Suite 100 Anoka, MN 55303 Phone: 763.231.5840 Facsimile: 763.427.0520 TPC@PlanningCo.com PLANNING REPORT TO: Eric Johnson FROM: Scott Richards DATE: December 8, 2011 RE: Oak Park Heights — Oak Park Senior Living Phase II - Planned Unit Development Amendment - City Council TPC FILE: 236.02 —11.07 The City Council, at their November 29, 2011 meeting reviewed the Oak Park Senior Living Phase II application for amending the Carriage House CO -OP Planned Unit Development (PUD) to allow for an increase in the density and building height. The project is at Oakgreen Avenue and 58 Street. Attached for reference: Exhibit 1: Revised Site Plan /Landscape Plan - December 7, 2011 (AS1) Exhibit 2: Layout Planfrraffic /Parking Plan - Phase II Exhibit 3: Perspective Views - Building 4 Exhibit 4 Oakgreen Village Concept Plan - March 2006 Exhibit 5 Oakgreen Village General Plan - May 2006 Exhibit (o Carriage House CO -OP /Oakgreen Commons - May 2009 Tim Nolde has provided revised plans that decrease the number of units from 96 to a total of 88. The revised plans indicate that a portion of the building along the elevation that faces 58 Street will be two stories. The corner of the building and the elevation facing Oakgreen Avenue will remain at three stories. The plan approved in 2009 had a total of 48 units in a two story building. The units now proposed with this amendment are as follows: Building 4 88 (96 previously) Page 84 of 136 Parking. The parking layout for the project has been revised slightly. The number of surface parking stalls was reduced by four and the number of underground stalls remains at 98. A review of the revised layout parking is as follows: Building Surface Stalls Underground Stalls Building 4 62 98 CONCLUSION / RECOMMENDATION The City Council must review the changes made by Mr. Nolde and determine if the project density, the setbacks, the parking and building design is appropriate for the area. A revised City Council resolution is attached for consideration. The following conditions have been amended since the meeting on November 29, 2011. 3. The development agreement shall include provisions enforcing Developer's assurances that the Oak Park Senior Living Phase I will remain as senior rental housing and shall not be converted to non age restricted rental housing. Reasonable security in the form of escrows, tax increment forfeitures, permit suspension and other consequences for default of this provision by the Developer or its transferees and assigns shall be imputed into the development contract and be subject to the approval of the City Attorney. 4. The Park Commission shall provide a recommendation on the proposed private and public trail system subject to the approval of the City Council. 5. The setback for Building 4 shall be at least 30 feet from the right of way line of Oakgreen Avenue and 58 Street North. 9. The City Council was favorable to the non shielded, residential style light fixtures on the building. 11. The projected traffic counts are subject to review and approval of the City Engineer. If the intersection at 58 Street and Oakgreen Avenue requires signalization or other traffic control measures, the applicant shall agree to the share of the costs as outlined in the Development Agreement and as determined by the City Council. 12. The Fire Marshal and Police Chief shall review the plans and determine the accessibility of emergency vehicles throughout the development. The Fire Marshal and City Engineer shall determine if the entrances onto Nova Scotia Avenue should be widened to allow for better accessibility of fire equipment. • • 2 Page 63 of 136 14. A revised snow storage area plan shall be provided to the City by January 31, 2012 subject to review and approval of the City Engineer. 15. All air handling vents or condensers shall be installed in the building or placed on the roof and totally screened subject to approval of the Building Official. Any electrical or gas equipment and transformers that are ground mounted or visible from adjacent streets shall be screened as required by the Zoning Ordinance. 17. The den rooms in the dwelling units shall not be converted to bedrooms. 22. The sidewalk connection plan for the first floor units of Building 4 shall be subject to City Council review and approval. 23. The City Council approves Phase 11 of Oak Park Senior Living with a total of 88 units in the brownstone building. 24. Phase II consisting of Buildings 4 shall be completed by the applicant and ready for occupancy no later than December 31, 2014 unless extended by the City Council. 25. The applicant shall provide to the City payment in lieu of taxes if the properties subject to this approval are converted to a tax exempt status as provided for within the Development Agreement. 26. The project shall be subject to an annual inspection and review at the discretion of the City to ensure compliance with the conditions of Planned Unit Development approval and the Development Agreement. 27. The City Council of the City of Oa(k Park Heights makes • the following findings of fact and resolution: 1. The real property affected by said application is legally described as follows, to wit: SEE ATTACHMENT A and—. 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B and 3. The property was approved by the City Council for a Planned Unit Development, general plan by the City Council on June 9, 2009; and 4. The Carriage House CO -OP was approved with 48 units in one, two story building; and 5. The Planned Unit Development amendment for Oak Park Senior Phase II includes a total of 88 units in one, three story building; and Page 98 of 136 6. The building is proposed with setbacks of 30 feet to the right of way of Oakgreen Avenue and a building height of 38 feet; and 7. City Staff prepared a planning report dated November 3, 2011 reviewing the request; and 8. Said report recommended approval of the amended Planned Unit Development subject to the fulfillment of conditions; and 9. The Planning Commission held a public hearing at their November 10, 2011 meeting, took comments from the applicants and public, closed the public hearing, and recommended that the application be approved with conditions. