State Telev_i,se Final Stakeholder Meetin Mayor Beaudet suggested that the City request that MnDOT televise the final Stakeholder electing. Councilmember Doerr cautioned that the Cable Commission may bill the City for it. Mayor 13caudet, seconded by Councilmember Abrahamson, moved to send a letter to MnDOT requesting that the final Stakeholder meeting be televised at WDO]"s, expense. Carried 5 0. VII. Old Business. A. Cover Park Mulchin _ Proiept Mayor Beaudet stated that this project needs to be completed in the next two to three weeks to prevent weeds. Mayor Beaudet reported that the City invested a lot of money to get the garden started and it was last mulched in 2001 by Abrahamsons. Discussion was held concerning funding for the project. City Administrator Johnson reported that this project was not budgeted for in the Parks budget and suggested using Bunds in Council contingency. Councilmember Swenson stated that the Parks Commission needs to budget for this maintenance item in the future. Mayor Beaudet, seconded by Councilmember Swenson, Moved to approve up to $3,600 for Abrahamson's to mulch the Cover Park garden with funds to conte from Couiacil Contingency and be reimbursed if there are leftover funds in the Parks budget. Action Meeting Date May 9 2.006 Agenda Item Title: Authorization to Accept Gift of Bagged Shredded Bark Mulch Time Required Agenda Placement Consent Originating Department/Requestor Public Works Director 1 Tom Ozzello Requester's Signature Action: Requested Authorization to Accept Gift from Woodbury Home De of Background/Justification The City of Oak Park Heights was contacted by Home Depot in Woodbury and told that they had numerous bags of shredded cypress mulch material that was the wrong item, they could not sell, and they would have to pay to return. They offered it to the City of Oak Park Heights free of charge if we would pick it up. It included numerous bags on pallets and broken pallets. The items will fit in to the city's dump truck for pick-up and distribution. The City of Oak Park Heights has ongoing need for this type of product. It is used as mulch material around trees and plantings to protect the tree from growth near the tree that would be trimmed by power equipment. Power equipment can accidentally damage the trees and drives up the cost of maintenance with the extra time to trim close to the trees. Mulch materials suppress weed and grass growth around the trees and keep a cleaner look at a lower cost with less potential damage. The City of Oak Park Heights will use the material to supplement existing mulch around trees in Autumn Ridge Park. Since this is a gift to the city, the City of Oak Park Heights must draft a resolution that can be adopted by the City of Oak Park Heights to accept the gift to the city. Recommendation We request Council Pass a resolution accepting the Gift of a Bagged Bark Mulch from Home Depot to be used around trees at Autumn Ridge Park. 01" -, Oak Park Heights ENCLOSLI Request for Council Action Meeting Date Ma 9`' 2006 Time Required: l Minute Agenda Item Title: Adopt Donation Policy for Cijy Parks Agenda Placement New Business Originating D Requester's Signature Action Requested Background/Justification (ease indicate if any previous action has been taken or if other public bodies have advised): Attached is a proposed policy on Park and Recreation Donations, as the City has from time to time been asked to place benches, memorials, trees and plaques in our City parks. A written policy outlines expectations and responsibilities for both the City and donors. All donations must be accepted by resolution of the City Council, such provision is inserted. 3 tj City of Oak Park Heights Parks & Recreation - Donations ia 1, POLICY • Thank you for considering the City of Oak Park Heights as a recipient of your donation. Donations to the park system help provide service and amenities beyond that possible within our allocated budgets. Your donation to the park is an opportunity for you to pay tribute to or recognize someone or an accomplishment, or just simply expressing an interest in the keeping our parks in good condition. • Donation possibilities are unique and diverse as the donor; some donations that have been made include: benches, plantings (i.e. shrubs, trees, and flowers), labor, and financial support. • All proposed donations must be presented, in writing, to the City Administrator for review and consideration of the Parks Commission and City Council approval prior to any donation activity occurring. City stag, advisory boards and elected officials will to their best to accommodate donation requests within a reasonable period of time. The City of Oak Park Heights desires to encourage donations while at the same time maintain aesthetic impacts and mitigate ongoing maintenance costs. 11. GUIDELINES 1. Appearance and Aesthetics: In maintaining aesthetics to the park system, physical donations should reflect the character of their proposed location of placement and must be installed in such a manner or location that will not substantially change the character of the areas intended use. The City shall be the sole entity to determine suitability and location. The City may reject any requested donation for any reason. 2. Maintenance: Donated items become City property. Accordingly, the City will maintain the donation for the expected life cycle of the donation under established practices for city maintenance. The City reserves the sole right to remove, alter or discontinue the use of a donated (physical or funded) item, based upon needs assessment for the park system or if the item is outdated, in state of condition beyond repair or found to be unsafe for public use. 3. Removal: The City reserves the sole right to remove any donated property, equipment, signage or apparatus that in anyway negatively impacts the City and without notice and/or compensation to the donor or other parties. 