CONDITIONAL USE PERMIT FOR: All uses shall be subject to the following conditions and/or restrictions imposed by the City Council of the City of Oak Park Heights. General Description: 1. Automobile dealership, major repairs and service operations. All conducted on property described within Exhibit (herein referred to as "dealership" lot) 2. Employee parking area located on real property identified within Exhibit said property being under long term lease from the Arthur J. Raduenz Trust (herein referred to as "employee parking lot "). II. ADDITIONAL RESTRICTIONS AND PROVISIONS. The following additional restrictions and provisions being part of the Conditional Use Permit to be issued herein affecting the following matters shall be: A. Accessory Buildings As presently located on the Dealership property None to be located on the employee parking lot B. Fencing As presently located on either parcel C. Exterior Storage None on employee parking lot Storage of operable automobiles only on dealership lot. No exterior storage of auto parts or related items shall be allowed on the site. All storage shall be within the building. D. Chemical/Pollutant Storage and Disposal None except as authorized by MPCA permit E. Screening As presently located on either lot. F. Landscaping As presently located on the dealership lot. Applicant to submit a landscaping plan to for the review and approval of the city arborist as to the employee parking lot G. Lighting As presently located on either lot and consistent with lighting requirements within the city zoning code. Any changes to existing lighting fixtures shall require submission of a detailed lighting and photometric plan which must be compliant with city ordinance. Applicant is requested to dim the lights in the parking lot after hours of operation. H. Parking As presently provided on either lot. All parking to be maintained on paved surfaces. I. Hours of Operation Not Regulated J. Advertising/Signage As currently provided. The temporary sign now located on the site facing Hwy 36 shall be allowed to remain for the remainder of its useful life as determined by the city director of community development and thereafter shall be removed by the applicant. K. Drainage As presently provided on site (dealership lot) Applicant to submit a grading and drainage plan to be subject to the review and approval by city engineer as to the employee parking lot. L. Other:(Employee Parking Lot) 1. Applicant is advised that this permit is not inclusive of other necessary governmental permits and approvals, including but not limited to State and County Highway Departments, Watershed Districts and others as may apply. 2. A minimum 40 foot setback shall be requires from 58 street on this project. 3. The site shall provide a minimum of 78 off street parking stalls at least 5 of which must be handicapped accessible(including one van accessible stall). 4. The new parking area shall be surrounded with surmountable or B6 -18 concrete curb and gutter. 5. A landscape plan shall be prepared by the applicant and submitted to the city arborist for her review and approval. 6. Applicant is requested but not required to replace the exterior broadcast paging system with hand held paging systems. Upon replacement of the external paging system a hand held paging system shall be implemented on the site. III. REVIEW Pursuant to Order of the City Council of the City of Oak Park Heights, a periodic review of this Conditional Use Permit is imposed as a condition of its grant. This Conditional Use Permit shall be reviewed annually at the Direction of the City Clerk, which shall notify the permit holder of the date of the annual review at least ten (10) days prior to the review hearing. The grading and drainage plan shall be subject to approval of the City Engineer. 2. The applicant is advised that City approval is not inclusive of other necessary governmental permits and approvals, including but not limited to State and County Highway Departments, Watershed Districts and others that may apply. 3. The temporary sign on the site of the off -site parking area shall be allowed to remain for its useful life as determined by the City. 8. Any changes to the existing exterior lighting shall require the submittal of a detailed lighting and photometric plan in conformance with Section 401.15.B.7 and subject to City approval. 9. There shall be no exterior storage of automobile parts, parts cars, or related items on the site. All storage shall be internal to the building. All cars to be stored outside of the building shall be visibly intact. 10. The applicant shall be encouraged, but not required, to dim the parking lot lights at night when the dealership is not open. 11. The applicant shall be encouraged, but not required, to replace the existing exterior broadcast paging system with a hand held paging system. When the existing exterior broadcast system is replaced, it shall be with a hand held paging system. 12. Any other conditions of the Planning Commission, City Council and City staff. 10. Create a 20 foot pedestrian trail easement over the drainage and utility easement on the site's west side along Osgood Avenue. The applicant shall prepare and grade the trail path to accommodate a future completion by Washington County at a later date. 11. The applicant must pay the City a cash payment equal to 14 percent of the fair market value of the subject property. To determine the appropriate park dedication fee, the applicant shall submit an appraisal of the site in accordance with Section 402.08.B.9 of the Subdivision Ordinance. 12. The applicant submit and receive approval of a detailed landscape plan from City staff and the City Arborist. 13. All exterior lighting shall comply with Section 401.15.B.7 of the City Code. 14. The applicant submit detailed patio and porch plans for each unit. 15. The applicant is advised that City approval is not inclusive of other necessary governmental permits and approvals, including but not limited to State and County Highway Departments, Watershed Districts and others that may apply. 16. All other conditions of the City staff, Planning Commission, or City Council.
