increase fire prevention awareness, the City rewards two residents each month with their choice
of an award of $25.00 or a fire extinguisher and /or smoke detector (s).
Your residence was checked on 'Thursday, August 7, 2008 to determine if you had your recycling
bin out with your regular garbage. Your recycling was out and ready for collection; therefore,

CITY COUNCIL MEETING MINUTES
1. Call to Order /PledLye of Alle-iance /Approval of Agenda: `l , he meeting was
called to order at 7:00 p.m. by Mayor Beaudet. Present: Councilmembers
Abrahamson, Doerr, MCCoi-nber and Swenson. Staff present: Administrator
Johnson, City Attorney Vierling and City Planner Richards. Absent: City
Engineer Postler.
Mayor Beaudet added "Secure Cost Estimates for `Village Area' Zoning
Amendments" as New Business Item I).
Councilmember Abrahamson, seconded by Councilrmember McCorliber, proved
to approve the Agenda as amended. Carried 5 -0.
II. Department /Council Liaison Reports:
A. Plannin- Commission: City Planner Richards reported that the last
meeting of the Planning. Commission was on July 10, He stated that there
were two public hearings that evening. Ile stated that one was on the City
Council Agenda as New Business Item A. He stated that the other item
was a request for a change in the landscape for the fly ash site. Richards
reported that the iterm was continued by the Planning Commission to
explore utility issues and elevation.
B. Parks Commission: Councilmember McCornber reported that the last
meeting of the Parks Commission was on July 21 at Autumn I -fills Park.
She staged that there was a discussion about the fly ash site and Party in
the Park.
C. Cable Commission: Councilmember Doerr reported that the next meeting
of the Cable Commission is oil August 20 at 7:00 p.m. at the Access
Center.
D. Water Management Organizations /Middle St. Croix: Mayor Beaudet
reported that the next meeting of the Middle St. Croix Water Management
Organization is oil August 14 at 7:00 p.m. at the Washington Conservation
District Office.
E. Other Liaison /Staff Reports: Mayor Beaudet reported that he attended the
G.E.A.R.S. meeting oil July 21. He stated that Councilmember
McCornber was forwarded on as an applicant and that another candidate
was chosen.

III. Visitors /Public Comment:
Recvchm - Award: Administrative Secretary Thoen reported that Andy and Karen
King of 5675 Newell Circle North were chosen as the recycling award winners.

Councilmember Swenson, seconded by Councilmember McComber, moved to
approve the Consent agenda. Roll call vote taken. Carried 5 -0.

VII. New Business:
A. Amended Conditional Use Permit — Stillwater Motors: City Planner
Richards reported that the City received a request from the owners of
Stillwater Motors for an amended CUP. He reported that a Resolution
was passed in July 2005 for conditions 3 and 5. Richards reported that the
request is to extend the conditions for a five -year timeline until August 31,
2013. He reported there was no objection from the Planning Commission.
Councilmember Abrahamson, seconded by Councilmember McComber,
moved to approve the Resolution. Roll call vote taken. Carried 5 -0.
B. Consider Possible Suvreme Court Appeal Stemminz from Recent R.
Bracken Property Decision on Land Classification: City Attorney Vierlang
stated that his recommendation is to not pursue an appeal.

C. Avi)roval of Public Works Trucks Smcilications and Authorizations to
Order City Administrator Johnson stated that he net with Public Works
Director Oz ello. Ile stated that the specilcations for the new vellicle will
meet the needs of the department and that funding is aligned. Johnson
stated that staff recommends approval.
Councilmember Doerr noted that all vehicles need to have updated first
aid kits.
Councilmember Doerr, seconded by Councihnen Abrahamson, moved
to approve the public works truck specifications and authorization to
order. Carried 5 -0.
D. Secure Cost Estimates for `Villaee Area' %onina Amendments:
Councilmember McComber stated that she would like the Planning
Commission to look at the ordinances of other cities to see if they
accommodate residents in the event someone wants to build a shed or
second garage bay on a non - conforming lot. Mayor Beaudet suggested
that the City Planner write a memo to council with a cost estimate before
this goes to the Planning Commission.
Mayor Beaudet, seconded by Councilmember Swenson, moved to have
staff review the accessory building and submit back to council a memo of
areas where the City may make changes or may not. Councilmember
Swenson clarified that this is to include the entire city. Carried 5 -0.
VIII. Closed Session:
A. Annual Performance Review ---- City Administrator: Councilmember Doerr,
seconded by Councilmember Abrahamson, moved to postpone this item to
the first meeting in August since some councilmembers did not receive the
review form until that evening. Carried 5 -0.
IX. Adiournment:
Councilmember McComber, seconded by Councilmember Abrahamson, moved
to adjourn at 7:24 p.m.

