The School District is applying for two freestanding signs to be located at Highway 5 and 58th Street and the south entrance on Highway 5. Both signs are proposed to be approximately 234 square feet and S — feet 8 inches high. Recommendation: . Based upon the review that follows, our office recommends granting a variance from the sign requirements for freestanding signs in the "0" District for the School District signs based on the dimensions in the plans submitted. • 5775 Wayzata Blvd. • Suite 555 • St. Louis Park, MN 55416 • (612) 595- 963'6•Fax. 595 -9837 • • . Standard proposed by Allowed by Sc — hoo Dia ; Ct Ordinance • Number of freestanding signs 2 • Square•footage of sign • 234 2 (65' actual lettering) Height of sign 9'8" 8' • The School District will therefore be requesting a variance for number of signs, size of signs, and height of signs. , — In considering all requests for a variance, and in taking 'subsequent action, the City Staff and the Board of Zoning .'Adjustments shall make a finding of fact that the proposed action will not: 1. Impair an adequate supply of light and air to adjacent property. '2. Unreasonably increase the congestion in the public street. — '3. Increase the danger of fire or endanger the public safety. 4. Unreasonably diminish or impair established property values _ within the neighborhood, or in any other way be contrary to the intent of this Ordinance. The freestanding sign located at Highway 5 and 58th Street is located' 20 feet from the Highway 5 right -of -way line or 78 feet from edge of pavement and 43 feet from the edge of pavement on 58th Street. Due to their size and location,.both signs will not impair light or air to any adjacent property, nor will they affect property values, increase traffic congestion or fire danger. The signs are located outside of the street corner sight triangles and as such, their added height and dimension should "' not impair traffic visibility from either site location. 2 • • . The signs are meant as identification signs and help establish the location of the high — school. • The size of the signs are in relation to the size of the • school, in that they are not - excessive in size compared to the school building. The construction materials of the sign are also consistent with those used on the school building which will help the signs' lend into the site. • — • Granting these variances does not conflict with any of the purposes of the "O ". District.• The size and number of signs do — not conflict with the open space intent of the district. CONCLUSION ., • Based on the very limiting sign requirements, our office recommends granting a variance for number of signs, size, and _ height of sign. pc: LaVonne Wilson Mick Kaehler Mark Vierling Dan Parker • • • • • 3 [. ; ',(' ' rj 1 J•t l ' +.i'T;taT:■i +T'' ''f ltir•N•i' ` T I '. ^' t . r., • ._ ; •r, r• , :..., „I •! 1i ".y? i'} Y ^: 4Y M. I appreciate the school district's desire to process the permits in a timely fashion. In order to accommodate that, the City will require several of the documents that are referenced within the Conditional Use Permit to be provided and to be on file within the City offices before the actual permit or any building permit to be issued thereto can be issued. Those documents to be filed with the City.will consist of the following: ' 1. Pursuant to Paragraph 5 of the permit, if it has not already been done, a final . Lighting Plan to be provided by the district indicating the provisions for . lighting of the area between the parking lots and the entrance gates and bleachers. 2. Paragraph 7 of the permit references the district's proposed Emergency Evacuation Plan for the stadium. If it hasn't already been completed, a final • draft of the Emergency Evacuation Plans submitted to and approved by the • Police Chief of the City of Oak Park Heights must be provided with that plan ,,, being on file with the City of Oak Park Heights Police Department. • Ms. India W. Pursuant to Paragraph 10, in the event that the district intends to change, alter or replace the existing scoreboard a new plan will have to be submitted for that structure; however, it was your previous representation that the existing scoreboard would be used and there would be no modifications to same and, if that is the case, no further applications would be required relative to that issue. 6. Paragraph 11 of the Conditional Use Permit requires a formal Landscape and Transplanting Plan be submitted to and approved by the City Arborist. 7. Paragraph 12 of the permit requires that drainage calculations for the proposed changes to the site be submitted to the City Engineer for his review and approval. We assume that the same has already been done, but if there • are any changes or modifications necessitated as a result of Valley Branch comments or modifications to their permit as issued, those should be promptly submitted to the City Engineer, as well. • 8. Paragraph 14 of the permit references the district's provision of the Parking • and Traffic Management Plan. The final plan must be submitted to and signed for approval by the City Administrator and the Chief of Police and be — placed on file with the City for public review. 9. The revised detail is what we are proposing to provide. We have had discussions with Paul Hoppe, the owner of the local satellite toilet company, to determine the most appropriate way of securing the units to minimize vandalism (tipping, moving, etc.). He stated that toilet units are typically secured to chain link fencing with cable and locks. Generally, a maximum of two units are cabled together to eliminate excessive slack in the cable. The cable is strung through the wood skids at the base of the toilet unit and through the fence. Keys are then held by school maintenance staff and the satellite toilet company. -- Please forward this information to related staff and City Council members, if appropriate. Minneapolis, MN 55416 Oak Park Heights, MN 55082 Re: Stillwater School District—Application for Amendment to Conditional Use Permit and Variances for Stillwater High School Stadium Our File No.: 16981/102 — Dear Ms. Danielson and Mr. Richards: — This letter is provided to you in connection with our efforts to secure final confirmation from the State of Minnesota regarding the application of the State building oode and the internal policies of the Minnesota Department of Administration concerning whether the School District