Randy 'Flloreson of l 4436 Upper 56 "' Street Court North came forward and provided the:. City Council with a letter lie prepared, I -le was concerned that transferring the utility bill to the property tuxes would impact those with escrow accounts on their mortgage. A resident who identified himself as Rudy came forward and commended the City Council on their work on this issue. He stated it was evident that the City Council put a lot of work into it, and Ile hoped it was sustainable. Ruth F"aston of 5853 Oakgreen Court North questioned why her property taxes increased 16 percent. Mayor Beaudet stated lie suspected that her property value did not decrease as much as the average. Finance Director Caruso added that the total property tax increase included other• districts such as the school district and the COUIlty, Lori Bclz, a resident who lives in a condominium, came forward and stated that because she was part of a condominium association, she would not see the full benefit of the tax credit if the utility bill was placed oil the property taxes. Steve uralllquist, president of Sunlluit Park Condominium Association, came forward and stated that there was only one meter per building, so they would not see the full bcnelit of the tax credit. I-ie suggested that the City Council consider raising the number of gallons that were covered in the lowest tier of the water rate structure. He stated lie did not care if the utility bill was transferred to the property taxes as loin; as it was equitable for everyone. Mayor Beaudet, seconded by C;'ouncilnaeniber Abrahamson, moved to put Resolution before the council. Mayor Beaudet, seconded by Councilmember Swenson, moved to amend Condition #7 of the Resolution that the; setback match the setback of the existing lour -story building, Tim Nolde, developer, came forward acid stated that to ilicrease density, plans would change because they would have to shorten the building. Starr Frost of 5555 Novak Avenue North calve forward and stated that the City COU11cil should not allow a ;zero moot setback for a four- stony building. She was concerned about privacy for the residents if the sidewalk was right neat to the facility. Steve Frost of 5555 Novak Avenue North came forward and stated lie (lid not think fur -story buildings were appropriate for that area with no setback. Amendment motion carried 5 -0. Amy Brown of 13898 56 "' Street North requested that the City Csouliesl think long -terns about how the high- density lsousilig would impact the az•ea. Mayor Beaudet stated tie was concerned about the lack of surface parking. City Planner Richards stated they could be required to do proof-of-parking spaces, but that would take away green space. Todd Erickson, project engineer, came forward and stated the plan was over the requirement ;for parking. City Planner Richards stated a solution could be that a condition be added to the Resolution that the developer work with Lowe's for parking. Councilmember Runk stated lie slid not think parkilig; Avould be an issue because he has observed that it was not a problem at BolFtwell3 Landing. He stated lie did not waist to sacs•ifice any gi space for parking. These charges need to be adjusted from time to time to recover additional costs incurred as a result of inflation, capitalized interest, or revisions /updates to trunk facilities, The table on the following page is a tabulation of the current area charges and those proposed for development initiated after January 1, 2012. Adjustments to the City's utility area charges are tied to the national Construction Cost Index (CCI), which is a benchmark of the current cost of materials and labor in the construction industry, The City's utility area charges were last updated in November 2010, Since that time, the CCI has increased 3.2 %, which is the current increase we are recommending to the City's area charges. CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING AREA CHARGES THROUGHOUT THE CITY Or OAK PARK HEIGHTS FOR CONNECTIONS TO MUNICIPAL WA'T'ER SYSTEMS, SANI'T'ARY SEWER SYS'T'EMS AND STORM SEWER SYS'T'EMS WHEREAS, Minn. Stat. §444.075, Subd. 3 authorizes municipalities to establish a system of charges for the construction, reconstruction, repair, enlargement, improvemew or 011ie] Obtainment, maintenance operation and use of municipal facilities, including, but not limited to charges for connections to such municipal facilities for municipal rvater, sanitary sewer, and storm sewer; and, WHEREAS, City ordinances provide for the Council to establish from time to time area charges to be collected for properties developing in and cminecting to the municipal water, sanitary sewer and storm sewer systems; and, WHEREAS, the City has historically established and collected area charges; and, WHEREAS, area charges established by the City of Oak Park Heights require modification and amendment from time to time; aa)d, WHEREAS, the office of the City Engineer has provided recommendations to the City Council as it affects the establishment of area charges throughout the City of Oak Park Heights as it relates to connection to trunk sanitary sewer systems, trunk water systems and trunk storm sewer systems; and, WHEREAS, the