Dear Mr." Timm;
Attached is the Petition which was discussed at the Wednesday June 12, 2002 meeting in
reference, to utility connections. The Petition is your formal request to connect to City
utilities and to stage payments for the utilities by assessing to the property. The petition
also waives assessment hearing and procedures for the assessment.
Please have two copies of this petition signed by Mr. Raduenz. Retain one for your
_ records and return one signed original to the City Administrator.

PETITION BY RADUENZ MOTOR MANAGEMENT, INC.
AND STILLWATER MOTORS COMPANY FOR CONNECTION TO CITY
SERVICES AND STAGED PAYMENT OF CONNECTION FEES PURSUANT
TO STIPULATION AND AGREEMENT IN CASE NO. CO -99 -6535
Raduenz Motor Management, Inc., being the fee owner of real property located
within the City of Oak Park Heights, the description of which is "LOT 1 BLOCK 1 KERN
CENTER" and incorporated by reference herein, hereby petitions the City of Oak Park Heights
to allow connection to municipal water, storm sewer and sanitary sewer services pursuant to that
certain stipulation and agreement which was executed by and between Raduenz Motor
Management, Inc. and the City of Oak Park Heights as is contained within Washington County
District Court File No. CO -99 -6535.
Pursuant to Paragraph 3 of said stipulation, real property identified as owned by
Raduenz Motor Management, Inc. and Stillwater Motors Company shall be allowed to connect
to municipal water, sanitary sewer and storm sewer services after paying the connection fees
therefor, which were to be staged over a five year period without interest, providing for equal
annual payments thereon. The total connection fees at present are in the amount of
$213,030.00. Equal annual installments structured in five payments would be in the amount of
$42,606.02, the first installment of which is paid as of the date of this Petition and the succeeding
four annual installments to be assessed by the City of Oak Park Heights pursuant to the terms of
said agreement. The undersigned as owners of the aforementioned property do hereby waive and
release of notice of all assessment hearings and procedures otherwise required under Minn. Stat.
§429.031, et seq., acknowledging that the assessment is provided only for security of the
payment of the connection fees and is not intended to reflect benefit that may otherwise accrue to
the properties at this time. .