may rely solely on the use of portable toilets, or whether it is additionally required to open up all or a portion of the school building for stadium restroom use. In connection with the foregoing, please find enclosed copies of email transmissions sent -_ and received by India Boulton of our office to and from Scott D. McLellan of the State of Minnesota. Although we have had conversations with others within the State of Minnesota on this issue (all of which have been consistent with the information now furnished by Mr. McLellan), we have focused our efforts to obtain clarification directly from Mr. McLellan as we understand that he is the person who had previously been in direct contact with the City staff one this matter. Mr. McLellan's comments pertain directly to the Minnesota Department of Administration, Building Codes and Standards Division, Policy No. PR-04 on the issue of "Required Plumbing Fixture?, a copy of which policy was previously furnished to the City. As you will recall, that Policy provided in part as follows: — The Division will recognize the use of the following to satisfy this requirement: a) permanent fixtures located either on site or available in an adjacent building; b) portable temporary fixtures that will be available on site during times when the bleacher seating is in use. • • RIDER, BENNETT, EGAN ... taUNDEL, LLP •.,.. Ms. Kris Danielson Mr. Scott Richards April 26, 2002 Page 2 Confusion on this issue between the City and the District generally focused on whether items (a) and (b) above were "alternatively" or "collectively" required in order to comply with State law. Mr. McLellan's responsive email makes it clear that such items are in fact "alternative" _ requirements. As reflected in the enclosed eznails, it is clearly the State's policy that the School District may satisfy the requirements for toilet facilities by either (a) providing permanent fixtures on site or in an adjacent building, or (b) providing portable fixtures on site. Consequently, the District will be in compliance with State law by furnishing only portable temporary toilets on site. It would be the District's intent to keep the school building locked and inaccessible for stadium restroom use; provided, however, as Lyle Koski, the high school principal, indicated at the March 26, 2002 City Council meeting, the District would most certainly be willing to provide limited building access in unique situations where the circumstances indicated that an individual would not be able to use a portable facility. This is anticipated to be an infrequent occurrence. While we recognize that there may remain some concern by the City over the lack of general access to the school building, I am advised by the District that there are a number of compelling reasons which support this position. These reasons including the following: 1. Access to the school building poses significant security and vandalism issues both .._ on the school grounds and within the school building generally, as well as within the school building restrooms specifically. 2. Granting access to the school building would require the District to implement a process for stamping hands, re- ticketing, or otherwise enabling stadium attendees to regain access to the stadium area after leaving the area to use school building . restrooms. This would present serious control problems. 3. Allowing stadium attendees to leave the ticketed stadium area creates problems with respect to possible access to alcohol or other prohibited substances, and additionally increases the potential for introduction of such substances into the stadium area. We have been advised by Shenn Danielson, the District's Activities Director, that all or nearly all school districts generally implement policies designed to keep stadium attendees within the designated stadium area during stadium events for these and other similar reasons. High School Stadium Scott, I just wanted to check in with you to make sure that you have my correct e-mail address to send your comments concerning the restroom issue at the Stillwater Area High School Stadium to be constructed in Oak Park Heights, MN. As we discussed, the main issue is whether the school district must also open up the school to the public for restroom use in addition to the District's proposal to provide sufficient portable toilet facilities. Our position is that the District is not required by state law to open up the school if it provides the requisite number of portable toilet facilites. Please confim. The plan states that they will confirm tree removals and replacements with the project landscape architect and myself prior to doing the work and that is acceptable. Tree protection fencing needs to be up in areas indicated on the tree protection plan prior to the start of any construction. Widin (E -mail) — Subject: Stillwater H.S. - drainage calculations In response to Item No. 7 of Mark's 4/25/02 letter to Ms. India Boulton and — Mr. Jeffrey Carpenter (addressing Paragraph 12 of the CUP), we have reviewed copy the drainage calculations for the Stillwater High School Stadium Improvements as submitted by Anderson - Johnson Associates, Inc. These same _ drainage calculations were submitted to the Valley Branch Watershed District and approved and permitted by VBWD on 3/28/02. The drainage calculations are acceptable as submitted. The school proposes -- to use two infiltration trenches and an infiltration basin on the west side of the proposed home bleachers to handle the increased rate of storm water runoff, basically not increasing the storm water runoff rate by more than 2% for the 2, 10, and 100 -year storm events. We would not normally consider - infiltration into our more conservative storm water runoff modeling if this were to be a city -owned and maintained system, however, since these improvements will be privately owned and maintained and have been approved by the VBWD, the proposed improvements are acceptable. The school will need to maintain these trenches and basin on an on -going basis to assure infiltration is in fact occurring as modeled. - As previously noted, the visitors bleachers are proposed to be constructed on top of an existing 15" storm sewer that is part of the school's privately owned and maintained football field /track storm sewer system. This storm sewer should probably be relocated around the proposed bleachers to avoid - potential future maintenance issues. Dennis M.