City Council determines it to be in the best interest of the residents and City of Oak Park Heights that such fees be periodically reviewed and adjusted to take into account cast: of construction and replacement and systems, cost of maintenance operation and other expenses that the City expects to incur with regard to the maintenance of such systems. NOW, THEREFORE, BE TT RESOLVED, by the City Council for the City of Oak Park Heights that effective ,January 1, 2010 city area charges to be applied throughout the City of Oak Park Heights for properties developing or connecting to municipal utilities shall be as follows: 1. Sanitary sewer area charge as follows: Commercial/Industrial & Retail Business Centers - .x;2,235.00 per acre. Low Density Residential - $2,132.00 per acre. Medium Density Residential - $2,844.00 per acre. High Density Residential - $4,976.00 per acre. Page 20 of 136 2. Page 3a*1av Karges- Fauiconbridge, Inc. 1- Meers Introduction Karges- Faulconbridge, Inc. was commissioned to investigate the geothermal heat pump issues at the Oak Park Heights City Hall located at 14168 Oak Park Boulevard North in Oak Park Heights, MN. Through site investigation, document review, and calculations of these systems, KF1 has developed this report which documents the potential issues in the systems. There are (4) water -to -water Beat pumps manufactured by GeoFurnace Mfg, Inc and installed to serve the majority of the heating and cooling requirements of the facility. There are (2) MW180 - 1S ton units and (2) MW240 — 2.0 tan units. The 15 ton units are labeled as HP -1 and HP -4 and these units are the primary heating and cooling units. The 20 ton units switch from heating to cooling when required to meet the demand. Since the startup of the geothermal heat pump system in the spring of 201.0, there have been multiple compressor failures in HP -1 and HP -4. Three (8) compressors have already been replaced and one (1) other compressor in HP - needs replacement. The following systems have been investigated to find out why these compressors have Mailed. • Electrical System • Equipment Manufacturing Defects • Temperature Controls • Geothermal Well Field Sizing • Heat Pump Equipment Sizing a Hydronic Flows Electrical System The electrical system has been analyzed by Emanuelson -Podas Consulting Engineers in September 2011, and they could find no issues with the electrical system that could be causing the compressor failures. The power factor readings were low, but a low power factor would 670 W. Equipment Manufacturing Defects The Geofurnace heat pumps have had several reported issues including a non - functional reversing valve that was replaced. The heat pumps have Danfoss compressors, but on past projects, we have seen as many failures with Copeland compressors as with DanFoss compressors. The manufacturer is not in business any longer, but did provide a three (3) year warranty on refrigeration components including compressors per the shop drawings. Temperature Control Shop Drawings The temperature control shop drawings show very little for controls or sequencing of the heat pumps. Items to be verified include the heating set points as several times the control shop drawings state 1257 and 130 °F supply water temperatures. I believe the heating setpoint is 115 °F. Also, the valve schedule included in the shop drawings does [lot show the flow (GPM) for the 3 -way butterfly valves for the heat pumps. Since recently gaining remote access to the system, the temperature control system shows several alarms from the past few months that should be investigated, Geothermal Well Field Sizing The geothermal well field has 104 bores which equates to 104 tons assuming each bore is approximately 1 ton. The field has more than enough capacity as the total connected equipment only is 80 tons of capacity. On November 21, 2011, the well field temperatures were 60 °F entering the well field and 58 leaving the well field. The pressure on the hydronic system was 68 psi (157 ft hd) to the well field and 25 psi (58 ft hd) coming back to the building. The hydronic pumps (P -3 and P-4) were sized for 330 GPM at 150 ft hd. The Test & Balance report shows the flows set at 167.35 GPM at 60.06 ft hd with the VFD at 36.3 Hz as the users only added up to 168 GPM. The pumps are operating at 100% currently and developing 100 ft hd across the well field. 2 Page 35 of 136 Heat Pump Equipment Sizing The heat pumps are sized adequately to provide staging with dual compressors in each unit to prevent over cycling. On site on November 21, 2011, the HP -1 was cycling one compressor in heating mode. All other heat pumps were off. Hydronic Plows As discussed previously, the source and load flows though the heat pumps as stated in the Heat Pump Schedules shown on the M7.1 included in the construction drawings and Test &Balance report do not match the flows required by the heat pump shop drawings. Page 18 of the Test & Balance report shows the flows through HP -1 and HP -4 at (2) 13.5 GPM. HP -2 and HP -3 flows are set at (2) at 23.0 GPM. It is not clear if these are flows through the load and source side or just the heating and cooling load side. The shop drawings state the source