In that this has been a controversial project in which the City Council has not been entirely comfortable with the increases in density proposed, Staff felt it necessary to also draft resolutions that would deny the current proposal. Please find attached the two draft resolutions. Votes Required Please note that Section 401.06,G. of the Zoning Ordinance requires that an amendment of a PUD amendment requires a four -fifths vote of the City Council. Comprehensive Plan At their December 13, 2011 meeting, the City Council voted to amend the Comprehensive Plan Land Use Map to change the land use classification of this property from medium density residential to high density residential, subject to approval of the Metropolitan Council. Staff has delayed forwarding the amendment to the Metropolitan Council until the City Council makes a final decision on Oak Park Senior Living. If the City Council is inclined to deny the Oak Park Senior Living project, it should also reverse its decision on the amendment to the Comprehensive Plan Land Use Map and vote to . change the land use classification back to medium density residential. The single greatest reason to deny a Planned Unit Development amendment is if it is not in conformance with the Comprehensive Plan. This action should be taken prior to the approval of the resolutions for denial. Please find attached a resolution that has been drafted related to the Comprehensive Plan land use designation. Page 94 of 190 The resolutions for denial indicate that the project is not in conformance with the Comprehensive Plan. Timeline The application for the Oak Park Senior Living Phase I Planned Unit Development amendment was received on September 20, 2011 and deemed complete on October 28, 2011. The City had extended the 60 day timeline to 120 days with a letter sent on September 22, 2011. The 120 day time line ends on February 24, 2012 unless Mr. Nolde agrees to provide an extension. In that there is only one City Council meeting in February on the 28 the City Council will need to act on this request at their January 31, 2012 meeting. 2 Page 95 of 190 RESOLUTION NO. CITY COUNCIL CITY OF OAK PARK HEIGHTS WASHINGTON COUNTY, MINNESOTA A RESOLUTION ESTABLISHING FINDINGS OF FACT AND RESOLUTION OF THE CITY COUNCIL THAT THE PROPOSED LAND USE MAP OF THE COMPREHENSIVE PLAN 2008 BE AMENDED WHEREAS, the City Council of the City of Oak Park Heights approved the 2008 Comprehensive Plan at their December 23, 2008 meeting subject to final review and approval of the Metropolitan Council; and WHEREAS, the Metropolitan Council approved the Oak Park Heights Comprehensive Plan 2008 on October 14 of 2009; and WHEREAS, the City of Oak Park Heights has received a request for a Planned Unit Development amendment as it relates to the Oak Park Senior Living Phase 1 and Phase 11 allowing an increase in density for the affected property between Oakgreen Avenue and Nova Scotia Avenue north of 58 Street North; and WHEREAS, the Planned Unit Development amendment necessitates a change to the Proposed Land Use Map of the Comprehensive Plan 2008 from medium density residential to high density residential land use; and WHEREAS, the City Council of the City of Oak Park Heights, at their December 13, 2011 meeting voted to amend the Proposed Land Use Map of the Comprehensive Plan 2008 for the affected property from medium density residential to high density residential land use subject to review and approval of the Metropolitan Council; and WHEREAS, the City Council of the City of Oak Park Heights, after further consideration and review of the Comprehensive Plan has determined that the land use classification for the affected property should remain as medium density residential land use. The City Council of the City of Oak Park Heights makes the following findings of fact and resolution: 1. The real property affected by said application is legally described as follows, to wit: SEE ATTACHMENT A and 2. The applicant has submitted an application and supporting documentation to the Community Development Department consisting of the following items: SEE ATTACHMENT B and Page 96 of 190 3. The City of Oak Park Heights did not forward the amendment of the Proposed Land Use Map of the Comprehensive Plan 2008 changing the land use classification of the affected property from medium density residential to high density residential property to adjoining jurisdictions, affected agencies or to the Metropolitan Council. As such the amendment was not yet been enacted; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE FOLLOWING: A. The City Council of the City of Oak Park Heights, after further consideration and review of the Comprehensive Plan has determined that the land use classification for the affected property should remain as medium density residential land use and hereby reverses its action taken at the December 13, 2011 City Council meeting. Suite 100 Anoka, MN 55303 Phone: 763.231 .5840 Facsimile: 763.427.0520 TPC©PlanningCo.corn PLANNING REPORT -- CITY COUNCIL TO: Eric Johnson FROM: Scott Richards DATE: January 24, 2012 RE: Oak Park Heights — Oak Park Senior Living Phase I - Planned Unit Development Amendment - City Council TPC FILE: 236.02 — 11.06 The City Council, at their November 29, and December 13, 2011 meetings reviewed the Oak Park Senior Living Phase 1 application for amending the Oakgreen Village Planned Unit Development (PUD) to allow for a reduction in the number of approved townhome units but increase the density by constructing three brownstone senior living buildings. The project is at Nova Scotia Avenue North and 58 Street. At the November 29, 2011 meeting, the City Council had asked the developer to reduce the number of total units from the original submittal of 350 which included the existing townhomes and the Oakgreen Commons building (120 units). The developer came back with a proposal to reduce the total to 334 units. At the December 13, 2011 meeting the City Council approved a motion to send the proposal back to the Planning Commission with two conditions as follows: 1. The third story on Building 4 shall be eliminated. Only two stories of dwelling units will be allowed for Building 4. 