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE FOLLOWING: A. The application submitted for a Planned Unit Development amendment as it relates to the Oak Park Senior Living Phase II (formerly Carriage House CO -OP) allowing an increase in the density and building height at Oakgreen Avenue and 58` Street North and affecting the real property as follows: SEE ATTACHMENT A Be and the same as hereby approved by.the City Council of the City of Oak Park Heights with the following conditions: 1. The City Council directs that the Proposed Land Use Map should be re- designated from medium density to high density residential in the Comprehensive Plan. 2. The City Council was favorable to the proposed density of the project. 3. The development agreement shall include provisions enforcing Developer's assurances that the Oak Park Senior Living Phase I will remain as senior rental housing and shall not be converted to non age restricted rental housing. Reasonable security in the form of escrows, tax increment forfeitures, permit suspension and other consequences for default of this provision by the Developer or its transferees and assigns shall be imputed into the development contract and be subject to the approval of the City Attorney. 4. The Park Commission shall provide a recommendation on the proposed private and public trail system subject to the approval of the City Council. 5. The setback for Building 4 shall be at least 30 feet from the right of way line of Oakgreen Avenue and 58 Street North.. 2 Page 99 of 136 6. All tree removal and landscape plans shall be subject to review and approval of the City Arborist. 7. The grading and drainage plans shall be subject to City Engineer and applicable • watershed authority review and approval. 8. All utility plans shall be subject to review and approval of the City Engineer. 9. The City Council was favorable to the non shielded, residential style light fixtures on the building. 10. The applicant shall submit any plans for new signage subject to City approval. 11. The projected traffic counts are subject to review and approval of the City Engineer. If the intersection at 58` Street and Oakgreen Avenue requires signalization or other traffic control measures, the applicant shall agree to the share of the costs as outlined in the Development Agreement and as determined by the City Council. 12. The Fire Marshal and Police Chief shall review the plans and determine the accessibility of emergency vehicles throughout the development. The Fire Marshal and City Engineer shall determine if the entrances onto Nova Scotia Avenue should -be widened to allow for better accessibility of fire equipment. 13. The trails and sidewalks shall be constructed in accordance with the City Engineer's review and approvals. 14. A revised snow storage area plan shall be provided to the City by January 31, 2012 subject to review and approval of the City Engineer. 15. All air handling vents or condensers shall be installed in the building or placed on the roof and totally screened subject to approval of the Building Official. Any electrical or gas equipment and transformers that are ground mounted or visible from adjacent streets shall be screened as required by the Zoning Ordinance. 16. The City Council was favorable to the 38 foot height of Building 4 as part of the PUD approvals. 17. The den rooms in the dwelling units shall not be converted to bedrooms. 18. The City Council was favorable to the final building appearance, colors, materials and the variety between buildings. The applicant shall provide a materials board for the building subject to review and approval of the City Council. 3 Page 100 of 136 19. "I'he development agreement shall include. a requirement that all of the buildings he maintained in proper condition and in compliance with City Codes. 20. The applicant shall be required to enter into a development agreement. The development agreement shall be subject to the review and approval of the City Attorney and City Council. 21. The applicant shall provide additional details for the private park area including elevations of the gazebo, materials to be used in the structures and walkways, and landscaping details for review and approval of the City Council. 22. The sidewalk connection plan for the first floor units of Building 4 shall be subject to City Council review and approval. 23. The City Council approves Phase II of Oak Park Senior Living with a total of 88 units in the brownstone building. 24. Phase II consisting of Buildings 4 shall be completed by the applicant and ready for occupancy no later than December 31, 2014 unless extended by the City Council. 25. The applicant shall provide to the City payment in lieu of taxes if the properties subject to this approval are converted to a tax exempt status as provided for within the Development Agreement. 26. The project shall be subject to an annual inspection and review at the discretion of the City to ensure compliance with the conditions of Planned .Unit Development approval and the Development Agreement. 27. Parking shall be allowed on only one side of the private roadway system in the development, subject to review and approval of the City Engineer.
