Dear Mr. Gilbertson:
Thank you for your recent communications regarding upgrading the exterior appearance and sign
package of the 5800 Neal Ave. N., Oak Park Heights, MN Valvoline Instant Oil Change.
At its April 14, 1998 meeting, the Oak Park Heights City Council approved requests of SuperAmerica
and Valvoline Instant Oil Change, including rezoning from 0, Open Space to B -2, General Business
District; a Planned Unit Development /Conditional Use Permit to address access and internal setback
issues; a conditional use permit for the automotive fuel station, oil change facility and car wash; a
variance from sign requirements; and the subdivision to create separate lots for the SuperAmerica and
Valvoline facilities. These approvals were subject to a number of conditions, which were made part
of the August 21, 1998 Developer's Agreement. A copy of this Development Agreement is attached
for your reference.
The subdivision was granted a pylon sign at Hwy. 5 and 58 St., which is in place with VOIC sign panels
installed.
The subdivision was also granted the choice between a monument sign at Neal Ave. or the installation
of "Simeks" and "SuperMoms" signs at the Neal elevation of the SuperAmerica store. The monument
sign at Neal Ave. was constructed and also houses VOIC sign panels.
VOIC was granted two wall signs, each on a different facade and the colored facade band on the
eastern and western elevations of the store conditioned that the band not be lit.
Zoning Ordinance 401.15.G.9.d allows for one wall sign per street frontage, with a maximum of two
signs total. The maximum area of signage permitted is 100 square feet or 15% of front building
fagade, up to 300 square feet, as shown in 401.15.G.9.d.1. I have attached this ordinance for your
reference and use.

Based upon the approvals granted and upon the information you have provided regarding upgrading
the sign package for the 5800 Neal Ave. N. VOIC, your proposal exceeds development approvals and
City Zoning Ordinance 401 requirements as it relates to wall signs and illumination of the western
elevation band.
The illuminated signs over the doorways, replacing those that are in currently I place, appear to
comply with development approvals and City Zoning Ordinance requirements. The illuminated logo
band with "instant oil change" text upon it at the western elevation would be considered a second
sign to that facade and is not permitted.
The three non - illuminated, aluminum bay indicators to the eastern elevation, as proposed with logos
upon them would be treated and three individual signs and exceeds the number of signs permitted
upon a single facade. If you were to remove the logos and the place the indicators without
illumination, they would be acceptable.
The proposed panel replacements to the pylon and monument signs appear to comply with
development approvals and City Zoning Ordinance 401 requirements.
The red barrels are not to be illuminated per development approvals. If, as you indicated, they are,
this is a violation of development approvals and such illumination shall be terminated no later than
Monday, March 22, 2010.
The two framed wall signs and framed ground signs were not approved as part of the development
approvals for the site and are to be removed no later than Monday, March 22, 2010.
If you wish to seek a comprehensive sign plan review and variance consideration to City Ordinance
401.15 as it relates to signage for your store, please let me know and we can commence that dialogue,
keeping in mind that variances are based upon hardship.