111. PROCESS I. Complete the application (attached) for proposed donation and submit to City Administrator to begin review/consideration process. 2. Upon receipt, City Administrator will review application and request any supplementary information needed. The application will then be conveyed to the Parks Commission for their review/consideration at the first available regularly scheduled meeting Applicant will be notified of this date and is encouraged to attend the meeting to address any questions that may arise during the Commission review/consideration of the application. 3. The Parks Commission will make a recommendation to the City Council. The City Council will also review the application and recommendation and will make a make a final decision (via resolution) at the first timely meeting following the Parks Commission meeting and recommendation. City Staff will proceed to follow through with the applicant, based upon the directive provided by the City Council. This final document, now dated May 9`h, 2006, includes all ordinance updates. Please remember that Sec 401 relating to Zoning was revised last August. A primary need to revise the Code was to have a current, up to date and electronically accessible version. Many of you submitted comments and concerns when this was distributed as a draft last year. All of which have been addressed and/or reviewed. In an effort to save printing, the current revised draft documents that staff is recommending for adoption can be found on the attached CD. A draft hard copy is also available at the front desk at City Hall. Each ordinance is listed separately. Generally, there are not wholesale changes or significant amendments, rather administrative, clerical and legal revisions and updates. I would point out some highlights: • Cc 704 —Right of Way has been revised to match those provided by the LMC to deal effectively with the new utility marking requirement. Also a new application form and $1'50.00 fee has been incorporated + Cc 102 — Master Fee Schedule has been created and can be revised on as needed basis without a re - adoption of the code and/or publication. Some of the fees have been adjusted slightly but remain lower than surrounding communities. Also, a fee has been added that would generate greater revenue for the City if it is asked to issue conduit revenue bonds orjrnance other projects for a developer, these are common in most cities. • Cc 301- Most of the 300 codes, dealing with building codes have been revised to the match current state standards. The purpose of discussing the acquisition this property now is as a result of its recent platting as an Outlot in Oak Park Commons and the contribution to park dedication fees by VSSA as part of that platting. The original city agreement with VSSA anticipated the crediting of park dedication fees otherwise due from VSSA lands as an offset to the City's cost in acquisition of the linear parr. Ifthe city intends to acquire the lands in the linear park it should take title to the parcel as the crediting of fees is effectively partial payment and acquisition has begun. if not, the park dedication fees from VSSA should be returned to them and VSSA should plan their use and/or sale of the parcel accordingly. 10 i MEMORANDUM OF AGREEMENT AND SUMMARY OF LAND AND PARK DEDICATION CHARGES WHEREAS, by the second amendment to a development agreement dated May of 2000 between Valley Senior Services Alliance and the City of Oak Park I leights, Valley Senior Services Alliance agrees{ to sell lands denoted as the "linear park" to the City of Oak Park Heights for the price of $1.40 per square foot; and, WHEREAS, said lands approximate 4.56 acres and were to include a 50 foot wide strip or tract of land adjacent to the Riverhills Development, being a strip ortract of land 150 foot wide as measured from north to south and running east to west along the entire border of the 1Z_iverhills Development, commencing on its east side with the right-of-way of Oakgreen Avenue and terminating on its west side with the current western boundary of the plat of Boutwell's Landing; and, WHE,IZEAS, the City of Oak Park Heights and Valley Senior Services Alliance agree that the City would acquire that property at its options for the price of $1.40 per square foot, or for a total accuunulated price of $278,546.10; and, WHEREAS, Valley Senior Services Alliance acknowledges that it had interest in real estate north. of 58`k' Street; and, WHEREAS, Valley Senior Se) -vices Alliance in conjunction with Anchobaypro, Inc, projected a Phase I Development for a project termed "Oakgreen Village" in 2003 that was rMr to contain 87 townhonne units, the site being north of 58"' Street North and west of Oakgreen Avenue North, with a concept plan for the area that was approved with conditions by the City Council in May of 2003. The projected cash park dedication fee for Please I. of Oakgreen Village that were approved in 2003 projected the payment of a park dedication fee to the City of Oak Park Heights in the unnount of 9283,000.00; and, WHEREAS, Phase I of Oakgreen Village as proposed in 2003 did not proceed to completion at that time and no development agreement was signed by Valley Senior Services and Anchbaypro, Inc.; and, WHEREAS, the parties desire currently to convey to the City of Oak Park heights the linear park previously referenced in the May, 2000 second amended agreement to the development contract, with the conveyance occurring concurrently with the execution of this agreement; and, WHEREAS, the parties are also in agreement that the 9278,546.10 owed by the City of Oak Park Heights to Valley Senior Services Alliance relative to the acquisition of the aforementioned linear park should not be paid at the present tinie, but should be credited against any payment that will be due to the City of Oak Park heights from Valley Senior Services Alliance relative to the development of its lands north of 50' Street at and when such time as those developments have occurred. NOW 'I'HEREFORF, be it agreed by and between the parties hereto as follows'. 