The variance re is the minimum variance necessar to accomplish the intended purpose of the applicant. h. The re does not create an inconvenience to nei properties and uses. Staff recommends allowin the p si to be increased to a total of 310 s feet and to allow 520 s feet of total si for Kowalski's. The Cit has, in the past, 14 g ranted variances to Rainbow, Kowalski's, and E Life to allow additional size and number of si to address the lack of visibilit of the shoppin center. The overpass of Hi 36 and 5 provides a si visible barrier for businesses in this shoppin center, thus j ustif y in g the increase in si area. Based upon the precedin review, Cit staff recommends the variance re be approved for the Oak Park Ponds Shoppin Center and Kowalski's Market based upon the findin that the shoppin center visibilit is compromised b the overpass of Hi 36 and 5, with the followin conditions: The area identification p si shall be allowed to be increased in size to a maximum of 310 s feet and contain individual tenant identification. 2. The p si shall not exceed a total hei of 35 feet. 3. Kowalski's Market shall be permitted to have up to a total of 520 s feet of wall and freestandin si 4. All si panels shall be lit in accordance with the Zonin Ordinance si 4 provisions includin the re that si with internal li shall include illumination of onl the text and/or lo portion of the messa N A RECOMMENDING RESOLUTION OF THE PLANNING COMMISSION CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA WHEREAS, the Cit of Oak Park Hei has received a re from United Properties for si variances to allow an increase in overall p si area for the Oak Park A Of Ponds Shoppin Center and an increase M* the allowable si area for Kowalski's Market at 5 801 Neal Avenue North and after havin conducted a public, hearin relative thereto, the Plannin Commission of Oak Park Hei makes the followin findin of fact: follows, to wit: 1. The applicant has submitted an application and supportin documentation to the Communit Development Department consistin of the followin items,, SEE ATTACHMENT B 3. The subject propert is zoned PUD, Planned Unit Development in which the retail sales operations are a permitted use for the propert and 4. The si variances have been re to allow the Oak Park Ponds p si to be increased to a total of 31 o s feet and to allow a total of 520 s feet of total si for Kowalski's. Under Section 401.15.G, Si of the Zonin Ordinance, the p si would be limited to 200 s feet and Kowalski's a total of 500 s feet of allowable si 5. Cit staff prepared a preliminar report dated October 6, 2005 reviewin the re for the si variances; and 6. The October 6, 2005 planning report recommended approval of the sign variances subj ect to the fulfillment of conditions; and 7. The Planning Cornrnission held a public hearing at their October 13, 2005 meeting, took comments from the applicants and public, closed the public hearing, and made the following recommendation: NOW, THEREFORE., DE IT RESOLVED BY THE PLANNING COMMISSION FOR THE CITY OF OAK PARK HEIGHT'S THAT THE PLANNING COMMISSION RECOMMENDS THE FOLLOWING: A. The application submitted by United Properties for sign variances to allow an increase in overall pylon sign area for the Oak park Ponds Shopping Center and an increase in the allowable sign area for Kowalski.'s Market at 5801 Neal Avenue North and affecting the real property as follows: SEE ATTACHMENT A Be and the sane as hereby recommended to the City Council of the City of Oak Park Heights for approval With the following findings of fact: l . The application requests an increase in allowable signage from 200 square feet to 310 square feet for the Oak Park Ponds Shopping Center pylon sign. 2. The application requests an increase in allowable signage from 500 to 520 square feet for Kowal ski's Market. 3. The overpass of Highway 36 and Highway 5 provides a significant visibility barer for businesses in Oak Park Ponds Shopping Center, resulting in a hardship for advertising in this location. The motion for approval was recommended by the Planning Commission of the City of Oak Park Heights With the following conditions: 1. The Oak Park Ponds area identification pyl on sign shall be allowed to be increased in size to a maximum of 310 square feet and contain individual tenant identification.. 2. The pylon sign shall not exceed a total height of 35 feet. 3. Kowal.skl's Market shall be permitted to have up to a total of 520 square feet of gall and freestanding signage. ftttv CITY COUNCIL CITE' of OAK P HEIGHTS WASHINGTON COUNTY, MINNESOTA WHEREAS, the City of Oak Park Heights has received a request from United Properties for sign variances to allow an increase m overall pylon sign area for the Oak Park Ponds Shopping Center and an increase in the allowable sign area for Kowalski's Market at 5801 Deal .Avenue Forth; and after having conducted a public hearing relative thereto, the Planning Conunission of Oak Park Heights recommended that the request be approved with conditions. The City Council makes the following findings of fact and resolution: follows, to wit: 1. The real property affected by said application is legally described as SEE ATTACHMENT A 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items; and SEE ATTACHMENT B 3. The subject property is zoned PU3, Planned Unit Development Mn which the retail sales operations are a permitted use for the property, and 4. The sign variances have been requested to allow the Oak Park Ponds pylon sign to be increased to a total of 310 square feet and to allow a total of 520 square feet of total signage for Kowalski's. Under Section 40 1.15.x-, Signs of the Zoning ordinance, the pylon sign would be limited to 200 square feet and Kowalski's a total of 500 square feet of allowable signage; 5, City staff prepared a prelm`m'ary report dated October 6, 2005 reviewing the request for the sign variances; and 6. The October 6, 2005 planing report recommended approval of the sign variances subject to the fulfillment of conditions; and 7. The Plann* g Commission held a public hearing at their October 13, 2005 meeting, took comments from the applicants and public, closed the public hearing, and recommended that the request be approved with conditions. NOW, THEREFORE, E IT RESOLVED BY THE CITY COUNCIL FOR THE CI'T'Y OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE FOLLOWING: A. All sign panels shall be lit in accordance with the Zoning ordinance sign provisions including the regwrernent that signs with internal lighting shall *include illumination of only the text and/or logo portion of the message.
