Most of the issues are present at the paved parking areas directly south of the new City Hall building Drainage Issues take the form of three (3) individual small depressions (i.e., "bird- baths ") that retain water until evaporation and would be a slip hazard whenever such water – when present - would freeze. Aesthetic Issues are four (4): Bituminous materials not neatly terminated at edges of concrete gutters (rather, those materials are irregularly onto those gutters); aggregate particles of the bituminous mix are exposed on the paving surface at several areas, are subject to rapid wear and thus have less longevity than as designed; joints are readily apparent between application "passes" (rather than blended together) in o several areas; and painted striping /accessibility symbols are irregularly placed, without clean edges and, otherwise not properly applied. Background o 1. The Construction Documents describe the Work: Drawings C2 and A1.0 and Specification Section 321000 Plant Mix Bituminous Pavement. 2. The Bituminous Paving Design Mix Submittal was approved and retumed to the General Contractor on October 22, 2009. 3. The bituminous installation of the paved parking areas directly south of the new City Hall o building occurred in early to mid- September, 2010. The above - stated issues were noticed directly after the installation. That was followed by a notification of the above - stated issues sent to the General Contractor on September 14, 2010 followed by two site meetings with the General Contractor and Bituminous Subcontractor and issuance on September 27, 2010 of a Timeline of events (attached). A response was requested from the General Contractor. 4. Braun Intertec had been requested for a quotation for professional services to provide visual o inspection and coring /testing of the installation (the latter to verify density of the installation) on September 20, 2010. A quotation was received but not acted upon. 5. The Bituminous Subcontractor has suggested repair recommendations and advised of similar locations that could be reviewed and that his organization had accomplished. 6. The Architect toured sites in Osseo and Maple Grove on September 30, 2010 and October 4, 2010 and found the outcomes to not be acceptable (i.e., they were "patch jobs "). The Architect, after consultation with the City of Oak Park Heights, sent a communication to the General Contractor on October 6, 2010 that provided different options to resolve these issues (attached). 8. Later that day and after the Bituminous Subcontractor recommended a "chip and seal" solution, the Architect, after consultation with the City of Oak Park Heights, sent another communication to the General Contractor indicting that reinstallation of the 1.5" top course of bituminous paving is the feasible solution to this issue. Possible Options • Replacement of the1.5" top course of bituminous paving in the paved parking areas directly south of the new City Hall building in Spring 2011. • Have the Contractor provide a "chip and seal" application to the: paved parking areas directly south of the new City Hall building, to the South Parking Area and to patched -in areas of 57 street and O'Brien Avenue directly adjacent to the new roadway construction; provide an extended (5 year) labor and materials warranty to this work and removal of bituminous materials slopped onto the concrete gutters all in Spring 2011. • A monetary settlement. • Accept the installation in place as installed. The Possible Options discussed above are for review and consideration by the City of Oak Park Heights. One or more may be addressed to the General Contractor for their review, consideration and response. Issues were discussed and further discussion with Jorgenson Construction planned for Project Meeting Forty - Six of 9/23/10. .9/21/10 Requested and received Professional Services Proposal from Braun Intertec for Visual Assessment, Coring and Testing of bituminous pavement if required. . 9/23/10 Project Meeting Forty -Six of this date included discussion of observed issues found with recent paving installation. Discussion as follows: Relevant Issues (discussed at 9/20/10 onsite meeting): 1. Edges of bituminous paving at concrete curbs /gutters are too high, not neatly applied and slopped over the gutter edges in spots. It is expected that these edges will be subject to premature edge deterioration over a short period of time as water gets between concrete gutter and bituminous paving (aesthetic issue and durability issue). 2. Three (3) individual "bird bath" ponding areas are still present notwithstanding whatever effort was previously applied to base course by Subcontractor (Harddrives). A solution such as surface patches may be short term in nature. However, an alternative of pavement area cut -outs and reapplication of wear course with visible abutting joints would not be acceptable (aesthetic issue and durability issue). 3. Exposed aggregate in the wear course that are visible at paving surfaces are not acceptable. It is expected that those surfaces will be subject to premature edge deterioration over a short period of time. (aesthetic issue and durability issue). 4. Painted striping lines and symbols: do not have sharp and distinct edges (windy conditions notwithstanding), stop short of concrete gutter in many instances, is shorter Page 1 of 2 than adjacent such lines at one accessible stall and have one accessible wheelchair symbol placement located inconsistent with two adjacent similar symbols (aesthetic issue). 5. Terminations of new paving adjacent to existing paving in the south parking lot and at O'Brien Avenue /57th Street are zigzag and are irregular in shape. A straight cut was shown in the Construction Documents for these locations (aesthetic issue and durability issue). 6. Areas composed of surface "fines" aggregate are crumbling in some areas (durability issue). 7. Specified MV3 mix design is for heavy duty use (with 3/4" aggregate) but, if properly applied and without letting mixture cool, can be applied so as to be uniform in appearance, without aggregate showing or projection to the top of the surface. Exposure of aggregate can lad to pop -outs and quicker deterioration of paving surface. The heavy duty MV3 mix has been placed with relatively smooth surface texture in certain areas of this installation so it is apparent that an acceptable installation can be achieved (aesthetic issue and durability issue). 