Enclosed is a title commitment evidencing ownership status and encumbrances. 2. We do not anticipate having to change any of the items outlined in the current developer's agreement, except for the items involving number of units and any proposed design and or color changes the Staff may recommend. The changes to the Homeowner's Association are outlined in my letter to Mark Vierling (see attached). 3. The neighborhood meeting was held on October 4 Two council members and one city staff member were present. 4. See enclosed Preliminary Plat 5. See enclosed utility plans 6. See enclosed full scale copies of the entire plan sheet 7. Dimensions are now included on all site and architectural plans. 8. Tables are now provided indicating square footages and bedrooms. 9. See calculated density information. 10. See attached plans for the previously approved Oak green Village project. The total proposed number of units in the earlier approved development was 67. 11. The plans have been updated to reflect how access is providing to the southwesterly units. 12. See enclosed lighting plan. 13. No more site signs and monuments are planned for. 14. See enclosed snow storage /removal plan. 15. All trash/recycling is to be stored inside of all buildings and units. Only on trash days will devices be outside. 16. There are no outside units that need screening on the proposed buildings. 17. See proposed colors on elevation plans and materials board. 18. See included graphic perspectives. The Homeowner's Association documents would be amended to reflect a total number of four units in the association. The association would enter into an agreement with the other two owners' of the development (Oakgreen Commons, LLC and Oakgreen Villa, LLC and/or its assigns) whereby they would agree to pay their pro -rata share of the upkeep and repairs on the streets and utilities benefiting their properties. Any other repairs and maintenance on the exterior of the four unit building would be handled internally by the Association. Lawn care and snowplowing will be provided by one entity at one time for the entire development. The costs would be shared on a pro -rata basis. This seems to be the fairest way to treat the existing homeowner's. Otherwise, they would not have a majority voice in an over -all association, and could be subjected to onerous assessments and dues increases. Regarding the $50,000 initial fund; that was initially intended for 67 units. We proposed to the homeowners' that 4 /67ths of that amount $3,000.00 would be funded into their reserves, when control of the association is turned over.