As you are aware, the City Council, at their meeting on July 22, 2008, directed us to
provide a proposal to review the current standards for accessory buildings (Section
401.15.D) of the Zoning Ordinance. The purpose of the study would be to review
ordinances from other cities and possibly revise the regulations so that there is more
flexibility for property owners in allowing new or expanded accessory buildings,
especially in the older areas of Oak Park Heights.
We would propose to complete the study for a not to exceed fee of $1,750.00. This
would include the background research, drafting the ordinance amendment, and
working with the Planning Commission and City Council in the public hearing and
adoption process. All of the meetings related to the work would be billed to the City
under our monthly retainer. The breakdown of the estimate is as follows:

Xcel Energy has requested a timeline extension to the City's review of their Fly -ash site proposal, ( now
clarified to Dec 31 2008 ) . They have requested this timeline extension to allow additional time to
consider sanitary/ utility impacts and improvements as well as to more effectively engage and respond to
issues raised at the .July 31 community meeting, ( ENCLOSURE #1). Please see the enclosed letter from
Mr. Chuck Donkers from Xcel Energy citing reasoning for such timeline extension) .
Scott Richards has prepared a short analysis of the current timelines status which afford the City through
October 22, 2008 — ( ENCLOSURE #2); meaning the City Council should take action on the request not
later than the first City Council meeting in October ( the 14' ) . In essence, if the City were to grant the
full timeline extension, the City's final decision would not be needed until Dec 31 2008.
At this time, staff has been provided `Summary of Comments and Questions' ( ENCLOSURE #3 ) from
Xcel Energy hosted community meeting that lists the expressed concerns from the community as well as
how Xcel would offer to correct these.
At this time City Engineer Dennis Postler has prepared a short analysis ( ENCLOSURE #4) regarding
utility infrastructure and is recommending a reroute of sanitary utilities ( option 1 ) .
Recommendation: Staff at this time does not have an objection to extending the timelines as requested by
Xcel Energy as there may be items stemming from the community meeting that may not able to be
effectively considered under the current timelines. However, the current timelines do appear to be adequate
to fully review and finalize recommendations for utility infrastructure and possible park improvements. The
Council may also consider a mid -point between Oct 22 and Dec 3 €

As you are aware, Xcel Energy submitted a request for a 120 day extension of the
development timeline for the amended conditional use permit for expansions to the A.S.
King Ash Disposal Facility. The Planning Commission is currently in the process of
considering the request and the public hearing for the conditional use permit remains
open.
The application for the conditional use permit was received on June 6, 2008 and
deemed complete when the additional materials, as requested by the City, were
submitted by Xcel on June 25, 2008. On June 19, 2008, a letter was sent to Manuel
Castillo of Xcel increasing the 60 day review period of the City to 120 days. As a result,
the pertinent development timeline dates are as follows:
June 6, 2008: Application Submitted
June 19, 2008: Letter Sent to Xcel Extending Timeline to 120 Days
June 25, 2008: Application Deemed Complete
October 22, 2008: End of 120 Day Development Timeline
The City has until October 22, 2008 to make a final decision on the conditional use
permit for Xcel Energy. The letter received from Xcel requests to extend the timeline an
additional 120 days from October 22, 2008.
The City Council will consider this request from Xcel at their meeting on August 12,
2008, The City Council can determine whether to make a decision on the conditional
use permit by October 22, 2008, or accept the additional extension time offered by Xcel.

