Mayor Beaudet, seconded by Councilmember Swenson, moved to approve
the Resolution for sewer rate increase. Roll call taken. Carried 5 -0.

Oak Park Heights — Oak Park Senior Living Phase 1— Planned Unit
Development Amendment: City Planner Richards reported that the
application was for a PUD amendment for Phase 1. He stated the original
plan was for 59 units, and the amendment was for 134 units.
Mayor Beaudet, seconded by Councilmember Abrahamson, moved to put
Resolution before the council.
Mayor Beaudet, seconded by Councilmember Swenson, moved to amend
Condition #7 of the Resolution that the setback match the setback of the
existing four -story building.
Tim Noldc, developer, came forward and stated that to increase density,
plans would change because they would have to shorten the building.
Starr Frost of 5555 Novak Avenue North carne forward and stated that the
City Council should not allow a zero foot setback for a four -story
building. She was concerned about privacy for the residents if the
sidewalk was right next to the facility. Steve Frost of 5555 Novak Avenue
North came forward and stated he did not think four -story buildings were
appropriate for that area with no setback.
Amendment motion carried 5 -0.
Amy Brown of 13898 56 Street North requested that the City Council
think long -term about how the high- density housing would impact the
area.
Mayor Beaudet stated he was concerned about the lack of surface parking.
City Planner Richards stated they could be required to do proof -of- parking
spaces, but that would take away green space. Todd Erickson, project
engineer, carne forward and stated the plan was over the requirement for
parking. City Planner Richards stated a solution could be that a condition
be added to the Resolution that the developer work with Lowe's for
parking. Councilmember Runk stated he did not think parking would be
an issue because he has observed that it was not a problem at Boutwells
Landing. He stated he did not want to sacrifice any green - space for
parking. Mayor Beaudet stated he did not want to lose any green space
either and suggested that maybe the number of units could be reduced to
create more parking and green space.

Mayor Beaudet moved to amend to reduce overall density from 134 units
to 118 units. Motion failed per lack of a second.
Mayor Beaudet requested staff develop language to set forth penalties if
there were residents living there who were not seniors.
Mayor Beaudet requested that the Parks Commission review the trails and
provide comments. City Administrator Johnson stated the Parks
Commission has a Special Parks Commission meeting on December 12
and could add that to their Agenda.
City Administrator Johnson requested "with the addition of a closet" be
deleted from Condition 18 of the Resolution.
Mayor Beaudet requested staff develop language that utility equipment
ancillary to the building such as the makeup air unit be located within the

building or screened on the roof.
Councilmembers Runk and Swenson and Mayor 13eaudet requested staff
get a recommendation from the Fire Chief on fire truck passage into the
site.
Mayor Beaudet suggested the developer come back with plans with
reduced density. Councilmember Swenson suggested the developer
reduce 50 units.
Mayor Beaudet, seconded by Councilmember Abrahamson, moved to
amend the Resolution to adopt the setback requirement and all other issues
listed above and come back with it at the next City Council meeting.
Carried 5 -0.
D. Oak Park Heights — Oak Park Senior Living Phase 11— Planned Unit
Development Amendment: Mayor Beaudet, seconded by Councilmember
Swenson, moved to postpone review of that development to the next
meeting and have staff put the same conditions as mentioned under the
discussion of Phase I with the exception of the setback, and reduce
density, and develop language for end of building life. Carried 5 -0.
