While these were missed by the City during final inspection, Wal-Mart is obligated to correct these trail deficiencies. Per City Council directive; I have enclosed a FINAL copy of the letter sent to the City's Congressional Delegation and to the St. Croix Crossing Coalition requesting specific legislative action. The Council directed that a letter be sent to Baytown Township advising them of the City's inquiry of purchasing the DNR lands. See enclosed document as sent C/O the Town Clerk. Related to this item I did receive a call Thursday morning from Rep Lohmer who indicated that she cannot support this request, but alternatively hopes that perhaps an arrangement can be made between the City and the Township. The poles have been placed on the sidewalk and restrict clear access to the sidewalk for pedestrian travel. (See the enclosed picture) Please note that this matter has been brought to our attention by a number of seniors who cannot access your facility on their personal mobility scooters. The City staff strives to provide top quality customer service to Oak Park Heights residents and endeavors to improve where possible, so comments or concerns are always welcome. From our phone conversation on Monday April 25, 2011, I understand your main concern was the small 1/8" chip rock covered in oil emulsion stuck to car tires and shoes and were inevitably carried into residents' homes. The tar covered rocks created a situation cumbersome to clean because of the small size, but also because of the tacky oil /emulsion coating. You suggested the City consider using a 1 /4" sized dresser trap rock. In 2010, the City specified CRS -2 Emulsion and 1/8" FA -3 class A aggregate. In the future, consideration will be given to include 1 /4" dresser trap rock, as well as a polymer modified CRS -2P emulsion in the specifications. The CRS -2P is said to set faster, potentially holding firm more trap rock and reducing the amount of tear up from at rest tires turning on a road surface. The ultimate goal is to reduce the amount of rock susceptible to attaching to tires or shoes and eventually being carried into homes. Please accept my apologies for the inconvenience the 2010 seal coat project has caused you and your neighbors on Nolan Lane. However, as the status of the Project remains fluid reasonable haste should be implemented to accomplish and affirmatively address any known issues that may unnecessarily forestall the Proj ect. Accordingly, it is the City's position that our federal legislators can aid the City in this process. By this, the City has prepared and sent correspondence to their respective offices requesting that should there be any proposed legislation to somehow facilitate the Project to move forward from this point that there be inserted into any action a requirement that the State of Minnesota Department of Transportation provide the full funding for ALL local costs anticipated to be incurred in the City of Oak Park Heights. (See Enclosed Letter Dated April 27, 2011) With this proposal, should it be successful, federal costs to the Project would not increase and would provide MNDOT with a clear and independent exception to its local cost share policies which have largely been the stumbling block between the City and MNDOT to finding the necessary common agreement. Dear Senator Franken, Senator Klobuchar and Representative Bachmann: At this time it is the City Council's understanding that there may be proposed legislation that addresses the matter of the proposed St. Croix River Crossing suggesting that the Wild and Scenic Rivers Act and /or a Section 7a review process would be waived, released or somehow amended to facilitate the Project and remove restrictions that have been judicially determined under the Wild and Scenic Rivers Act to have precluded the project to date. The City of Oak Park Heights does not by this correspondence take sides on this policy and the significant issues addressed in such proposed legislation vis -a -vis the Wild and. Scenic Rivers Act. However, as we have communicated with congressional offices in past years, there are significant financial impacts imposed by the proposed Project upon the City of Oak Park Heights, Minnesota. To date the City has already lost significant property, residences and commercial businesses taken as a result of right of way acquisition and which has negatively impacted the City's property tax revenues by over $500,000. Further, there are anticipated to be substantial financial losses by virtue of MNDOT cost sharing policies that prescribe that the City of Oak Park Heights must provide twenty (20) percent of costs associated with utility relocation, traffic signalization, as well as future trail and storm -water maintenance within the proposed right of way of the Trunk Highway 36 improvements that are necessary to the project. These local costs could rise into the millions when design, right -of -way acquisition and maintenance costs are included. As you might expect, a city of 4,339 cannot bear the financial burden and provide the funding necessary to even entertain these significant commitments for a regional project. This issue was addressed some years ago in 2005 when Representative Kennedy did secure some funding legislation that was intended to be directed to help the City with these costs but language within the draft allowed the funds to flow directly to MNDOT and those were applied by that agency to its needs not to those of the City. Moreover, to date the City has been unable to find local solutions to these policies with MNDOT. Accordingly, at this time the City is seeking legislative assistance and relief that as a federal condition to any exemption provided to the St. Croix River Crossing as it relates to the Wild and Scenic Rivers Act, or any other legislation or final funding allocation that would allow the Project to move forward, that the State of Minnesota shall be required within the text of the legislation to fully fund all local infrastructure replacement and related costs for the City of Oak Park Heights associated with the construction of the Project. These costs again include all aspects of water, sanitary and storm water utility relocations, traffic signalizations, storm water ponds and trail systems and their future maintenance and reconstruction. By proceeding as above, there would not a requirement for additional Federal allocation of dollars and does provide MNDOT a clear and precise exemption to its cost -share policies which have stymied final agreements between the City and MNDOT. It is vital to note that the total costs necessary to address the local costs pale in comparison to $650+ million Project estimate and such requirements upon MNDOT should not create any hardships towards MNDOT executing this Project. We again stress that the City's position is unique in -so -far as the City has already incurred substantial financial losses and that a community of 4,339 cannot be expected to provide disproportionate funding for a regional project to the magnitude required by the State of Minnesota Department of Transportation. Dear Senator Lillie: Thank you for talking the time to discuss the St. Croix River Crossing with myself and the City Attorney last week. We look forward to additional discussions. However, the purpose of this correspondence is on another topic of interest to the City Council, being the possible acquisition of the "DNR Lands" that are adjacent to the City's south border and along the west side of Osgood Avenue being across the street from the Department of Corrections High Security facility; (200 acres + / -, See attached map.) The City is interested in securing this property so that it can become public parkland and provide trail opportunities, but to also reduce if not eliminate hunting on such lands as the site is bordered by the suburban-type residential areas. Homes in Oak Park Heights have been hit with stray bullets /pellets, arrows and so forth, not to mention the seasonal gunfire noise. Accordingly, the City would like to request that the State entertain a possible sale to the City in a modest amount (i.e. not to exceed $400,000). The City would also be amenable to the imposition of the following conditions as part of the sale: • Restrictions keeping the lands largely in an "open- space" condition but allowing trails, park like facilities , biking opportunities, dog runs, play areas and other outdoor recreational opportunities for area residents. • Maintain current MNDOT storm water mitigation easements and we also would consider leaving the lands within the borders of Baytown Township for a five -year period after which they would automatically come into the City. (We would need a joint powers agreement with Baytown to provide for OPH police enforcement and parkland regulations to be imposed. • The City would perform required maintenance consistent with above uses and impose its park regulations consistent with its other park areas. • Allow a reasonable total or smaller -unit buy -back from the State in the event the City would ever discontinue the park land use. Please note that much of the land is undevelopable due to wetlands and/or high voltage power- lines. Understandably, there is likely a specific process by which the State would need to follow to divest itself of these lands, and the City does certainly offer any assistance we can in this matter. With four weeks remaining in the legislative session there is still a lot of work they will need to accomplish. Since our last update, the tax conference committee has met several times. The meetings have been informational and the committee has not voted on any amendments yet. As mentioned in previous emails, we do not expect that there will be anything in the final bills that will cause serious problems for CUC members but we will continue to monitor the progress of the committee.