1. That Valley Senior Services Alliance shall convey by marketable title that area formally designated by the parties as the linearinark to the City of 0ak Park Heights, conveying sanne by Warranty Deed to the City of Oak Park Heights. aj 2. The 2006 sanitary sewer budget for contracted services is $50,000 and $44,000 of this was planned for televising and cleaning sewer lines. The remainder was for emergencies and repairs. These areas have been previously scheduled for road replacement and all corrective sewer work must be identified and completed prior to any road replacement work. The solicitation will specified the costs be listed and bid separately but that, if both projects are awarded, the work on both areas can be done at the same time. Crack Sealing services are used to find, clean and fill cracks in the asphalt prior to a new overlay or seal coat or to re -seal a crack in the pathway. Establishing a fully sealed pavement keeps water out of the base and minimizes the damage done when water goes through the freeze thaw cycles that expand and break up the base and surface. Streets has total funding of $181,351 in budgeted projects for seal coating, crack sealing and other work for 2006. Seal coating is planned for the 91" addition (list of streets at end of text). Crack sealing is needed in this area prior to Seal Coating. The Parks Commission has also discussed the high priority of crack sealing for trails. They have requested costs and information (included in the quotes) to allow them to make recommendations on Park Trail Repairs. The two quotes submitted were from I<ahmer Asphalt Sealers, hic. and Struck & Irwin Paving, Inc. Struck and Irwin Paving included an itemized list of preparatory work in their quote for each area to be Slurry Scaled. 'The October 17, 2005 letter from Struck and Irwin is attached to outline the breadth and depth of preparatory work they would recomaalend to allow a successful project. Fahrner's quote was for slurry seal application only and was quoted as cost per square yard of application. In comparing the cost of the slurry seal product, Struck and Irwin estimated total surface at 17,000 square yards and gave a firm price for the slurry seal portion at $19,698. Fahrner quoted $1.25 per square yard so would have a slurry cost of $21,250. The Preparatory work is quoted at $5236.05 by Struck and Irwin. We would have to do this preparatory work for either vendor. There is a reliability factor in having the slurry seal vendor provide the preparatory work. They can not claim the preparatory work was not done properly if there is a later issue on the project. Box 2007 Oak Park Heights, MN 55082-2007 Re: Slurry Seal Budgeting Information Dear Erik: Thank you and Toni for taking the time to talk with me last week to discuss possible slurry seal in Oak Park Heights, As you requested, I am enclosing a table with a list of the streets you selected for possible slurry seal. In addition, I have indicated the approximate cost to slurry seal those streets identified on the attached table. A map of Oak Park Heights is also enclosed with the prospective streets for slurry sealing highlighted. Two important factors to be concerned about when selecting pavement surfaces for slurry seal are the pavement profile and crack :conditions. that exist on the streets. The pavement profile on the streets identified as possible slurry seal candidates are relatively good, with limited wheel rutting, depressions, or other pavement profile imperfections. With regard to crack conditions, none of the cracks that have formed have been sealed. These cracks should be addressed before a slurry seal is applied in an attempt to prevent water from getting down into the gravel base. It has been our experience that the best way to keep water out of the primary cracks is to fill them with a rubberized sealant. However, the edge and secondary cracks are either too close to the edge of the street or too close to the primary cracks for them to be effectively routed and filled with a rubberized sealant. Instead, these cracks are best addressed with a "spray patching" process. This process cleans out these cracks and. applies a liquid asphalt into the crack. A light coating of cover aggregate is then applied to the crack area to prevent traffic from tracking the liquid asphalt before it dries. I can not stress enough the importance of treating cracks prior to slurry scaling in order to provide the most cost-effective process to your streets, Otherwise, reflected cracks which will occur through the slurry seal will allow water to further degrade the gravel base and lead to a much quicker pavement deterioration rate. We refer to the crack sealing and spray patching processes described above as preparatory work. The enclosed table provides the cost breakdown between preparatory work and slurry seal work.