To Residents and Facility Neighbors,
On July 31, 2008, Xcel Energy hosted a public meeting to share information about their
existing landfill located in Oak Park Heights, MN. I wanted to lei you know our initial
response to your comments and will follow -up with an up -date in a few weeks.
1) As suggested at the meeting, we will install remote cameras at the landfill. The
cameras will allow us to audit facility operations and identify specific
environmental conditions, which lead to excessive fugitive dust. Random auditing
of security camera video will also be performed to ensure trucks are covered
when arriving and leaving as specified in our contract with the hauler.
2) We recently improved our inspections of the roadway for fugitive dust. Our
inspections now include periodically walking portions of the road to determined
when sweeping is required, and inspecting truck under carriages for residual ash,
which may subsequently fall off.
3) We have requested our trucking contractor to make equipment modifications to
limit the amount of ash coming in contact with the trucks' under carriage.
4) We will be establishing a phone number for you to call to report problems or
concerns, such as excessive dust or material on the roadway. if you call, please
identify the specific date and time the problem was observed to enable us to better
investigate and identify the cause.
5) We have requested a 120 -day extension regarding the city's Conditional Use
Permit decision. This time will be used to further evaluate and address public
concerns.
't'hese are our initial steps. Our preference is to resolve the root cause of the problem.
We are developing additional measures that may be implemented depending upon
inspection results.

We have reviewed several options for the existing trunk sanitary sewer under the Xcel Energy
Fly Ash Site. This memo provides details on the various options and their related costs.
Option 1 includes the installation of gravity sanitary sewer around the north side of the existing
fly ash pit and force main from the south. Construction would include a 15 hp lift station to
pump flows from the south half of the City. Existing sanitary sewer and structures in the fly ash
pit would be abandoned. This option would provide the City with a new, reliable trunk sewer
line, but would also add the maintenance of a lift station. Preliminary layout of this option can
be seen in Figure 1 (attached).
Option 2 is for tunneling a new sewer li ne through the fly ash pit parallel to the existing pipe.
The advantage would be that a casing pipe would be installed around the carrier pipe, allowing
for easier repairs in the future if need be. The disadvantages are that jacking pits would be
installed at each end of the tunneling, and possibly interim manhole locations, which would
disturb a large area of the existing fill and lining of the fly ash pit. Also, means and methods of
tunneling through the sedimented fly ash would need to be explored further.
Option 3 includes costs for installation of a cured -in -place pipe lining in the existing trunk
sewer lines. CIPP lining is designed to act as stand -alone pipe. Lining the sewer does not
necessarily provide additional strength, but if the existing RCP sewer were to fail, the pipe
would gain the strength of the underlying CIPP, Pipe lining also slightly decreases the capacity
of the pipe, but CIPP lining would provide for a smoother flow than the existing RCP, Because
�CIPP lining is typically used for pipe repair and rehabilitation, more research would be necessary
r„ � to determine the exact effect of lining a pipe that is currently in good condition if this option
l! was chosen.

The City also has the option of doing nothing at this point. Some of the existing pipe has had
40 to 70 Feet of fill on it for almost twenty years. From soil borings taken by Braun Intertec in
1984, the fly ash pit has limestone bedrock under the fill so long term settlement is not likely to
occur. If the City chooses not to proceed with an alternate sewer plan at this time, televising
and inspection of the existing sanitary and storm sewer should be completed to document the
existing conditions. Costs for this are shown above under Option 4. Additionally, escrow
money should be provided to the City by Xcel to cover the cost of the potential future sewer
installation.
Existing trunk storm sewer also runs under the existing fly ash fill site, and under or adjacent to
the proposed additional fill area. Although relocating the storm sewer is not being analyzed or
recommended at this time, the City should have an agreement with Xcel Energy whereby they
would be responsible for any future pipe failure attributable to the additional fill loading.
