MINUTES OF MEETING HELD MONDAY, JULY 8, 1991
Call to order by Mayor O'Neal at 7:00 p.m. Present: Carufel,
Kern, Seggelke, Vierling and Wilson. Absent: Doerr.
Clerk read public hearing notice, presented affidavit of
publication and mailing list for variance request submitted by
Francis Petersen. Mayor called for comments and discussion
ensued. Carufel, seconded by Kern, moved to close hearing. 4
aye votes. Hearing closed.
Seggelke, seconded by Kern, moved to approve above request due to
topography and corner lot restrictions. 4 aye votes. Carried.
Seggelke, seconded by Carufel, moved to hire Brian Nelson as part
time summer employee at $4.50 per hour. 4 aye votes. Carried.
Kern, seconded by Carufel, moved to approve minutes of June 10th,
24th and 27th as presented. 4 aye votes. Carried.
Seggelke, seconded by Kern, moved to approve Request #L4791 and
#47150 submitted by US West Communications. 4 aye votes.
Carried.
Seggelke, seconded by Kern, moved to approve Finance Officer's
attendance to MGFOA in Alexandria, September 17th through 19th.
4 aye votes. Carried.
Kern, seconded by Seggelke, moved to adopt Resolution #91 -07 -36
approving receiving preliminary report and calling for a public
hearing on water and sewer extension improvements of 1991.
Hearing scheduled for Monday, July 22, 1991 at 7:00 p.m. Roll
call vote taken with 4 aye votes cast. Resolution adopted.
Seggelke, seconded by Carufel, moved to approve payment of bills
as presented and Treasurer's report. 4 aye votes. Carried.
Carufel, seconded by Seggelke, moved to adjourn. 4 aye votes.
Adjourned at 7:32 p.m.

ZONING ORDINANCE VARIANCE
1. Variance. Subject to the terms and conditions set
forth herein, the City of Oak Park Heights hereby grants a
zoning ordinance variance for:
FRANCIS L. PETERSEN, JR.
TO CONSTRUCT GARAGE WITHIN 20 FEET OF 56TH STREET CIRCLE N.
CURRENT SETBACK IS 30 FEET. VARIANCE OF 10 FEET REQUESTED.
2. Property. The variance is for the following described
property in the City of Oak Park Heights, Washington County,
Minnesota:
14878 N 56TH ST. - LOT 9, BLOCK 1, BREKKE HEIGHTS #2 ADDITION
3. Conditions. The variance is issued subject to the
following conditions:
NONE.
4. Termination of Variance. The City may revoke the variance following a
public hearing under any of the following circumstances: material change of
condition of the neighborhood where the use is located, violation of the terms of
the permit. The variance is automatically terminated if not utilized within one
year of the date of City Council approval.
5. Criminal Penalty. Violation of the term of this zoning variance is a
criminal misdemeanor.

'QUESTION C. THE REQUESTED VARIANCE IS FOR A REDUCTION IN THE ROAD SET BACK ON
56TH ST CIRCLE N. THE CURRENT SET BACK IS 30 FEET. I AM REQUESTING A
10 FOOT REDUCTION, OR A 20 FOOT SET BACK FROM THE STREET. THE
MAJOR PROBLEM IN CONSTRUCTING A GARAGE ON MY PROPRTY IS, THE PROPOSED
LOCATION OF A DETACHED GARAGE HAS TO BE AT LEAST FIVE FEET FROM ANY
OTHER STRUCTURE. WITHOUT A VARIANCE, THE LARGEST BUILDING I WOULD
BE ABLE TO BUILD IS ONLY 15 FEET WIDE. THE PRESEBT CONTOUR OF THE
LOT DOES NOT ALLOW FOR BUILDING ANYTHING BEHIND THE HOUSE.

SIDE OR EAST.
QUESTION E. i would like to build a two car garage on my property. THIS VARIANCE
WOULD CHANGE THE LAY OUT AND CHARACTERISTICS OF THE LOT THE LEAST.

to rebuild existing telephone manholes and conduit. 5 aye votes.

submitted by Francis Petersen. 5 aye votes. Carried.
Doerr, seconded by Seggelke, moved to approve widening of
Northbrook Boulevard at a cost of $1300.00 with monies to be
expended from Contingency Fund. 5 aye votes. Carried.
Doerr, seconded by Carufel, moved to submit statement for
retaining wall repair to insurance company and pay balance from
water fund. 5 aye votes. Carried.
Doerr, seconded by Kern, moved to approve payments of bills and
investments as presented. Details available at clerk's office.