2. The overall density of the development, including the existing townhomes and Oakgreen Commons shall not exceed 275 to 291 dwelling units. The developer has now reduced the total units to 291 and eliminated the third story on all of the buildings. The Planning Commission, at their January 12, 2012 meeting reviewed the new plan and recommended on a 2 —1 vote the revised plan for Oak Park Senior Living Phase I with the following conditions: 1. The third story on buildings 1, 2 and 3 should be eliminated. Only two stories of dwelling units shall be allowed for buildings 1, 2 and 3. Page 98 of 190 • 2. The overall density of the development, including the existing townhomes and Oakgreen Commons shall not exceed 291 dwelling units. Attached for reference: Exhibit 1: Original Submittal Master Plan — Phase 1 and 11 Exhibit 2: Revised Master Plan - Phase I and 11 — December 29, 2011 Exhibit 3: Revised Master Plan with Parking Counts Exhibit 4: Building Elevations — Two Stories Exhibit 5: January 12, 2012 Planning Commission minutes (not approved) Phase I Tim Nolde has provided revised plans for Phase 1 that reduces the total number of units. The three buildings will now be two stories instead of three. The footprint of Building 2 has been reduced to create additional open space. The four unit townhome building at the intersection of 58 Street and Nova Scotia Avenue North has been eliminated. The units now proposed with this amendment are as follows: One level townhomes (7 constructed) 7 dwelling units Multi level townhomes (4 constructed) 4 Townhomes to be constructed 4 Building 1 22 Building 2 22 Building 3 50 Total 109 dwelling units (134 previously) Parking The applicant has provided updated plans that include parking counts. The plan shows 497 parking stalls and 51 proof of parking stalls for an overall total of 548 parking stalls. There is adequate parking to meet City requirements for senior housing. Building Design The applicant has provided updated elevation plans to show the two story design. The Planning Commission was favorable with the revised elevation plans. 2 Page 99 of 190 Timeline The application for the Oak Park Senior Living Phase I Planned Unit Development amendment was received on September 20, 2011 and deemed complete on October 28, 2011. The property was approved by the City Council for a Planned Unit Development, general plan by the City Council on May 27, 2008; and 4. The Planned Unit Development amendment for Oak Park Senior Phase 1 includes a total of 109 units, 15 of which are single and multi level townhomes and 94 brownstone units in three buildings; and 6. City staff prepared a planning reports dated November 3, 2011; December 8, 2011; and January 5, 2012 reviewing the request; and 7. Said reports recommended approval of the amended Planned Unit Development amendment subject to the fulfillment of conditions; and 8. The Planning Commission held a public hearing at their November 10, 2011 meeting, took comments from the applicants and public, closed the public hearing, and recommended that the application be approved with conditions. 9. The City Council reviewed the application, the Planning Commission recommendation and the comments of the public and continued the discussion to the December 13, 2011 meeting with a request to the applicant to reduce to density of the overall project to 275 to 291 units and to remove the third story of Building 4. The City Council also approved a motion to send the application back to the Planning Commission. 10. The Planning Commission held a public hearing and reviewed the revised plans at their January 12, 2011 meeting, took comments from the public and the applicant, and recommended the Planned Unit Development Amendment for Oak Park Senior Living 1 with the following conditions: (1.) NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF OAK PARK HEIGHTS THAT THE CITY COUNCIL APPROVES THE FOLLOWING: A. The application submitted for a Planned Unit Development amendment as it relates to Oak Park Senior Living Phase I (formerly Oakgreen Village) allowing a reduction in the approved number of townhome units, construction of brownstone units and an increase in the density at Nova Scotia Avenue Street North and affecting the real property as follows: SEE ATTACHMENT A 2 Page 102 of 190 Be the same as hereby approved by the City Council of the City of Oak Park Heights with the following conditions: 1. The preliminary and final plat, as well as the dedication and vacation of any easements shall be subject to the review and approval of the City Engineer and City Attorney. 2. The City Council is favorable to the proposed density of the project with 109 units in Phase I and 291 units in total for the development. 3. Buildings 1, 2 and 3 shall not exceed two stories of dwelling units. 4. The development agreement shall include provisions enforcing Developer's assurances that the Oak Park Senior Living Phase I will remain as senior rental housing and shall not be converted to non age restricted rental housing. Reasonable security in the form of escrows, tax increment forfeitures, permit suspension and other consequences for default of this provision by the Developer or its transferees and assigns shall be imputed into the development contract and be subject to the approval of the City Attorney. 5. The City Council approves the added parking and changes to the private access roadway and cul de sac adjacent to Nova Scotia Avenue North as reflected in the Master Plan and Traffic Analysis received by the City on December 8, 2011. 6. The Park Commission was favorable to the proposed private and public trail system subject to the approval of the City Council. 7. The City Council approves a setback minimum of 20 feet for Building 1 from the right of way line of Nova Scotia Avenue. 8. All tree removal and landscape plans shall be subject to review and approval of the City Arborist. 9. The grading and drainage plans shall be subject to City Engineer and applicable watershed authority review and approval. 