Dear Mr. Richards,
We are proposing to construct a four (4) story, 120 -unit assisted living facility ( "Project ") on the
property located at 5700 Oakgreen Avenue North ("Property"). Please accept this letter as part
of our application for a 15 foot variance from the City of Oak Park Heights ( "City ") zoning
Code ( " Code ") which imposes a 35-foot maximum height for residential structures. we
respectfully request that the City grant the variance because the Project is consistent with the
overall spirit and intent of the Code and a literal enforcement of the ordinance would result in
unnecessary and undue hardship.
"Undue hardship" as used in connection with the granting of a variance means the property in
question cannot be put to a reasonable use under the requirements of the zoning Code because of
circumstances which are unique to the property. Importantly, the variance, if granted, cannot
alter the essential character of the community. The Minnesota Court of Appeals has explained
that the undue hardship requirement does not mean that a property owner must show the land
cannot be put to any reasonable use without the variance. Father, the undue hardship standard
requires a showing that the property owner would like to use their property in a reasonable
manner that is prohibited by ordinance.
Here, we are proposing to use the Property in a reasonable manner. The proposed assisted living
facility is consistent with the City's future land use plans and the proposed structure meets all
other Code requirements related to lot coverage and setbacks. Because of the unique topography
and the existing power lines on the northern side of the Property, the footprint of the building
must be reduced and placed on the lot in a particular location. Therefore, we need some
flexibility in the height of the building. The slightly taller building will not in any way look out
of place or alter the essential character of this neighborhood.
Importantly, our request not only, meets the state law requirements for granting a variance, but it
is also consistent with the requirements of the City Code. The taller building will not impair the
supply of light to adjacent properties nor will it unreasonably increase congestion on the
surrounding streets. Assisted living facilities are permitted within this zoning district and the
proposed use is consistent with the City's comprehensive plan.
In order for the project to be economically viable, we need the density supported by this taller
structure. we cannot achieve economies of scale and provide affordability without this. Finally,
ranting the variance will not result in a decrease to neighboring property values in fact, we
believe that by granting the variance, the City will be allowing us to construct a Project that will
have a positive imp act on property values in this area.
Both state law and the City Code allow the City to relax certain zoning requirements when the
City Council determines that such deviation will not be contrary to the public interest and that
the deviation 's justified because of unique conditions which would cause a literal enforcement
of the ordinance to result 'n unnecessary and undue hardship. Because our proposal is a
reasonable use of our Property and because the flexibility is needed due to unique circumstances
including topography and existing power lines, we respectfully request that the City grant our
request for a 15foot variance from the maximum height restriction in the Code.
