Oak Park Heights, MN 55082 Re: Fence & Yard Dear Mr. Belz, I appreciate the time you and your daughter shared with Building Official, Jim Butler yesterday during our site visit to your home. Per our conversation at the time of visit, you agreed to have the pile of debris, dirt and other items cleaned up from yard area at the end of your driveway area no later than Monday, May 25, 2009. Jim did speak with our City Planner regarding the composition of your fence pieces and was advised that they do constitute a fence structure. Accordingly a fence permit is required. Remit your completed fence permit application to Jim Butler by the end of the day Monday, May 25, 2009 or have the fence taken down no later than Monday, May 25, 2009. For your convenience I have enclosed a fence permit handout which includes City Ordinance 401.14.E. Fencing, Screening and Landscaping, a permit application, Memorandum of Acknowledgement (for neighbor signature if the fence is located 3 feet or Tess from the property line shared with an adjacent neighbor), and a site plan which you may note your fence locations and specific information related to heights, material, location and setback. At this time the City is taking no issue with the container plants situated in the rear yard, with the express understanding that these plants are not part of your permitted home business, that they and their container and related supplies are kept tidy, and that no sale of these plants is occurring at the residence. This includes any type of plant "yard" sale. Should such a sale occur or the City become aware of the plants being used as part of a business at the home, the situation will be readdressed. Finally, please be reminded that when mowing your lawn or weed - whipping, that the vegetation should remain in your yard and not be distributed in any way to the properties adjacent to your home or the roadway. Please give Jim or I a call if you have any questions regarding this letter or what is needed.