10. All utility plans shall be subject to review and approval of the City Engineer. 11. The City Council was favorable to the use of the non shielded, residential style light fixtures the buildings. 12. The applicant shall submit any plans for new signage subject to City approval. 13. The projected traffic counts are subject to review and approval of the City Engineer. If the intersections at 58" Street and Oakgreen Avenue and /or Nova 3 Page 103 of 190 Scotia Avenue requires signalization or other traffic control measures, the applicant shall agree to the share of the costs as outlined in the Development Agreement and as determined by the City Council. 14. The Fire Marshal and Police Chief shall review the plans and determine the accessibility of emergency vehicles throughout the development. The Fire Marshal and City Engineer shall determine if the entrances onto Nova Scotia Avenue should be widened to allow for better accessibility of fire equipment. 15. The trails and sidewalks shall be constructed in accordance with the City Engineer's review and approvals. 16. A revised snow storage area plan shall be provided to the City by February 29, 2012 subject to review and approval of the City Engineer. 17. All air handling vents or condensers shall be installed in the building or placed on the roof and totally screened subject to approval of the Building Official. Any electrical or gas equipment and transformers that are ground mounted or visible from adjacent streets shall be screened as required by the Zoning Ordinance. 18. The den rooms in the dwelling units shall not be converted to bedrooms. 19. The City Council was favorable to the final building appearance, colors, materials and the variety between buildings. The applicant shall provide a materials board for all of the buildings to be subject to review and approval of the City Council. 20. The development agreement shall include a requirement that all of the buildings be maintained in proper condition and in compliance with City Codes. 21. The applicant shall be required to enter into a development agreement. The development agreement shall be subject to the review and approval of the City Attorney and City Council. 22. The proposed multi level townhome four plex is to be constructed of the same building materials and appearance as the building at 5812 -5818 Nutmeg Court North and all of the existing and proposed one level townhomes are to be constructed with the same building materials and appearance as the building at 13848 -13872 Upper 58"' Street subject to review and approval of the City Building Official. 23. The applicant shall provide additional details for the private park area including elevations of the gazebo, materials to be used in the structures and walkways, and landscaping details for review and approval of the City Council. 4 Page 104 of 190 24. Phase 1 including the townhome units and Buildings 1, 2 and 3 shall be completed by the applicant and ready for occupancy no later than December 31, 2013 unless extended by the City Council. 25. The applicant shall provide to the City payment in lieu of taxes if the properties subject to this approval are converted to a tax exempt status as provided for within the Development Agreement. 26. The project shall be subject to an annual inspection and review at the discretion of the City to ensure compliance with the conditions of Planned Unit Development approval and the Development Agreement. 27. Parking shall be allowed on only one side of the private roadway system in the development, subject to review and approval of the City Engineer. The overall density of the development, including the existing townhomes and Oakgreen Commons shall not exceed 291 dwelling units. The application submitted for a Planned Unit Development amendment as it relates to Oak Park Senior Living Phase 1 (formerly Oakgreen Village) allowing a reduction in the approved number of townhome units, construction of brownstone units and an increase in the density at Nova Scotia Avenue Street North and affecting the real property as follows: SEE ATTACHMENT A Be the same as hereby denied by the City Council of the City of Oak Park Heights with the following findings of fact: 1. The project density does not conform to the medium density land use classification of the subject property as specified in the Comprehensive Plan. 2. The density of the project is not appropriate for the project area and is not compatible with the surrounding single family neighborhoods to the south and east. 3. The potential traffic generation from the proposed number of dwelling units could adversely impact the intersections of Nova Scotia and 58' Street and Oakgreen Avenue and 58 Street. 4. The narrow private street system with a high density of elderly residents will be problematic for access by emergency vehicles. 5. Long term maintenance of the buildings and the grounds as a rental complex is a concern for the health, safely and welfare of the residents and the surrounding neighborhoods. Please find the following results: Boutwells Landing 1 have calculated the density in two ways, one as a total development and second, just the main campus with the higher density development. Total Development The Boutwells Landing development consists of a total of 116.7 acres which includes the City Park land that is 11.10 acres. That results in a development area of 105.6 acres. There are 537 housing units in the overall development. The density calculation is as follows: 105.6 (4,599,936 sq ft) / 537 units = 8,565.9 square feet per unit. Main Campus The main campus consists of a total of 38,8 acres. There are 404 units in the main campus. The density calculation is as follows: 38.8 (1,690,128 sq ft) / 404 units = 4,183.4 square feet per unit • Page 115 of 190 Oak Park Senior Living Phase 1 and 11 The most recent plan for Oak Park Senior Living Phase 1 and 11 indicate a total of 291 units. This had been reduced from the original submittal of 350 units. Both of these totals include the 120 units in the Oakgreen Commons building and the existing townhomes that will remain.