flow through HP -1 and HP -4 should be a minimum of 36 GPM. I would recommend that the higher flow of 45 GPM be used. The load flow in either heating or cooling should be 45 GPM. For HP -2 and HP -3, the shop drawings state a minimum of 4.8 GPM for the source flow. I recommend using the higher flows at 60 GPM. The load flow in either heating or cooling should be 60 GPM. From this initial review, it appears the current flows for both the source and load sides do not meet the minimum requirements for these heat pumps and this led to the early compressor failures. In I-fouse Pressure Reducing Valves As it happens, Sunny Side and the village area are within the same water pressure zone, but differ greatly in water pressure provided at any given individual service. This is due to diff.'erences in elevations as well as pl acemen t of pressure reducing valves between the two areas. "Typical water pressure in the village area is roughly 55psi whereas typical water pressure at the Sunny Side Condo's is 89psi, Although only 20 psi is required For fire protection (with a 6" service line) the Department of Health recornmends maintaining system pressure of no less than 35 psi with a normal operating pressure of 60psi. Water pressure is extremely hard to perfect as individuals tend to prefer different "ideal" pressure. At the November 15" Council meeting the Council directed staff to investigate the impact of placing individual in line pressure reducing valves in the Sunny Side area, Staff completed some preliminary investigation by sending ou t a survey to Sunny Side area residents and researched the number of pressure reducing valves that would be required if adjustments were made to increase pressure in the village area. The City received a 21% response from the survey. Three questions were asked to find out 1. How residents deemed the overall quality of water in 01 2. How residents deemed the water pressure, 3. Whether or not the resident currently has an inline water pressure reducing valve. TR EE CITY U.S.A. RE Page 48 of 136 One hundred percent of the respondents feel that the overall quality of water meets expectations. When asked about water pressure, 82% of the respondents feel the water pressure, is just right, while 12% believe the pressure is too low and G% believe the pressure is too ]high. When the residents of Sunny Side were asked whether or not they knew if a pressure reducing valve wa installed on their service line 76% of the respondents were unsure, 1 8% checked no and t% responded yes. Research of the Sunny Side units plus a handful of other area residents or cornmercial. properties illustrated that an estimated thirty one (3 1) individual pressure reducing valves would need to be purchased and installed if pressure adjustmmts were made. if the City were to purchase the valves, the estimated expense would be in the $1 0,100 range, excluding installation costs. A more derailed investigation and request for quotes would be,; necessary to do'terrnine exact num bers, If the valves are purchased and placed, the maximurn operating pressure will be 75psi at individual services. Services that require valves 1.5" or larger will have the option to sett the water plessure according to prefe ence; however maintenance such as changing the interior disc �Illd gaskets as Ihecessary is required oil pressure reducing valves. if Illaintenance is not performed, the valves simply don't work. Site Plan /Landscape Plan - December 7, 2011 (AS1) Exhibit 2: Master Plan - Phase Exhibit 3: Oakgreen Village Concept Plan - March 2006 Exhibit 4: Oakgreen Village General Plan - May 2006 Exhibit 5: Carriage House CO-OP /Oakgreen Commons - May 2009 Tim Nolde has provided revised plans that decrease the number of units to a total of 19 townhouse units and a total of 107 units in the three brownstone buildings. The previous plan had a total of 134 units. The four plex at the north edge of the property and adjacent to Nova Scotia Avenue North has been eliminated. Building 1 has been reduced four units to a total of 22 units and a setback of 20 feet to the right of way of Nova Scotia Avenue North has been established, The units now proposed with this amendment are as follows: One level townhomes (7 constructed) 11 dwelling units Multi level townhomes (4 constructed) 8 Building 1 22 Page 62 of 136 Parking. The parking layout for the project has been revised slightly. The number of surface parking stalls was reduced by four and the number of underground stalls remains at 98. As Joel Gustafson mentioned the controller is running free (not in time of day sync) with the Hwy 5 & 58' St, intersection, due to his reporting of a issue with the controller. The controller currently used by MNDOT is the ASC3-21.00, which is on the state contract (440015) for $2,525.00. The ASC3 is the latest in controller technology and other Cities in Washington County have been upgrading to these controllers, which allow them to have the timing data backed up on a data key and allows for less downtime should the old controller fail, The new controller is compatible with the MNDOT closed loop system on HWY 5 and with the option of a 4:SK telemetry ($375) and could be added to the system