RE: Oak Park Heights - Brad Swager Variance Request
Dear Mark:
Per our discussion today, I am forwarding information pertaining to the Brad
Swager variance request for a five foot modification of the ten foot side yard
requirement. From the perspective of the situation as now exists, it is more of
a legal matter than a planning matter.
From our perspective there is absolutely no justification for the request on any
grounds. The only problem being of course is that the building is already existing
and is to our understanding occupied. Again, however, this inour opinion is
not justification to allow the variance and additionally, if granted would appear
to open the door for "forced" acceptance of future "mistakes".
With this transmittal, we are dropping further action on the matter unless assistance
is requested by your office.

RE: Brad Swager and Rasmusson Variance Requests
Dear Mark:
While discussing the two variances referenced above with staff, it occurred
to me that there is absolutely no basis for two setback problems to exist.
Swagers should have known that the two houses had to be at minimum twenty
feet from each other. Even if they were uncertain of the lot line location,
they should have known of the required minimum distance between structures.
Good luck in pushing enforcement of this situation. Again, if we can be of
assistance, please let me know.