8. Drainage slope of main parking lot from east to west a distance of 64' at 1/8" per foot drainage slope is typical - not unusual - The design is not faulty or unusual (aesthetic issue and durability issue). 9. Bird baths must be avoided even with 1/8" per foot drainage slope. That slope is commonly implemented and is successfully achieved in other installations (aesthetic issue and durability issue). 10. Potential solutions discussed included: removal and replacement of paving OR leaving paving as installed with credit granted to Owner to reduce paving installation price OR repairing by application of fines and heating OR extended performance warranty. Potential outcome(s) discussed 9/23/10 meeting: 1. Owner may be interested in having only main parking lot located south of new City Hall improved in appearance and durability. That would require replacement of: wear course, striping, top elevation of wear course same as concrete gutter, neat installation and no bird baths. 2. Remainder of installation would be deemed acceptable but with extended warranty. 3. No increase in Contract Price. 4. A response is sought from Jorgenson Construction ASAP. I believe that the bituminous paving and repair work achieved at those locations are similar to what the Paving Subcontractor had discussed last week. In both of those areas that I visited, repaired /patched areas, existing joints and existing cracks were more -or -less visible through the tops of the paved surface - signs of repair and renewal work to existing bituminous paving. It looks like that would be the same result at the newly paved areas at the Oak Park Heights City Hall if infrared heat repairs and a seal coating would be utilized to correct the visible deficiencies of the wear course of the heavy duty paving located on the west side of the site and on public streets and /or at the visible deficiencies of the wear course of the light duty paving located on the east side of the site in front of the new City Hall building. The paving Subcontractor had indicated that the installation is sound although special testing has not occurred to substantiate that claim. The cost of such testing would be borne by the Contractor if the installation would be found after testing to be not in compliance with the Contract. The cost of such testing would be borne by the City if the installation would be found after testing to be in compliance with the Contract. I am not - at this time - advocating such testing. I will contact the Owner about these findings and will discuss the following options that have been previously discussed: (1) Accept the installation of heavy duty paving on the west side of the site and on public streets at: Oak Park Drive North; the Public Works Building: the Public Page 1 of 2 Works Storage Yard; Garage Driveway; Police Impound Yard; Oak Park Boulevard North, 57th Street, O'Brien Avenue and in the South Parking Area. (2) Accept paragraph (1) above as well as the current light duty paving on the east side of the site (i.e., at the driveway and parking area in front of the new City Hall) subject to a cost credit to the Contract for the unacceptable installation on the east side of the site. (3) Accept paragraph (1) above but not the current light duty paving on the east side of the site (i.e., at the driveway and parking area in front of the City Hall installation) until the Contractor repairs to the Owner's satisfaction the already - identified wear course deficiencies on the east side of the site utilizing the infrared heating and seal coat applications. (4) Accept paragraph (1) above but not the current light duty paving on the east side of the site (i.e., at the driveway and parking area in front of the City Hall installation). The wear course must be replaced with an installation that complies with the Contract and meets the Owner's satisfaction. Please let me know If you have anything to add to the above. Mike Leuer of Harddrives called me today and suggested the placement of a hot aggregate seal (or "chip seal ") onto the light -duty paving areas located on the east side of the site. After consideration, discussion with the City's Consulting Engineer and after speaking to the Owner, find that to be an inappropriate application as well as a unsatisfactory solution for newly - installed paving. The various repair options are not feasible and, thus the following must be achieved at this time: The recently - placed wear course of the light -duty paving located on the east side of the site (i.e., at the driveway and parking area in front of the City Hall installation) is not acceptable per comments stated below. The wear course must be replaced with an installation that complies with the Contract and meets the Owner's satisfaction as follows: 1. Edges of bituminous paving at concrete curbs /gutters are too high, not neatly applied and slopped over the gutter edges in spots. It is expected that these edges will be subject to premature edge deterioration over a short period of time as water gets between concrete gutter and bituminous paving (aesthetic issue and durability issue). Reinstallation of the 1.5" wear course must place the 1.5" thick wear course level with the adjoining concrete gutter and without spillovers onto concrete gutters. 2. Three (3) individual "bird bath" ponding areas are still present notwithstanding whatever effort was previously applied to base course by Subcontractor (Harddrives). A solution such as surface patches may be short term in nature. However, an alternative of pavement area cut -outs and reapplication of wear course with visible abutting joints would not be acceptable (aesthetic issue and durability issue). Carried 5-0. Dick Johnson, a resident of Oak Park Heights, requested clarification on whether the 1995 plan was approved by the City Council. City Attorney Vierling reported that there was an approval of the concept layout but there have been a number of changes since then. Vieding stated that the City's position is that the current plan was not in compliance with the 1995 plan. H. Mayor Beaudet, seconded by Councilmember Abrahamson, moved to 410 cancel the first meeting in February; move the March 23 meeting to March 30; cancel the first meetings in June, July, and August subject to the call of the City Administrator, and move the November 23 meeting to November 30.