if interconnect wire is added between the signals, if tho system remains non - interconnected the controller can still run time of day and the taming modifications can be loaded through a spare Data Key if needed or directly connected to the Aries Closed Loop system computer. MNDOT leas stated this is a "30%" plan, City Engineer Chris Long had mentioned, conceptually there has not been a determination if some or perhaps all of the impacted utilities will be pulled out of the MNDOT right of way. This issue will also need to be resolved so that proper planning can occur and should be part of future discussions. These meetings are anticipated to require perhaps 20 hours of engineering time at $120/hour 'Phis would be in addition to time possibly needed from the City Attorney for review if also desired. The first meeting is proposed for Dec 14"', 2011 and staff is prepared to attend at this point if desired by the City Council. Grantee agrees to meet the timelines established for the submission and /or completion of the following key project benchmarks. Grantee must submit an ongoing maintenance plan detailing now the playground will be mainlained, who will conduct the maintenance, and how the maintenance plan will be budgeted. d) No later than 2 weeks after the Build mate: I. Grantee must submit the equipment invoice showing the equipment order, their payment, and a remaining balance of $20,000. i!. Grantee must submit Grantee Completion Report. A portion of the report consists of a post -build survey, which will be providers by KaBOOMi. In addition, the grantee must include ri project summary, photographs, and media stories that document the project's progress and execution. GENERAL REQUIREMENT'S FOR ALL ELEMENT'S — (unless noted"*): A. All play structures shall meet the age - related design criteria and be suitable for 2.. 5 year olds. and be suitable for 5 -12 year olds. GENERAL PLAYGROUND EQUIPMENT GENERAL SPECIFICATIONS UNLESS OTHERWISE SPECIFICALLY NOTED: a. Safety signage must be provided and installed and must include the ages equipment is planned for and that parental supervision is required. b. A wood fiber base (or approved alternate) with a geotextil.0 ground cloth must be provided and installed, The wood fiber must be an engineered or wood finer that is approved for handicapped accessibility, Documentation of this requirement must be provided. The wood fiber must meet current CI"SC standards, ASTM 0=1951 -99 and ASTM 1=1292 -99 standards and in the appropriate depth. c. The wood fiber base must be enclosed with an approved border designed to contain the wood fiber, d. An accessible play curb must be installed at the playground access. e. "Kick out mats" must be provided and installed under all slides over 3 feet in height. Such mats shall be approved by the City and at least 3' x 3' in dimension. f. Documentation must be provided that the play equipment proposed is age - appropriate. g. Documentation must be provided that the playground meets the requirements of the current American Society for Testing Materials. h. Documentation must be provided that all playground equipment provided is covered by product liability insurance. j. Documentation must be provided that the wood fiber proposed for the base material has boen approved for handicapped accessibility and for use in a public playground. m. Ali equipment provided and all arias around and between equipment must comply with the most current Consumer Project Safety Commission (CPCS) guidelines and the American Society for Testing and Material (ASTM) standard. Equipme nt that requires labor intensive measures or modifications, after installation, such as the cutting of bolts off, to bring the equipment into conformance with CPSC and ASTM will not be accepted. Documentation must be provided that the playground equipment proposed meets the current Consumer Product Safety Commission Guidelines for public playgrounds. n. All materials shall have a demonstrated record of durability in tyre playground or similar outdoor setting. All metals shall be painted, galvanized, or otherwise treated to prevent rust. Slack steel is not acceptable. o. All fasteners where applicable shall be yellow zinc di- chromate plated steel o r 18 -8 grade stainless steel. All clamps shall be die cast of high strength 380 aluminurn alloy or galvanized steel. Tenzalloy (40 -E, 315.0) is not acceptable as a load bearing clamp material. p. Rotationally Molded Plastic Parts shall be from color - compounded, first quality, linear low density polyethylene. Dry- blended or molded -in resins are not acceptable. Provide a warranty (2 year minimum) kit and materials. Warranty shall cover all parts, service and installation. 4. ADDITIONAL BIDDER /CONTRACTOR RESPONSIBILITY TO PROJECT * t. Provide, Deliver all playground equipment and related materials (borders, mats, etc) to the site and stage for volunteer installation. 2. OWNER /CITY RESPONSIBILITY TO PROJECT: 1. Site grading and leveling (if necessary and as determined by City). 2. Provide between 20 and 36 adult volunteers to the "BUILD DAY' and provide tools to volunteers. 3. Purchase and installation of drain tile (if necessary and as determined by City). 4.
